58:1
Scimus antea legem, etc. Relicta ecclesiae Mysiæ ad redemptionem captivorum et pauperum substentationem venduntor, si longius ab eo loco in aedibus aut vineis consistant: ut tamen qui ea reliquit, ex venditione relictorum jusserit erogationem fieri. Is qui in jure postulatur, si se absentet, condemnator, videlicet malam rem agens, quod contestata lite et legitime vocatus, non obtemperaverit. PP., mense Aprili, anno imperii d. Justiniani 12, Joanne v. c. cos.
We know a former law, etc. Things bequeathed to the church of Mysia for the redemption of captives and the support of the poor are to be sold, if they consist of buildings or vineyards farther from that place — provided, however, that he who bequeathed them shall have ordered the disbursement to be made from the sale of the things left. He who is summoned at law, if he absents himself, is to be condemned, as one plainly conducting an evil cause, because, the suit having been joined and he being lawfully summoned, he has not obeyed. Promulgated in the month of April, in the twelfth year of the reign of our lord Justinian, John being vir clarissimus, consul.
我們知道從前有一律法,云云。凡遺贈予密西亞教會、用於贖回俘虜與供養貧人之物,若是離該地較遠的房舍或葡萄園,當予變賣——但有一前提:立遺贈者須已命令從變賣所遺之物中作出撥付。凡依法受傳者,若自行迴避,當被定罪,顯然是行不義之事,因為在訴訟已成立、且已合法受傳之後,他竟不順從。頒佈於四月,當我主猶斯丁尼在位第十二年,約翰任執政官。
