desideramus probabile genus hominum inpressa gratia dignitatis ornare, ut laudabilius unus quisque possit vivere, cum se honores reverendos cognoverit accepisse. sic enim et ad virtutis studia decenter ascenditur et a bonis civibus res publica plus amatur. atque ideo te spectabilitatis nitore decoramus, ut sententiam tuam in conventibus publicis spectandam esse cognoscas, cum inter nobiles decorus assederis, ut, si haec praedicabili conversatione tractaveris, in futurum praemiis melioribus augearis. Constat iucundum esse rerum bonarum saporem et utilem ambitum laudis, qui appetitur per augmenta virtutis.

We desire to adorn the worthy class of men with the impressed favour of dignity, so that each one may live the more praiseworthily, when he has known that he has received reverend honours. For thus one both fittingly ascends to the pursuits of virtue, and the commonwealth is the more loved by good citizens. And therefore We adorn you with the lustre of the spectabilis rank, so that you may know that your opinion is to be regarded in public assemblies, when you sit comely among the nobles, in order that, if you handle these matters with commendable conduct, you may in future be increased with better rewards. It is agreed that there is a pleasant savour to good things and a useful pursuit of praise, which is sought through the increases of virtue.

hoc nos studium providae liberalitatis infundimus, ut maior sit cultus morum, dum crescunt desideria praemiorum. clarissimatus igitur honorem, ornamenta iudicii nostri, regia tibi largitur auctoritas, quod praebeat et exactae vitae testimonium et futurae prosperitatis polliceatur augmentum. quapropter nihil iam obscurum agere patiaris, qui clarissimatus dignitate resplendes. grande siquidem vitae testimonium est non tam clarum quam clarissimum dici, quando paene totum de illo optimum creditur qui tanti fulgoris superlativo nomine vocitatur. Superfluum quidem videtur tuitionem specialiter a principe petere, cuius est propositi universos communiter vindicare.

This zeal of provident liberality We infuse, so that there may be a greater cultivation of morals while the desires of rewards grow. The royal authority therefore bestows upon you the honour of the clarissimate, the ornaments of Our judgement, which both affords the testimony of a well-spent life and promises the increase of future prosperity. Wherefore now suffer yourself to do nothing obscure, you who shine resplendent with the dignity of the clarissimate. For it is a great testimony of life to be called not so much 'famous' (clarus) as 'most famous' (clarissimus), since well-nigh everything best is believed of him who is named with the superlative title of so great a brilliance. It seems indeed superfluous to seek protection specially from a prince, whose purpose it is to defend all in common.
8:80
sed quia securitatem tuam quorundam violentorum exsecranda temeritas inquietat, non piget dolentium querelis ad hanc partem pietatis adduci, ut quod omnibus praestare cupimus, supplicanti potissimum conferamus. atque ideo diversorum te, quemadmodum quereris, dispendiis sauciatum in castra defensionis nostrae clementer excipimus, ut cum adversariis tuis non, ut hactenus, campestri certamine, sed murali videaris protectione contendere. ita fit ut, truculentis viribus pressus, reddaris auxiliis regalibus exaequatus. Quapropter tuitionem tibi nostri nominis quasi validissimam turrem contra inciviles impetus et conventionalia detrimenta nostra concedit auctoritas:

But because the execrable rashness of certain violent men disturbs your security, it does not irk Us to be drawn by the complaints of the suffering to this part of pity, so that what We desire to grant to all We may confer chiefly upon the suppliant. And therefore We mercifully receive you, wounded, as you complain, by the losses inflicted by divers persons, into the camp of Our defence, so that you may seem to contend with your adversaries not, as hitherto, in open-field combat, but with the protection of a wall. Thus it comes about that, oppressed by savage forces, you are rendered made equal by royal aids. Wherefore Our authority grants you the protection of Our name, as it were a most strong tower, against uncivil assaults and the detriments of litigation.
8:81
ita tamen, ne, his praesumptionibus sublevatus, civile despicias praebere responsum et tu videaris insolens calcare iura publica, quem primitus detestanda premebat audacia. et quia ministros efficaces nostra debet habere praeceptio nec decet principem loqui quod non videatur posse compleri, praesentis beneficii iussione, adversus Gothos illa, adversus Romanos illa, facile te fides et diligentia custodivit: quia nemo laborat defendere quod timetur offendi, dum praestans dominus fieri formidatur ingratus. fruere igitur nostra clementia: beneficio laetare suscepto. nam si ulterius a quoquam sub incivilitate temptaris, tua de inimicis potius vota complebis.

Yet in such a way that, raised up by these presumptions, you do not disdain to give a civil response, and you yourself do not seem insolently to trample the public laws, you whom a detestable audacity first oppressed. And because Our precept ought to have effective ministers, nor is it fitting for a prince to say what cannot seem able to be fulfilled, by the command of the present benefit, against the Goths this man, against the Romans that man, faith and diligence have easily guarded you; since no one labours to defend what is feared to be offended, while the lord who grants is dreaded to become ungrateful. Enjoy therefore Our clemency; rejoice in the benefit received. For if you be thereafter assailed by anyone under incivility, you will the rather fulfil your vows against your enemies.
8:82
Aeternum est beneficium quod posteritatis fuerit favore collatum nec plus est conveniens regi quam si humanae praestet origini. in lucem quippe venturus casus suscipere non meretur adversos, ne ante gravamen districtionis incurrat quam gaudia supernae lucis inveniat. Oblata itaque supplicatione depromis mulierem quam tibi placitus illigavit amplexus, beneficio nostro iugali honestate debere sociari, ut ex ea liberi nati nomen nanciscantur heredum. nam cum spontanea copula animantia cuncta consociet dignumque unicuique videatur esse quod placuit, durum est ibi libertatem liberam non haberi, unde liberi procreantur.

Eternal is the benefit that shall be conferred by favour upon posterity, nor is anything more becoming to a king than if he should bestow it upon human origin itself. For he who is about to come into the light does not deserve to undergo adverse fortunes, lest he incur the burden of strict judgement before he finds the joys of the supernal light. Therefore in the petition offered you declare that the woman whom a pleasing embrace has bound to you ought, by Our benefit, to be associated with you in conjugal honour, so that the children born of her may obtain the name of heirs. For since a spontaneous union joins together all living creatures, and to each it seems fitting that which has pleased him, it is hard that liberty should not be held free there whence free children are procreated.
8:83
Et ideo illam quae, sicut iure praecipitur, honestate non fuisse probatur aequalis, legitimam tibi fieri censemus uxorem et filios ex eadem coniuge, sive qui suscepti sunt sive qui sunt suscipiendi, heredum volumus iura sortiri, ut sub nulla dubietate diligas quos tibi absolute successores futuros esse cognoscas. natura enim tibi praestitit filios, sed nos tali securitate facimus esse carissimos. Gloriosa est supplicatio, quae veniam quaerit aetatis: quando se gravitatem de moribus profitetur accipere, quam maturitatem vitae adhuc non contingit intulisse. minor nascendo grandaevus cupis esse consilio.

And therefore that woman who, as is rightly enjoined, is proved not to have been your equal in respectability, We decree shall become your lawful wife, and the sons from this same spouse, whether those who have been begotten or those who are to be begotten, We will to obtain the rights of heirs, so that you may, under no doubt, love those whom you know shall be your successors without qualification. For nature has bestowed sons upon you, but We make them most dear by such security. Glorious is the supplication which seeks an indulgence of age, when one professes to receive gravity from his morals, which the maturity of life has not yet chanced to bring in. Younger in birth, you desire to be aged in counsel.
8:84
ita quod in humanis rebus audacissimum est, ad erroris auxilium beneficium contemnis annorum. quapropter oblata supplicatione depromis, ut, cum tibi sit ratio firma prudentiae, actiones tuae non relinquantur ambiguae, ne infirmetur iure quod non potest utilitate titubare. hoc nos, quibus cordi est bona desideria perficere, libenter accipimus, quia nullas se captare velle profitetur insidias, quisquis habere liberos contractus constanter affectat.
如此,凡在人間事務中最為大膽之事——你竟為了補救誤失而輕看年歲的好處。因此,在所呈的懇求中你聲明:你既擁有穩固的明智判斷,你的行為便不該被置於疑慮之中,免得那在實用上不能動搖之事,竟在法律上被作廢。我們既以成全善願為心,便欣然接納此事,因為凡堅定地志在擁有自由契約之人,都聲明他不願設下任何圈套。
Thus what in human affairs is most audacious, you contemn the benefit of years for the aid of error. Wherefore in the supplication offered you declare that, since you possess a firm reckoning of prudence, your actions may not be left in doubt, lest by law that be invalidated which cannot waver in respect of utility. This We, to whom it is at heart to fulfil good desires, gladly accept, since he professes that he wishes to catch at no snares, whoever steadfastly aims to have free contracts.
8:85
Atque ideo, si id tempus constat elapsum, quo ad hanc veniam accedi iura voluerunt, nos quoque probabilibus desideriis licentiam non negamus, ut in competenti foro ea quae in his causis reverenda legum dictat antiquitas, sollemniter actitentur, ita ut alienandis rusticis vel urbanis praediis constitutionum servetur auctoritas: ne cum opinioni praestare volumus, utilitatem supplicis laedere videamur. cape igitur nostro beneficio potiorem annis aetatem et quod petis ab oraculo, moribus exhibeto. nam professio maturitatis acerbae locum denegat actionis, quando multo gravior est culpa, quam suae promissionis impugnat auctoritas.
所以,倘若確實已過了法律所願的、得以求取此寬免的期限,我們也不拒絕對可嘉的願望給予許可,使那些在此類案件中律法可敬的古制所規定之事,得以在合宜的法庭莊嚴辦理,並要如此:在轉讓鄉間或城市產業時,當遵守各項憲令的權威:免得當我們願按其意願賜予時,反顯為損害了懇求者的利益。所以你當藉我們的恩惠,取得一個強過你年歲的成年,而你向諭旨所求之事,當在你的品德中顯出。因為宣稱未熟的成年,反使行動失去其立足之地,因為那被自己所許之言的權威所攻擊的過錯,要嚴重得多。
And therefore, if it stands that the time has elapsed within which the laws willed that this indulgence be approached, We too do not deny licence to commendable desires, so that in a competent court those things which in such causes the venerable antiquity of the laws dictates may be solemnly transacted, in such wise that, in alienating rural or urban estates, the authority of the constitutions be observed: lest, while We wish to grant according to opinion, We seem to injure the advantage of the suppliant. Take therefore by Our benefit an age stronger than your years, and what you ask from the oracle, display in your morals. For the profession of an unripe maturity denies the place of action, since the fault is far graver which the authority of one's own promise assails.
8:86
Frequenter saiones, quos a nobis credidimus pia voluntate concedi, querelis maximis cognovimus ingravatos. corruptum est, pro dolor! beneficium nostrum, crevitque potius de medicina calamitas, dum ad alios usus petentium malignitate translati sunt quam eos nostra remedia transtulerunt. unde nobis necesse fuit remedio salubri votis pestiferis obviare, ne, dum pietatis studio ad aequabilia beneficia trahimur, subreptionum iniquissima patiamur.
我們屢次得知,那些我們以為是出於虔誠之意而由我們賜予的執法官(saiones),竟被極大的怨訴所加重。唉,可悲啊!我們的恩惠被敗壞了,災禍反倒從那良藥中滋生,因為他們被請願者的惡意挪作別的用途,而非我們的補救把他們作此挪移。因此,我們必須以有益的補救去抵擋那些害人的願望,免得當我們被虔誠的熱忱牽引去賜予公允的恩惠時,反受最不公的暗中欺瞞之害。
Frequently We have learned that the saiones, whom We believed to be granted by Us with pious intent, have been aggravated by the greatest complaints. Corrupted, alas for grief! is Our benefit, and calamity has rather grown out of the medicine, while they have been transferred to other uses by the malignity of the petitioners than that Our remedies have transferred them. Whence it became necessary for Us to oppose pestilential wishes with a wholesome remedy, lest, while We are drawn by the zeal of piety toward equable benefits, We suffer the most iniquitous of surreptitious frauds.
8:87
Atque ideo edictali programmate definimus, ut, quicumque contra violentas insidias propter ineluctabiles necessitates suas mereri desiderat forte saionem, officio nostro poenali se vinculo cautionis astringat, ut, si praecepta nostra eius inmissione plectibili is apud quem meretur excesserit, ipse poenae nomine det auri libras tot et satisfacere se promittat quaecumque adversarius eius potuerit tam commodi quam itineris sustinere detrimenta. Nos enim cum reprimere inciviles animos volumus, praegravare innocentiam non debemus.
所以我們藉敕令的公告規定:凡因其無可避免的急需,或想要為抵禦暴力的陷害而求得一名執法官者,當以保證書的束縛把自己約束於我們的刑罰官署,使倘若那受惠之人因其應受責備的唆使而違犯了我們的訓令,他自己便當以罰金之名繳付若干磅黃金,並當應許賠償其對頭可能蒙受的一切損害,包括利益的與旅途的。因為我們既願制止無禮的性情,便不該過分地加重無辜者的負擔。
And therefore by an edictal proclamation We define that, whosoever desires perchance to deserve a saio against violent snares on account of his unavoidable necessities, shall bind himself to Our penal office by the bond of a recognisance, so that, if by his blameworthy instigation he, in whose favour he deserves it, shall have transgressed Our precepts, he himself shall under the name of penalty give so many pounds of gold and shall promise to make satisfaction for whatever detriments his adversary may have sustained, both of advantage and of journey. For We, when We wish to repress uncivil tempers, ought not to overburden innocence.
8:88
saio autem, qui sua voluntate modum praeceptionis excesserit, donativo se noverit exuendum et gratiae nostrae, quod est damnis omnibus gravius, incurrere posse periculum nec sibi ulterius esse credendum, si iussionis nostrae, cuius executor esse debuit, temerator extiterit. Constat militiam bene geri, quae probatis moribus videtur imponi, quando ipse secum potest revolvere, quod iudex eum admonere debuit: maxime cum ad patrimonia divinae domus talis mereatur accedere, ut detestabili cupiditate non possit accendi.
但那執法官,若憑自己的意志超越了訓令的尺度,便當知道:他要被剝奪其賞金,並可招致危及我們恩寵之險——這比一切損失都更為嚴重——而他也不再被信任,倘若他在自己本當作執行者的命令上,竟挺身作了違犯者。公認那加於經受考驗之品德上的軍職,乃是善盡的,因為這樣的人能自己在心中默想法官本當提醒他的事:尤其當這樣的人配得進入神聖宮室的產業時,他便不致被可憎的貪欲所點燃。
But the saio, who of his own will shall have exceeded the measure of the precept, shall know that he is to be stripped of his donative and can incur peril to Our grace, which is graver than all losses, and that he is no longer to be trusted, if he has stood forth as a violator of Our command, of which he ought to have been the executor. It is agreed that that soldiery is well discharged which is seen to be imposed upon proved morals, when a man can himself revolve within himself what the judge ought to have admonished him: especially when such a one deserves to come to the patrimonies of the divine house, so that he cannot be inflamed by detestable cupidity.
8:89
deinde cum splendidissimum officium censoria quadam gravitate reluceat et turpe sit illi misceri qui dignis moribus non potest approbari, congruum videtur tales quaerere qui in nullo debeant displicere. atque ideo tribuni chartariorum suggestione comperta, penes quem officii est digna reverentia, ab illo die chartarii te volumus nomen adipisci, ut qui nobis bene acturus promitteris, documentis laudabilibus approberis. avaritiam declina: fuge longius iniqua compendia. multo melius proficitur, si bonis operibus serviatur. Nescio quid grande de se videtur promittere, qui loca desiderat publica possidere.
再者,既然這最為光輝的職務閃耀著某種監察官般的莊重,而讓一個不能以配得之品德受認可的人混雜其中乃是卑下的,所以尋找這樣的人——即在任何方面都不該令人不悅的人——便顯為合宜。因此,登記官之護民官的建議既已查明(職務的應有威儀繫於此人),我們願你從那日起獲得登記官(chartarius)之名,使你這位受許諾將為我們善盡職守的人,能以可嘉的憑證受認可。你當躲避貪婪;當遠遠逃離不義之利。若以善工事奉,所得的利益要好得多。凡渴望佔據公職的人,似乎對自己許下了某種我不知為何等的大事。
Then, since this most splendid office shines forth with a certain censorial gravity, and it is base for one to be mingled with it who cannot be approved by worthy morals, it seems fitting to seek out such men as ought in no respect to displease. And therefore, the suggestion of the tribune of the registrars having been ascertained, with whom rests the worthy reverence of the office, We will that from that day you obtain the name of registrar (chartarius), so that you who are promised to be about to act well for Us may be approved by laudable proofs. Shun avarice; flee far from iniquitous gains. Far better is the profit, if one serves by good works. I know not what great thing he seems to promise of himself, who desires to possess public offices.
8:90
hoc enim ita fieri decet, si res squalida in meliorem loci faciem transferatur et revocetur ad ornatum quod pridem iacere videbatur incultum. atque ideo desideranti tibi illum locum proprietario iure concedimus, praeter aes aut plumbum vel marmora, si tamen ibi fuerint latere comperta. age itaque ut per te decorem sumat quod neglectum incuriosa vetustate iacuerat, quatenus boni civis laudem invenire merearis, si faciem tuae civitatis ornaveris, securus etiam ad quoslibet vel ad posteros transmissurus quod proprio fuerit labore compositum. quia tanto firmius unusquisque talia possidebit, quanto se auctoresque suos amplius expendisse probaverit.
因為這事理當如此辦理:若一處骯髒之物被改造成那地方更美的容貌,而那久已似乎荒置未墾之物,被重新喚回到華麗。所以對你這渴望它的人,我們以所有權把那地方賜給你,唯獨青銅、鉛或大理石除外,倘若那裡查出有此等物隱藏其中。因此你當行事,使那因疏忽的古舊而被荒置之物,藉著你而煥然生美,以便倘若你裝飾你城邑的容貌,你便配得贏得善良公民的稱讚,並且也能安然地把那以你自己勞力所成就之物,傳給任何人或後裔。因為各人愈能證明他自己與其前人在這等物上花費得愈多,他便愈穩固地擁有它們。
For this ought so to be done, if a squalid thing be transferred into a better appearance of the place and what long ago seemed to lie uncultivated be recalled to adornment. And therefore to you, who desire it, We grant that place by proprietary right, save for bronze or lead or marbles, if any be found lying hidden there. Act therefore so that through you that may take on beauty which had lain neglected through careless antiquity, in order that you may deserve to win the praise of a good citizen, if you adorn the face of your city, secure too to transmit to any persons or to posterity what shall have been composed by your own labour. For each one shall possess such things the more firmly, the more he shall have proved that he and his predecessors have expended upon them.
8:91
Cum de agri utilitate vivatur et omnibus inde certum sit iustum venire compendium, tributum illud possessionis in illa provincia constitutae ita quereris onerosum, ut universas tibi voraverit facultates hiatus ille vastissimus functionis et quod aliunde magno labore potest colligi, per illam videatur absumi, cuius utilitatem nimia transcendit illatio, dum plus compulsoribus redditur quam a sedulo cultore praestetur. quapropter credimus te evadere posse nuditatem, si dominium huius ruris amiseris, cui iugis sterilitas de compulsoribus venit, ne condicione miserabili servias necessitati, cuius dominus esse meruisti.
既然人靠田地的出產而活,又眾人都確知由此而來正當的收益,你卻抱怨:那設立於該行省之地產的賦稅是何等沉重,以致那賦課那最廣闊的深淵吞噬了你一切的家財,而那能在別處費大力收集之物,似乎也被它耗盡——它的收益被過度的稅課所超過,因為交給徵收者的,比勤勞耕者所出產的還多。因此我們相信,你若放棄這片田產的所有權,便能脫離赤貧——這片田產因徵收者之故而有不斷的荒瘠——免得你在可悲的境況中淪為窮乏的奴僕,而你本配作其主人。
Since men live from the produce of the field, and it is certain for all that a just gain comes therefrom, you complain that that tribute of the holding established in that province is so burdensome that the vastest chasm of the public charge has devoured all your means, and that what can be gathered elsewhere with great labour seems to be consumed through it, whose advantage an excessive impost surpasses, while more is rendered to the collectors than is furnished by the diligent cultivator. Wherefore We believe that you can escape destitution, if you relinquish the ownership of this estate, to which a continual sterility comes from the collectors, lest in a wretched condition you serve necessity, whose master you have deserved to be.

Sed quia hoc genus beneficii praestari mediocribus leges sacratissimae censuerunt, ut qui unius cespitis enormitate deprimitur nec alterius commodo sublevatur, moderatione habita ei debeat subveniri, magnitudini vestrae, cui cordi est cogitare iustitiam, praesenti auctoritate decernimus, ut, si ita est, tot solidos tributarios supradictae possessionis datis praeceptionibus ad eos quorum interest ita faciatis de vasariis publicis diligenter abradi, ut huius rei duplex vestigium non debeat inveniri, sed per saecula sine errore servetur quod una tantum summa concluditur.
但因最神聖的律法已規定:這類恩惠當賜給中等財力之人,使那位被一塊地的龐大稅額所壓、又得不到另一塊地之收益扶助的人,當以節制相待而蒙救濟,所以我們憑現行的權威向以思量公義為念的你閣下決定:倘若確是如此,你便當藉所頒的訓令,將上述地產的若干索利都金幣賦稅,為有關之人勤謹地從公庫登記冊中刪除,使此事不該留下雙重的痕跡,乃要使那僅以單獨一筆總額所涵蓋之數,世世代代無誤地存留。
But because the most sacred laws have decreed that this kind of benefit be afforded to persons of middling means, so that he who is depressed by the enormity of one plot and is not relieved by the advantage of another ought, with moderation observed, to be succoured, We decree by present authority to your Magnitude, whose care it is to ponder justice, that, if it be so, you shall cause so many solidi of tribute of the aforesaid holding, by the issued precepts, to be diligently erased from the public registers in favour of those whom it concerns, so that no double trace of this matter ought to be found, but that throughout the ages there be preserved without error what is comprised in one single sum only.

Institutio divinarum legum humano iuri ministravit exordium, quando in illis capitibus legitur praeceptum quae duabus tabulis probantur ascripta. sacer enim Moyses divina institutione formatus Israhelitico populo inter alia definivit, ut concubitus suos a vicinitate pii sanguinis abstinerent, ne et se in proximitatem redeundo polluerent et dilatationem providam in genus extraneum non haberent. hoc prudentes viri sequentes exemplum multo longius pudicam observantiam posteris transmiserunt, reservantes principi tantum beneficium in consobrinis nuptiali copulatione iungendis, intellegentes rarius posse praesumi quod a principe iusserant postulari.

The institution of divine laws furnished the beginning for human right, since in those chapters is read the precept which is proved to be inscribed upon two tablets. For holy Moses, formed by divine instruction, among other things defined for the Israelite people that they should abstain in their unions from the nearness of kindred blood, lest both by returning into propinquity they should defile themselves, and they should not have a provident expansion into a foreign stock. Following this example, prudent men transmitted to posterity a chaste observance much further still, reserving to the prince so great a benefit in the joining of cousins in nuptial union, understanding that what they had ordained to be requested of the prince could the more rarely be presumed.

Ammiramur inventum et temperiem rerum stupenda consideratione laudamus hoc ad principis remissum fuisse iudicium, ut qui populorum mores regebat, ipse et moderata concupiscentiae frena laxaret. et ideo, supplicationum tuarum tenore permoti, si tibi tantum illa consobrini sanguinis vicinitate coniungitur nec alio gradu proximior approbaris, matrimonio tuo decernimus esse sociandam nullamque vobis exinde iubemus fieri quaestionem, quando hoc et leges nostra permitti voluntate consentiunt et vota vestra praesentis auctoritatis beneficia firmaverunt.
我們驚歎於這安排,並以驚異的省思讚美此事的節度——竟把這事交由君王的裁奪,使那治理眾民品德的君王,自己也得以放鬆那受節制的情慾韁繩。因此,我們既為你懇求的內容所感動,倘若只有她憑那表親血緣的相近與你相連,而你被證實在任何其他親等上都不更為相近,我們便決定她當在婚姻中與你聯合,並命令此後不得對你提出任何質問,因為這事既經律法以我們甘願的同意而准許,你們的誓願又確認了現行權威的恩惠。
We marvel at the device and with astonished consideration We praise the temperance of the matter, that this was left to the prince's discretion, so that he who governed the morals of the peoples should himself also relax the moderated reins of concupiscence. And therefore, moved by the tenor of your supplications, if she alone is joined to you by that nearness of a cousin's blood and you are proved no nearer by any other degree, We decree that she is to be associated to you in matrimony, and We command that no question be thereafter raised against you, since both the laws permit this with Our willing consent and your vows have confirmed the benefits of the present authority.

erunt vobis itaque deo favente posteri sollemniter heredes, castum matrimonium, gloriosa permixtio, quoniam quicquid a nobis fieri praecipitur, necesse est ut non culpis, sed laudibus applicetur. Patitur hoc inprovida mortalium plerumque condicio, ut, cum laedere putatur, consulat et cum consulere videtur, affligat. sed illud magis est eligendum, quod prodesse cognoscitur. nam venena ipsa si iuvare probantur, accepta sunt: et contra refugienda est suavitas mellis, quae inferre dinoscitur laesiones. finis ergo sapientis est amare quod expedit: sic nec aegri votum respicit qui prodesse contendit.
因此你們將蒙神之恩,得後裔作莊嚴的繼承人,得貞潔的婚姻、光榮的結合,因為凡我們所命令當行之事,必當歸於讚美,而非歸於過錯。凡人那欠缺遠慮的境況常常如此:當它被以為在傷害時,它卻有益於人;而當它看似在謀益時,它卻使人受苦。但那被認作有益之物,才是更當揀選的。因為連毒藥本身,倘若被證實有助益,也是受歡迎的;反之,蜂蜜的甘甜倒當躲避,因為它被知道會帶來傷害。所以智者的目的,乃是愛那有益之事:如此,那竭力使人得益的人,連病人的願望也不顧及。
You shall therefore, by God's favour, have posterity as solemn heirs, a chaste matrimony, a glorious union, since whatever is commanded by Us to be done must needs be applied not to faults but to praises. The improvident condition of mortals oftentimes suffers this, that, when it is thought to injure, it consults the good, and when it seems to consult, it afflicts. But that is rather to be chosen which is recognised to profit. For poisons themselves, if they are proved to help, are welcome; and on the contrary the sweetness of honey is to be shunned, which is known to inflict injuries. The end therefore of the wise man is to love what is expedient: thus he who strives to profit does not regard even the wish of the sick.

praedia quidem curialium non facile distrahi prudens definivit antiquitas, ut ad necessitates publicas melius sufficerent, si substantiae iuvamina plus haberent. Sed in hac iterum parte prospexit, ut, si apud vos ineluctabilis necessitas appareret, ei suarum rerum distractio subveniret. nam quid prodest, si quispiam videatur idoneus et fieri non possit a contractis nexibus absolutus? egenti similis est, qui reddere nequit alienum, nec dici potest proprium, quod liberare dominum non videtur aditum.
明智的古人規定,市議員的田產不可輕易變賣,使其更能應付公共所需,因為他們若有更豐厚的財產資源,便更為充裕。然而在這同一件事上,古人又作了另一番考量:倘若你們當中出現了無可避免的急難,便可藉變賣自己的產業來紓解。因為一個人縱然看似勝任公職,若無法從種種債務的羈絆中脫身,那又有何益處呢?他就如同一個無力償還他人之物的窮人;而那不能為其主人開啟解脫之路的財產,也不能被稱為他自己所有。
Prudent antiquity decreed that the estates of curials should not be readily sold off, so that they might better suffice for public needs, since they would have greater resources of substance. Yet in this same matter it again made provision, so that, if an inescapable necessity should appear among you, the sale of his own property might come to his relief. For what does it profit a man, if he seems fit for office yet cannot be freed from the bonds of his entanglements? He is like a pauper who cannot repay what is another's, nor can that be called his own which is not seen to open the way for the owner's release.
8:97
Sed quamvis hoc vestrae potestati fuerit legum auctoritate concessum, tamen, ne quam vel rarissimi facti sustineretis invidiam, illius municipis allegatione permoti, nos quoque eminentiae vestrae praesenti iussione permittimus, ut ad liquidum veritate discussa, si aliter solvi nequeunt contracta ligamina, praedii sui, quod propria voluntate delegerit, habeat licentiam distrahendi, ita ut reddat debitum quod probatur esse contractum, ne vitio voracitatis imbutus facultates suas absorbere videatur esse permissus. constet apud vos probabilis causa damnorum, quoniam illi volumus subveniri qui duris necessitatibus probatur astringi:

But although this has been granted to your authority by the sanction of the laws, nevertheless, lest you should incur the ill-will of an exceedingly rare act, moved by the plea of that townsman, we too, by this present command, permit your Eminence that, the truth having been clearly sifted, if the contracted obligations cannot otherwise be discharged, he shall have license to sell that estate of his which he shall have chosen of his own will, on condition that he repay the debt which is proven to have been contracted, lest, steeped in the vice of greed, he be thought permitted to swallow up his own resources. Let the just cause of his losses be established in your sight, since we wish relief to be brought to him who is proven to be bound fast by harsh necessities:

utrumque enim potest esse culpabile aut malis moribus frena laxare aut iustas iterum querelas excludere. quapropter provide vobis permisit antiquitas de illa causa decernere, cui est utile curiam custodire. a quibus enim urbium munia poterunt sustineri, si civitatum nervi passim videantur abscidi?
因為兩種作法都可能有過:或是放鬆韁繩、縱容惡習,或是反過來把正當的申訴拒之門外。因此古人深謀遠慮,准許你們就那件事作出裁決,因為保全市議會對它有益。試問,若城市的筋脈處處被砍斷,城市的重擔又能由誰來承擔呢?
For either course can be blameworthy: either to loosen the reins to evil habits, or again to shut out just complaints. Wherefore antiquity providently permitted you to decide concerning that matter, for which it is profitable to safeguard the curia. For by whom can the burdens of the cities be sustained, if the sinews of the civic communities are seen to be cut away on every side?
