42:1
Imperator Justinianus Augustus Hermogeni gloriosissimorum sacrorum officiorum magistro, exconsule et pa tricio. Inter cætera quae in deMentem ordinem reduximus, neque ea quæ spectabiles nostros referendarios concernunt, extra providentia nostrae terminos relinquenda putavimus, idque eo magis quo pluribus ia rebus magno nobis esse solent usui. Nam cum initio non amplo admodum numero inclusi essent, nos, quo magis multos illorum interventu adjuvaremus, facilius singulorum desideria perdiscentes, ut plures essent quam dudum effecimus.
The Emperor Justinian Augustus to Hermogenes, most glorious master of the sacred offices, ex-consul and patrician. Among the other things which we have reduced to a fitting order, we have thought that neither those matters which concern our honorable referendaries should be left outside the bounds of our providence, and this all the more because they are wont to be of great use to us in very many affairs. For since at the beginning they were comprised in a number not very ample, we—that we might the more aid many through their intervention, more easily learning thoroughly the desires of individuals—brought it about that they should be more numerous than before.

Caeterum exstiterunt quidam, qui liberalitatem nostram ad immensum provocantes, partim multos introducendo, qui nobis supplicarent, partim multis utendo precibus, dignitatis plenissimam rem quotidianis additamentis pene ad infinitum deduxerunt. Neque enim ante petendi finem feceruut, quam in quatuordenarium usque iilorum numerus evaderet.
But there arose certain men who, provoking our liberality to an immeasurable degree—partly by introducing many who might make supplication to us, partly by employing many entreaties—drew out this most exalted dignity, by daily additions, almost to infinity. For they did not make an end of petitioning before their number swelled all the way to fourteen.

Ne igitur quod jure a nobis in pretio habitum est, si ad multitudinem effundatur, suam amiuat dignitatem, placuit nobis ad certam illorum numerum mensuram contrahere, non ut iis qui hoc tempore sunt, concessa derogemus (neque enim regiæ hoc magnificenliae proprium est) praesertim cum neminem eorum qui nobis placeant, quique nobis honeste subserviunt, nostro expellere ministerio ullo unquam modo soleamus.
Lest, therefore, that which we have rightly held in esteem should lose its dignity if it be poured out upon a multitude, it has pleased us to confine them to a fixed number, not so as to take away the privileges granted to those who now hold the office (for that is hardly proper to royal magnificence), especially since we are by no custom ever wont to expel from our service any of those who please us and who serve us honorably.
因此,凡是我們依理珍視之物,若散布於眾多之人便會喪失其尊貴;故我們樂意將其人數限定於一個確定的數目,並非要剝奪如今任職者所獲的特權(因為這絕不合乎王者的恢宏氣度),尤其因為我們從不以任何方式、習於將那些令我們喜悅、又誠實地事奉我們之人逐出我們的職務。
42:4
Sed manere illos sub eadem qua modo sunt forma sancimus, neque omnino quisquam apponatur, donec intra octo viros illorum mensura consistat, ut perpetuo octo existant, nullo quidem, neque modo, neque tempore eo numero augendo, semper autem contendentibus illis, ut circa nos obsequio, et erga imperatoriam majestatem benevolentia alter alterum vicissim superent. Nemine licentiam habente ut ejus generis aliquid de caetero petat, sciente quod aeque ea quæ petit assequetur, et quia petere ausus est, non solum decem Hbrarum auri pœnæ erit obnoxius, sed etiam propria excidet militia.
But we ordain that they remain in the same form as they now are, and that no one whatever be added, until their number settles within eight men, so that there be perpetually eight, that number being increased neither now nor at any time; while they ever strive that, in obedience toward us and in goodwill toward the imperial majesty, each may in turn surpass the other. No one shall have license henceforth to seek anything of that kind, knowing that he will by no means obtain what he seeks, and that, because he has dared to seek it, he shall not only be liable to a penalty of ten pounds of gold, but shall also be cast out from his own office.
但我們頒令他們仍維持如今的形制,且絕不增添任何人,直到他們的人數定於八人之內,使其永遠保持八位,無論現今或日後皆不增此數;他們卻當常常彼此競爭,務求在對我們的順服、以及對皇室威嚴的善意上,輪番彼此勝過。自此以後無人有權謀求此類之事,須知他絕不能得著所求;並且因他膽敢謀求,他不僅要受罰十磅黃金之刑,更要被逐出自己的職位。
42:5
Volumus enim ut ad praedictum usque numerum intra mensuram cogibeantur, semperque justitia et aliis augeantur, magisque ae magis illustrentur virtutibus. Nullam enim dignitatem obtinet multitudo quae solo spectatur numero, quandoquidem ex tam multis vix paucos reperias, in quibus vita secundum virtutem salva sic. Quapropter maneant quidem (ut diximus) nunc sub hac forma. Cognoscens vero ea excellentia tua, ita custodiat, ut nullo unquam tempore transiliri eorum aliquid quae a nobis sancita sunt permittat, quin potius ab iis qui haec contra quid faciunt praedictam pœnam exigat, utpote qui ea expetant quae aeque petere licitum, neque dari possibile est.
For we wish that they be kept within measure up to the aforesaid number, and that they be ever increased in justice and in other things, and grow more and more illustrious in virtues. For a multitude that is regarded by number alone obtains no dignity, since out of so many you would scarcely find a few in whom life according to virtue is preserved. Wherefore let them indeed remain (as we have said) for now in this form. And let Your Excellency, taking cognizance of these things, so keep guard that at no time it permit any of the things ordained by us to be transgressed; but rather let it exact the aforesaid penalty from those who act contrary to anything herein, inasmuch as they seek things which it is neither lawful equally to seek nor possible to grant.
因為我們願他們被約束在所述的數目之內,並常在公義與其他事上有所增長,越發在諸德上彰顯。因為僅憑數目來衡量的群眾並無任何尊貴可言,既然在如此眾多之人中,你幾乎難尋幾位是按德行存活的。故此願他們(如我們所言)暫且維持此形制。願閣下知曉這些事,謹守此命,使任何時候都不容許我們所頒定之事有絲毫被踰越;反當向凡違背此中任何條款者,索取上述之刑罰,因他們所追求的,乃既不可均等地謀求、亦不可能賜予之事。
42:6
Atque ita prorsus nostra haec lex multitudine depulsa virtutem inducat, quae non admodum in multis elucescit, praesertim in iis viris qui tametsi bonis prognati sunt parentibus, fortunas tamen ac facultates suas in exponendis supplicum precibus, et impetrando illis a nobis auxilio repositas habent. Quæ igitur nobis placuerunt, et per hanc sacram exprimuntur legem, ea studeat excellentia tua ad effectum deducere, certoque fini tradere. Dat. Idib. Maii, Constantinop. Belisario v. c. coa.
And thus may this our law, with the multitude driven away, altogether introduce virtue, which does not shine forth greatly among many, especially among those men who, though born of good parents, yet keep their fortunes and means laid up for the laying forth of suppliants' petitions and for the obtaining of aid for them from us. The things, then, which have pleased us and are expressed through this sacred law, let Your Excellency be zealous to bring to effect and to deliver to a sure conclusion. Given on the Ides of May, at Constantinople, Belisarius, vir clarissimus, being consul.
