83:1
The same Augustus to John, Praetorian Prefect. Whereas by the Leonine law it was granted to the most reverend bishops, and presbyters, and deacons to hold a peculium as if a military one, with this added, that they might even make a testament concerning it, it was doubted whether testaments of this kind ought to be assailed by the complaint of the undutiful will, since concerning all persons who have earned a peculium of this kind the same question had arisen?
Dat. Non. Februar., CP., postcoss. Lampadii et Orestis. anno 2, 532.
We therefore decree that to the most reverend bishops, and presbyters, and deacons who possess such a peculium as if military, it is permitted, concerning these things only which are of the quasi-military peculium, not only to draw up their last testaments according to the laws (which descends from the Leonine constitution), but also that their last wills, held concerning these things only, are in no way subject to the complaint of the undutiful will. Given on the Nones of February, at Constantinople, after the consulship of Lampadius and Orestes, in the second year, 532.
