Idem Augustus Joanni P. P. Sancimus ut si quando abfuerit is qui res alienas vel creditori obnoxias detinet, et desideret dominus rei vel creditor suam intentionem proponere, et non ei licentia sit, absente adversario suo qui rem detinet, vel infantia, vel furore laborante, et neminem tutorem vel curatorem habente, vel in summa poteslate constituto [eamdem rem auctoritate sua usurpare], licentia ei detur adire praesidem provinciæ, libellumque ei porrigere, et hæc in querimoniam deducere, et intra constituta tempora interruptionem faccre; sin autem nullo poterit modo præsidem adire, saltem ad episcopum locorum eat et JIll manifestare voluntatem in scriptis deproperet. The same Augustus to John, Praetorian Prefect. We decree that, if ever he should be absent who detains property belonging to another or liable to a creditor, and the owner of the property or the creditor desires to set forth his claim, and it is not permitted to him — his adversary who detains the property being absent, or laboring under infancy or under madness and having no guardian or curator, or being established in supreme power [so as to usurp the same property by his own authority] — let permission be given to him to approach the governor of the province, to present a petition to him, to bring these matters into a complaint, and within the appointed times to make an interruption of prescription; but if he is in no way able to approach the governor, let him at least go to the bishop of the place and hasten to manifest his will to him in writing.
