98:1
Idem Augustus Juliano P. P. Tam dementis quam furiosi liberi, cujuscunque sexus, possunt legitimas contrahere nuptias, tam dote quam ante nuptias donatione a curatore eorum præstanda: aestimatione tamen in hac quidem regia urbe excellentissimi præfecti urbi, in provinciis autem virorum clarissimorum earum praesidum vel locorum antistitum, tam opinionepersonae quam dotis moderatione, et ante nuptias donationis, statuenda; praesentibus tam curatoribus dementis quam furiosi, necnon his qui ex genere eorum nobiliores sunt;
The same Augustus to Julian, Praetorian Prefect. The children, of either sex, both of a demented (demens) and of an insane (furiosus) person can contract lawful marriage, the dowry as well as the ante-nuptial donation being furnished by their curator: the valuation, however, being determined in this royal city by the most excellent Prefect of the City, but in the provinces by the most illustrious governors of them or by the prelates of the places — both as regards the estimation of the person and the measure of the dowry and of the ante-nuptial donation — in the presence of the curators both of the demented and of the insane, as well as of those who are nobler among their kindred;
同一位奧古斯都致禁衛總長尤利安。心智喪失者(demens)與精神失常者(furiosus)的子女,無論其性別如何,皆得締結合法婚姻,其嫁資(dote)與婚前贈與(ante nuptias donatio)皆由其保佐人提供:然估價之事,在此皇都應由至尊的京畿長官決定,在各行省則由最尊貴的總督或當地教長決定,兼顧對當事人身分的衡量,以及嫁資與婚前贈與的酌量;並須有心智喪失者與精神失常者雙方的保佐人,以及其親族中較為顯貴者在場;
98:2
ita tamen, ut nulla ex hac causa oriatur, vel in hac regia urbe, vel in provinciis jactura substantiæ furiosi, vel dementis, vel mente capti, sed gratis omnia procedant, ne tale hominum infortunium etiam expensarum detrimento prægravetur.
yet on this condition: that no loss of the property of the insane, or demented, or mentally afflicted person arise from this cause, whether in this royal city or in the provinces, but that all things proceed without charge, lest such a misfortune of these men be further burdened also by the detriment of expenses.
然須以此為條件:無論在此皇都或在各行省,皆不得因此事而使精神失常者、心智喪失者、或心神喪失者的財產蒙受任何損失,而當一切無償進行,免得此等不幸之人更因費用之耗損而加重其累。
