What things have been established by law concerning the Samaritans regarding their synagogues and successions obtain also in the case of the Montanists, and the Ascodrogi, and the Ophites. For the orthodox alone succeed to them by will and on intestacy, and take legacies; but the other heretics—that is, those who are not orthodox—and the Greeks, that is, pagans, and the Samaritans, neither serve in the army, nor are honored with any dignity, nor obtain any public office, nor teach, nor exercise the function of advocates. But if anyone, in order to obtain these things, feigns himself orthodox, and it appears that he has a heretical wife or children, and does not bring them to orthodoxy, he is cast out.
But even if he conceals it, he cannot give away any of his goods, or otherwise alienate them to a heretic; rather, the fisc claims both these goods and his succession when it has passed to a heretic. For in general, those who share in military service, or in any dignity, or in advocacy, or in public largesse, or in public acclamation, have only orthodox persons as their successors; and whatever goods of theirs have passed in any way to a heretic, the fisc claims. § 1. If one of the spouses be orthodox and the other heretical, their children ought to be made orthodox. But if of these some become orthodox and others remain heretical, the orthodox alone succeed to both parents. But if all are heretical, the orthodox kinsmen succeed, or, these not existing, the fisc. § 2.

The constitution has various penalties against those who neglect, and who do not prosecute or denounce—against governors and civil or military offices and against bishops, who indeed report to the prince concerning negligent governors; but the penalties are applied to the fisc.
