Victor the grammarian offered two codices and four quaternions. Felix, the perpetual flamen and curator of the commonwealth, said to Victor: Bring out the writings; you have more. Victor the grammarian said: If I had had more, I would have given them.

Labor that no one may know what this conspiracy is. The things contained in the account are yours. But even brother is judged with brother, and that before unbelievers,» just as you, when you do not press your case in court. Has it come to this, that we should give such an example to the heathen, so that those who through us believed in God should themselves curse us, when we come into public court?

Farewell; but I beg you, let no one know.» When these things had been read, Zenophilus, the most distinguished consular, said: From the acts and the letters that have been recited, it is established that Silvanus is a traditor. And he said to Victor: Confess plainly whether you know that he handed anything over. Victor said: He handed things over, but not in my presence. Zenophilus, the most distinguished consular, said: What office did Silvanus then hold among the clergy?

For I had also ordered certain bishops from the Gauls to go to our aforesaid city of Rome, so that both these — for the integrity of their life and praiseworthy conduct — and also seven bishops of the same communion, as well as the bishops of the city of Rome, and those who, together with them, would investigate the matter, might be able to give due credit to the affair which seems to have been set in motion. And they indeed reported to my knowledge, with acts duly drawn up, all that had been done in their presence, affirming moreover in word that their judgment had been delivered according to the equity of the matters, and saying that those rather were liable to the case who thought to stir up certain things against Caecilianus — to such a degree that, after the judgment had been given, they forbade those men to return to Africa.

For since it is certain to me that you too are a worshiper of the supreme God, I confess to your gravity that I in no way deem it lawful that contentions and altercations of this kind should be passed over in silence by us — by which perhaps the supreme Divinity might be moved, not only against the human race, but even against me myself, to whose care he has by his heavenly nod committed all earthly things to be governed, and might decree something otherwise, being thus far provoked. There we endured a grave and ruinous injury against our law and tradition, and against men of unbridled mind, whom both the present authority of our God and the tradition and rule of truth so reject that in them no reasonable case for speaking could stand, nor any manner of accusation, nor any proof could be agreed. Therefore, with God as judge and the Church as mother — who knows and approves her own — they were either condemned or driven out. And would that, most beloved brother, you had thought it worth your while to be present at so great a spectacle! Surely we believe that an even sterner sentence would have been pronounced against them, and that, with you judging together with us, our assembly would have rejoiced with greater gladness.

But since you were quite unable to withdraw from those regions in which the apostles daily sit enthroned and their very blood without ceasing bears witness to the glory of God, yet these were not the only matters that seemed to us worthy of discussion, dearest brother, to which we had been invited; rather we judged that we ought also to take counsel for our own concerns. And because the provinces from which we have come are diverse, so too various matters arise which we judge we ought to observe. The eternal and devout, incomprehensible mercy of our God by no means permits the human condition to wander long in darkness, nor does it suffer the hateful wills of certain men to prevail to such a degree, but, once more opening with His most splendid lights the path of salvation, He grants them to be turned to the rule of righteousness. For I have come to know this by many examples, and I measure these very things from my own self. because, if even now with sincere faith they should be willing to render obedience to the most holy law, they will be able to understand how greatly it has been provided for them by the nod of God. And this indeed, most holy brethren, I hoped might be reproved even in those in whom the greatest hardness of soul is innate. But right adjudication availed nothing with them, nor did propitious divinity enter into their minds; for truly, not undeservedly has the clemency of Christ withdrawn far from those in whom it shines forth by manifest light that they are of such a kind that we discern them to be hateful even to the heavenly provision.

What so great madness persists in them, since with incredible arrogance they persuade themselves of things which it is not lawful either to speak or to hear, falling away from the right judgment that was given — by which judgment they have found out, through heavenly provision, that they demand my judgment! What force of malice persists in the breasts of these men. How often have they already, by their most shameless petitions to me myself, been overwhelmed with a fitting reply! Surely, if they had been willing to set this before their eyes, they would by no means have interposed this very thing. They demand my judgment — I, who myself await the judgment of Christ. For I declare, as the truth itself holds, that the judgment of priests ought to be so regarded as if the Lord Himself were seated and judging.

nihil enim licet his aliud sentire uel aliud iudicare, nisi quod Christi magisterio sunt edocti. quid igitur sentiunt maligni homines officia, ut uere dixi, diaboli? perquirunt saecularia relinquentes caelestia. o rabida furoris audacia! sicut in causis gentilium fieri solet, appellationem interposuerunt. equidem gentes minora interdum indicia refugientes, ubi iustjtia cito deprehendi potest, magis ad maiora indicia auctoritate interposita, ad appellationem se conferre sunt solitae. quid hi detractatores legis, qui renuentes caeleste indicium meum putauerunt postulandum? sic sentire de Christo saluatore?
For it is not lawful for them to think or to judge anything other than what they have been taught by the teaching of Christ. What then do these malicious men think — agents, as I have truly said, of the devil? They seek out worldly things, forsaking the heavenly. O the rabid boldness of fury! As is wont to be done in the lawsuits of the heathen, they have lodged an appeal. Indeed the heathen, sometimes fleeing lesser tribunals where justice can be quickly grasped, are accustomed rather to betake themselves to greater tribunals, by interposing higher authority, and to resort to an appeal. What of these detractors of the law, who, refusing the heavenly tribunal, have thought that mine must be petitioned? Is this to think rightly of Christ the Savior?

Behold, now they are traitors; behold, without any sharper investigation, they have by themselves betrayed their own crimes. What humanity is to be perceived in those who have leapt out monstrously against God Himself? Indeed, dearest brethren, although these things seem to have been detected in them, nevertheless you who follow the way of the Lord and Savior, exercise patience, an option being still given to them as to what they think should be chosen. And if you see them persist in these same things, straightway set out together with those whom the Lord has judged worthy of His worship, and return to your own seats, and remember me, that our Savior may always have mercy upon me.

For the rest, I have dispatched my men to bring these same unspeakable deceivers of religion at once to my court, that there they may dwell, there foresee for themselves a death worse than death. Nor is it a wonder that the wicked depart from the good; for thus rightly is it noted in the proverb: like are gathered together with like. Those who are infected with the evil of an impious mind must of necessity be at variance with our society. For a wicked man, as the Scripture says, out of the evil treasure brings forth evil things, but a good man out of the good brings forth good.

sed quia, ut dictum est, haeretici et schismatici, qui bonum relinquentes et malum sectantes ea perficiunt, quae deo displiceant, diabolo, qui eorum pater est, adprobentur adhaerere, rectissime et sapienter grauitas uestra fecit et secundum sanctum fidei praeceptum ab eorum peruersis contentionibus temperando et hisdem remittendo, quod idem sibi indebitum atque alienum usurpare contendunt, ne, sicuti est eorum peruersitas maligna et perfida, ad seditiones usque prorumperent et inter turbas atque concentus sui similes incitarent atque ita aliquid exsisteret, quod sedari non oporteret. sceleratum quippe eorum propositum semper requirit diaboli opera perficere.
But because, as has been said, heretics and schismatics, who forsaking the good and following the evil accomplish those things which displease God, are proven to cleave to the devil who is their father, your gravity has acted most rightly and wisely, and according to the holy precept of the faith, by restraining yourselves from their perverse contentions and by yielding to them that which they strive to usurp as undue and alien to themselves, lest — as their perversity is malicious and faithless — they should break out even into seditions, and amid tumults stir up those like to themselves, and thus something should arise which it would not be fitting to quell. For their wicked design ever seeks to accomplish the works of the devil.

et ideo cum a sacerdotibus dei per patientiam cum ipso suo patre superant, sibi ii, qui cultores dei summi gloriam, illi uero damnationem conparent et condigna supplicia. ex hoc quippe maius dei summi exsistat iustiusque iudicium, quod eos aequo animo tolerat et patientia condemnat his omnia, quae ab ipsis processerunt, sustiuendo , dens siquidem se omnium uindicem promisit. et ideo cum uindicta deo permittitur, acrius de inimicis supplicium sumitur.
And therefore, when by patience they are overcome by the priests of God along with their own father himself, those who are worshipers of the supreme God procure for themselves glory, but those others procure damnation and fitting punishments. For from this there arises a greater and more just judgment of the supreme God, in that He bears them with an even mind and condemns them by patience, enduring against these all the things which proceeded from them; for God has promised that He will be the avenger of all. And therefore, when vengeance is left to God, the punishment exacted from the enemies is the sharper.

quod nos nunc famulos et sacerdotes dei libenter fecisse cognoui et satis gratulatus sum, quod de impiis et sceleratis, sacrilegis et profanis, perfidis et inrelegiosis et deo ingratis et ecclesiae inimicis nullam uindictam poscitis et, ut idem potius ad ueniam pertineant, postulatis. hoc est uere ac penitus deum nosse, hoc est praeceptis insistere, hoc est feliciter credere, hoc est uere sentire, hoc est scire, quod maior uindicta in contrarios ecclesiae prouocetur, cum hisdem in saeculo parcitur.
And this I have learned that you, the servants and priests of God, have now gladly done, and I rejoiced greatly that concerning the impious and the wicked, the sacrilegious and the profane, the faithless and the irreligious, and those ungrateful to God and enemies of the Church, you ask for no vengeance, and rather petition that these same men may attain to pardon. This is truly and inwardly to know God; this is to persist in His precepts; this is to believe happily; this is to think truly; this is to know that a greater vengeance is provoked against the adversaries of the Church when these same men are spared in this world.

Accepta igitur epistola sapientiae et grauitatis uestrae conperi haereticos siue schismaticos eam basilicam ecclesiae catholicae, quam in Constantina ciuitate iusseram fabricari, solita inprobitate inuadendam putasse et frequenter tam a nobis quam a iudicibus nostris ex nostra iussione commonitos et reddere, quod suum non erat, noluisse, uos tamen imitatores patientiae dei summi eorum malitiae placida mente ea, quae uestra sunt, relinquentes et potius locum nobis inuicem alium, fiscalem scilicet, poscere.
Having therefore received the letter of your wisdom and gravity, I have learned that the heretics or schismatics thought, with their usual wickedness, that they should seize that basilica of the Catholic Church which I had ordered to be built in the city of Constantina, and that, frequently admonished both by us and by our judges at our command also to restore what was not their own, they refused; yet you, imitators of the patience of the supreme God, with calm mind leaving to their malice those things which are your own, and rather asking from us in turn another place, namely one belonging to the fisc.

This petition I have gladly embraced after the manner of my custom, and at once gave suitable letters to the procurator, that he should cause the house of our domains, with all its right, to pass over into the ownership of the Catholic Church, which I have donated with prompt liberality and ordered to be straightway handed over to us. In which place, nevertheless, I have ordered a basilica to be erected at the expense of the fisc, and have commanded a letter to be written also to the consular of Numidia, that he himself should aid your holiness in all things in the construction of that same church. The lectors also of the Catholic Church and the subdeacons, and the rest besides, who at the instigation of the aforesaid men were summoned, in keeping with certain practices, to public charges or to the decurionate, I have ruled, according to the statute of my law, are to be called up to no public charge;

sed et eos, qui ducti sunt haereticorum instinctu, iussimus protinus molestis perfunctionibus absolui. de cetero etiam legem meam super ecclesiasticos catholicos datam custodiri mandaui, quae omnia, (ut) uestrae patientiae palam fierent, harum litterarum testificatione perscripta sunt et utinam quidem haeretici uel schismatici aliquando suae saluti prouiderent et detersis eorum tenebris ad uisionem uerae lucis oculos aperirent et a diabolo secederent et ad deum, qui unus et uerus, qui omnium iudex est, uel sero confugerent! sed quia constat eos in sua malitia manere et in suis facinoribus mori nelle, sufficit hisdem commonitio nostra et praecedens assidua cohortatio.
but also those who were led on at the instigation of the heretics, we have commanded to be at once released from burdensome duties. For the rest, I have also commanded that my law given concerning the Catholic clergy be kept; all of which, that they might be made plain to your patience, have been set down in writing by the testimony of these letters. And would indeed that the heretics or schismatics might at some time provide for their own salvation, and, their darkness wiped away, open their eyes to the vision of the true light, and withdraw from the devil, and flee, even though late, to God, who is one and true, who is the judge of all! But because it is established that they remain in their malice and are unwilling to die in their crimes, our admonition and our constant preceding exhortation suffices for them.
但對那些因異端者慫恿而被引去的人,我們也已下令立即免去他們繁重的負擔。至於其餘,我又下令當遵守我所頒、關於大公教會聖職人員的律法;這一切既要向你們的忍耐表明,便藉這信函的見證寫了下來。但願異端者或分裂者有朝一日能顧念自己的救恩,拭去他們的黑暗,向真光的異象睜開眼睛,離棄魔鬼,即便已晚也逃向那獨一、真實、作萬人審判者的神!但因確知他們仍存留在自己的惡毒中,並情願死在自己的罪行裡,那麼我們的勸誡與先前不住的勸勉,對他們也就足夠了。

si enim iussionibus nostris obtemperare uoluissent, ab omni malo liberarentur. nos tamen, fratres, sequamur, quae nostra sunt, mandatis instemus, custodiamus diuina praecepta ex bonis actibus. uitam nostram ab erroribus uindicantes fauente dei misericordia per rectum limitem dirigamus I data Non. For if they had been willing to obey our commands, they would have been freed from all evil. Yet let us, brethren, follow what is our own, press on in the commandments, keep the divine precepts by good deeds.
