42:1
I. Et quia in ordinandis clericis antiquorum Patrum statuta non ad integrum, sicul expedit, observata esse cognoscuntur, ne forte quorumcunque importunis et inordinatis precibus sacerdotes Domini fatigentur, et ea quæ toties sunt præcepta transgredi compellantur, hoc inter sc observandum esse definiunt, ut nullus episcoporum diaconum, antequam viginti quinque annos impleat, ordinare præsumat. Episcopatus vel presbyterii honorem nullus laicus ante præmissam conversionem, vel ante triginta ætatis annos accipiat. II. Et licet de laicis prolixiora tempora antiqui Patres ordinaverint observanda, tamen quia crescente ecclesiarum numero, nccesse est nobis plures cieri..
I. And because in the ordaining of clerics the statutes of the ancient Fathers are found not to be observed in full, as is expedient, lest by any men's importunate and disorderly entreaties the priests of the Lord be wearied and be compelled to transgress the things that have so often been enjoined, they determine that this is to be observed among themselves: that no bishop presume to ordain a deacon before he has completed twenty-five years. Let no layman receive the honour of the episcopate or of the priesthood before a conversion has first been made, or before thirty years of age. II. And although the ancient Fathers ordained that longer periods be observed with regard to laymen, nevertheless, since with the increasing number of churches it is necessary for us to ordain more clergy...

cos ordinare, hoc inter nos sine præjudicio duntaxat canonum convenit antiquorum, ut nullus metropolitanorum cuicunque laico dignitatem episcopatus tribuat, sed nec reliqui pontifices presbyterii vel diaconatus honorem conferre præsumant, nisi anno integro fuerit ab eis praemissa conversio. III. Nullus poenitentem, nullus digamum, vel internuptarum maritum, in prædictis honoribus audeat ordinare. Et licet hæc jam prope omnium canonum statuta contineant, tamen ne cui sacerdutum supplicantum, sicut jam dictum est, importunitas vel suggestio iniqua subripiat, necesse fuit ut nunc severio* rem regulam sibi velint Domini sacerdotes imponere.
...to ordain them, it has been agreed among us, without prejudice however to the ancient canons, that no metropolitan bestow the dignity of the episcopate upon any layman, and that neither may the other bishops presume to confer the honour of the priesthood or the diaconate, unless a conversion of one full year has first been made by them. III. Let no one presume to ordain to the aforesaid honours a penitent, a man twice married, or the husband of a woman previously married. And although these matters are already contained in the statutes of nearly all the canons, nevertheless, lest, as has already been said, the importunity or wicked suggestion of any of those petitioning the priests should steal upon them, it has been necessary that now the priests of the Lord should be willing to impose upon themselves a stricter rule.

Et ideo quicunque ab hac die, contra ea quæ superius sunt comprehensa, clericum ordinare praesumpserit, ab hac die, qua hoc ei potuerit approbari, anno integro missas facere non præsumat. Quam rem si quis observare noluerit, et contra con ensum fratrum faciens, missas celebrare præsumpserit, ab omnium fratrum charitate se noverit alienum: quia dignum est ut severitatem ecclesiasticae discipline sentiat, qui toties salubriter a sanctis Patribus instituta observare contemnit. IV.
And therefore whoever from this day, contrary to the things comprised above, shall presume to ordain a cleric, from that day on which this can be proved against him let him not presume to celebrate Mass for one full year. And if anyone will not observe this, and, acting against the consent of the brethren, presume to celebrate Mass, let him know himself to be estranged from the charity of all the brethren; for it is fitting that he should feel the severity of ecclesiastical discipline who scorns to observe the things so often and so wholesomely instituted by the holy Fathers. IV.

Et si forte aliqcis clericurum, regulam disciplinæ ecclesiasticæ subterfegiens, fuerit evagatus, quicunque eum susceperit, ct m n solum pontifici suo non rec nciliaverit, sed magis defensae præsumpserit, Ecclesiæ communione privetur (21 quæst. 5. Si forte aliquis).
And if perchance any cleric, escaping from the rule of ecclesiastical discipline, has wandered off, whoever shall receive him and shall not only fail to reconcile him with his own bishop, but rather presume to defend him, let him be deprived of the communion of the Church (Cause 21, question 5, 'If perchance anyone').
倘若有任何聖職人員逃避教會紀律的規矩而漫遊在外,凡收留他之人,若不但不使他與其本主教和好,反而擅自袒護他,就當被剝奪教會的共融(見《教令集》第21案、第5問,「倘若有人」條)。
