60:1
Idem imperator Joanni gloriosissimo Orientalium practoriorum praefecto, iterum exconsule et patricio. Causa talis ad nos pervenit. quam existimavimus oportere competenti uti a nobis interoretatione simul et adjutorio. Cognovimus etenim quia malier quædam habens filium, sibi ex nuptiis legitimis procrentum, voluit quidem segregare se a communi ista conversatione, et in quodam mulierum monasterio commanere, plurima bona faciens mulieribus reverendissimis ibidem congregatis.
The same emperor to John, most glorious praetorian prefect of the East, twice former consul and patrician. A matter of the following kind has come before us, which we judged ought to receive from us both a fitting interpretation and assistance together. For we have learned that a certain woman, having a son begotten by her in lawful wedlock, wished indeed to withdraw herself from this common manner of life and to dwell in a certain monastery of women, doing many good works for the most reverend women gathered together there.

60:2
Et quoniam nostræ pietatis lex vult eos qui se monasteriis dedicarint, seu viros seu mulieres, antequam ingrediantur monasterium, eo quo voluerint modo quae sua sunt disponere, nec posse, postquam ingrediuntur monasterium, ulterius agere quidquam de propriis, ut pote domini rerum non ulterius existentes, eo quod sic sanciverimus hujusmodi viros et mulieres cum corpore et anima ipso ingressu ad monasterium dedicare se suasque substantias, et siquidem discesserint, manere eliam sic eorum substantias in monasterium, eo quod domini harum ulterius non existunt:
And since the law of our piety wills that those who dedicate themselves to monasteries, whether men or women, should, before they enter the monastery, dispose of their possessions in whatever manner they wish, and that after they enter the monastery they can no longer do anything concerning their own property, inasmuch as they are no longer owners of those things, because we have thus enacted that men and women of this kind, by the very act of entering the monastery, dedicate both themselves with body and soul and their substance, and that if they should depart, their substance nevertheless remains with the monastery, because they are no longer owners of it:
又因我們虔敬的法律規定:凡獻身於修道院的人,無論男女,在進入修道院之前,可按其所願的方式處置自己的財產;但一旦進入修道院之後,便不能再對自己的財物作任何處置,因為他們不再是這些財物的所有者;緣由是我們如此立定:這類男女藉著進入修道院這一行為本身,就連同身體與靈魂並自己的財產一同獻上;即便他們日後離去,其財產仍歸屬修道院,因為他們不再是這些財物的所有者。
60:3
hinc autem metuere, ne forte (quamvis nostra constitutio multo posterior sit quam cum in praedictam venerabilem domum ingressa est) aliqui prohibeant eam prospicere suo filio, et oportere propter prædictum metum hæc interpretari, et lege nostra fieri manifesta, quia nihil læsa sit, aut ipsa aut filius ejus circa ejus ex memorata constitutione successionem.
but hence there is a fear lest perhaps (although our constitution is much later than the time when she entered the aforesaid venerable house) certain persons might forbid her to look after her son; and that, on account of the aforesaid fear, these matters ought to be interpreted and made clear by our law, namely that neither she herself nor her son has suffered any injury concerning his succession arising from the aforementioned constitution.
但因此產生一種顧慮:恐怕(雖然我們的這項法令遠晚於她進入上述可敬居所之時)有人會禁止她照看自己的兒子;又因上述顧慮,這些事宜應當加以解釋,並藉我們的法律予以明確,使無論她本人或她的兒子,在由前述法令所生的繼承事上都不受任何損害。
60:4
Propterea sancimus, si quis monasterium habitaverit vir aut mulier ante praedictam nostram constitutionem, aut hactenus habitat, et maxime filiis existentibus, nullain habere necessitatem nunc eorum substantiam in monasterium, sed filio aut filiae transmittere, aut totam aut etiam partem suae substantiæ, aut etiam quo voluerit modo res suas disponere:
Therefore we enact that if any man or woman shall have dwelt in a monastery before our aforesaid constitution, or dwells there even now, and especially when there are children, he or she has no necessity now to assign their substance to the monastery, but may transmit to a son or daughter either the whole or even a part of their substance, or may even dispose of their property in whatever manner they please:
因此我們立法規定:凡在我們上述法令之前已住進修道院、或至今仍住在其中的男女,尤其在有子女的情況下,如今並無必要將其財產歸於修道院,而可將其財產的全部或一部分轉交給兒子或女兒,甚或按其所願的任何方式處置自己的財物。
60:5
utpote primam illam legem alia nostra hac constitutione interpretante (eos enim qui semel ante memoratam dudum nostram legem monasteria intraverint, in nullo posita postea lex contristatura, aut ablatura est his ea quæ prius eis, ut licet, data sunt), neque prius nostrae legis impedimentum penitus faciente, eo quod neque possibile sit hoc fieri, ut oportuisset prius disponere, et ita ingredi monasterium. Si vero nulla tunc tali lege posita in monasterium ingressa est, quomodo fieri potuerit converti ordinem legis, et exigere ut qui prius ingressi sunt monasterium, illa faciant quæ prius ignorata, postea per sacram nostram constitutionem sunt innovata.
inasmuch as this other present constitution of ours interprets that first law (for those who once, before our aforesaid law of long ago, entered the monasteries, no law laid down afterwards is to grieve at all, nor to take from them those things which had previously, as was lawful, been given to them), nor is the impediment of our earlier law to operate at all upon them, because it was not even possible for this to be done, namely that they should first dispose of their property and so enter the monastery. But if at that time, with no such law laid down, she entered the monastery, how could it come about that the order of the law be reversed, and that it be required of those who entered the monastery earlier that they do those things which, formerly unknown, were afterwards newly introduced by our sacred constitution?
因為我們這另一道現行法令正是對那第一道法律的解釋(凡曾在我們先前那道舊法之前進入修道院的人,日後所立的任何法律都絕不令其憂傷,也不奪去他們先前依法所獲得之物),我們先前法律的障礙也絲毫不可施於他們,因為那本是不可能做到的,即要他們先處置財產然後再進入修道院。但她若在當時並無此類法律的情況下進入了修道院,又怎能使法律的次序顛倒,要求那些更早進入修道院的人去做那些先前並不知曉、後來才藉我們神聖法令新訂之事呢?
60:6
Sed unumquemque competit secundum sua tempora exspectare ea; et quidein quae post legem sunt, ita quaerere fieri, sicut lex vult. Si quid autem ante legem subsecutum est, hoc non commovere, neque perscrutari, sed in priori figura relinquere. Haec igitur lex pro interpretatione utili posita sit prioris nostrae illius constitutionis, ut illa in posterioribus temporibus, ex quo facta est, locum habeat; et his qui postea convertentur, viris ac mulieribus posita sit, sibique potestatem in illis custodiat, nullo horum quae antea fuerint perscrutando:
But it is fitting that each person await these things according to his own times; and indeed those things which come after the law should be sought to be done thus, as the law wills. But if anything has followed before the law, this should not be disturbed nor scrutinized, but left in its former state. Therefore let this law be set down as a useful interpretation of that former constitution of ours, so that the latter may have effect in subsequent times, from the time it was made; and let it be laid down for those who shall afterwards be converted, men and women, and let it preserve its authority over them, scrutinizing none of those things which were before:
但合宜的是各人按自己的時候等候這些事;凡在法律頒布之後的事,當照法律所願去成就。但若有事發生在法律之前,便不應攪動,也不應追查,而當任其保持原狀。因此,願這條法律作為對我們先前那道法令有益的解釋而頒立,使那道法令自其制定之時起,於日後的時代得以生效;又願它為日後歸入修道生活的男女而立,並對他們保持其效力,而不追查任何先前已發生之事。
60:7
cum licentia sit prioribus viris ac mulieribus qui habitaverunt, aut etiam hactenus habitant in monasteriis, et maxime filiis existentibus, suas res quo volunt disponere modo. Tua igitur eminentia quae placue- J runt nobis, et per hanc sacram declarata sunt legem, solemniter per programmata sua omnibus facere manifesta festinet. Dat. Id. Octob., imp. d. n. Just. PP. since liberty is granted to the earlier men and women who have dwelt, or even now dwell, in monasteries, and especially when there are children, to dispose of their property in whatever manner they will. Let your Eminence therefore hasten to make manifest to all, solemnly through your edicts, the things which have pleased us and have been declared through this sacred law. Given on the Ides of October, in the eleventh year of our lord Justinian, Pius, Perpetual, Augustus, John the most distinguished man being consul, in the second indiction.
因為對於那些先前曾住、或至今仍住在修道院中的男女,尤其在有子女的情況下,已賦予自由,可按其所願的任何方式處置自己的財物。故願閣下從速藉您的詔諭,將我們所喜悅、並藉此神聖法律所宣告之事,隆重地向眾人公布。頒於十月之望日,我們的主上猶斯丁尼、虔誠者、永久者、奧古斯都在位第十一年,由至顯赫者約翰任執政官,第二個小紀年。
