36:1
Imperator Justinianus Augustus Epiphanio, sanctissimo et beatissimo bujus regiæ urbis archiepiscopo, ejusque universi tractus patriarchae. Conversationis monachalis vita sic honesta est, sic commendare novit Deo ad hoc venientem hominem, ut omnem humanam ejus maculam detergat, et purum ac rationabili natura decentem, et plurima secundum mentem operantem, et humanis cogitationibus celsiorem reddat. Si quis igitur futurus est monachus perfectus, indiget et divinorum eloquiorum eruditione, et conversationis integritate, ut tanta dignus factus sit mutatione. Credimus igitur et nos explanare quid agendum ab eis sit, et decertatores eos veros ad sacram viam constituere.
The Emperor Justinian Augustus to Epiphanius, most holy and most blessed archbishop of this royal city, and patriarch of its entire district. The life of monastic conversation is so honourable, it knows so to commend to God the man who comes to it, that it wipes away every human stain of his, and renders him pure and befitting his rational nature, and operating in many things according to the mind, and loftier than human thoughts. If therefore anyone is to be a perfect monk, he has need both of instruction in the divine eloquences and of integrity of conversation, that he may be made worthy of so great a change. We believe therefore that we too explain what ought to be done by them, and constitute them true contenders unto the sacred way.

36:2
Et ita nobis intentio praesentis est legis, ut post illa, quae de sanctissimis episcopis sancivimus, et quæ de reverendissimis clericis disposuimus, neque quod monasticum est, extra competentem formam relinquamus. Illud igitur ante alia dicendum est, ut quocunque tempore et quocunque loco quis aedificare venerabile monasterium voluerit, non prius licentia sit hoc agendi, quam Deo amabilem locorum episcoI pum advocet. At ille extendat manus ad cœlum, et per orationem locum consecret Deo, figens in eo salutis nostrae signum (dicimus autem adorandam et vere honorandam crucem). sicque inchoet ædificium, bonum utique quoddam in hoc et decens fundamentum ponens hoc;
And thus the intention of the present law is ours, that after those things which we have sanctioned concerning the most holy bishops, and those which we have ordained concerning the most reverend clerics, we should not leave even that which is monastic outside its competent form. This therefore before all else must be said: that whensoever and in whatsoever place anyone shall wish to build a venerable monastery, let there not first be license of doing this, before he summon the bishop of the place, beloved of God. And let him stretch out his hands to heaven, and by prayer consecrate the place to God, fixing in it the sign of our salvation (we mean the cross, to be adored and truly to be honoured); and so let him begin the building, laying in this some good and seemly foundation;

36:3
itaque principium piae veneraMlium monasteriorum fabricae fiat. Hinc autem nobis etiam de singulis monachis cogitandum est, quo conveniat fieri modo, et utrum IIberos solum, aut etiam forte servos, eo quod omne similiter divina suscepit gratia praedicans palam, quia quantum ad Dei cultum non est masculus, neque femina, neque liber, neque servus', omnes enim in Christo unam mercedem percipere.
and so let the beginning of the fabric of pious and venerable monasteries come to be. But hence we must also take thought concerning individual monks, in what manner it is fitting it should be done, and whether free men only, or perhaps even slaves, inasmuch as divine grace has alike received all, openly proclaiming that, as concerns the worship of God, there is neither male nor female, neither free nor slave; for all alike receive one reward in Christ.

36:4
Sancimus ergo sacras sequentes regulas, eos qui singularem conversationem profitentur, non prompte mox a reverendissimis præsulibus venerabilium monasteriorum habitum percipere monachalcm, sed per triennium totum (sive liberi forte sint, sive servi) tolerare, nondum monasticum habitum promerentes, sed tonsura et veste eorum qui laici vocantur, uii et manere, sic divina addiscentes eloquia.
We therefore decree, following the sacred canons, that those who profess the solitary life are not at once to receive the monastic habit readily from the most reverend prelates of the venerable monasteries, but are to undergo a full three years (whether they happen to be freeborn or slaves), not yet earning the monastic habit, but using and retaining the tonsure and the garb of those who are called laymen, and so learning the divine words.
故此我們依循神聖教規而頒令:凡立志度獨修生活之人,不可立即輕率地從可敬隱修院中最可敬的院長手中領受隱修士的會服,而須先經歷整整三年(不論其為自由人或奴隸),在此期間尚不配得隱修會服,乃應持守那被稱為平信徒之人的剃髮與服飾,如此學習神聖的聖言。
36:5
Et reverendissimos eorum abbates requirere eos, sive liberi sint, sive servi, et unde eis desiderium vitæ singularis accesserit, et discentes ab eis quia nulla maligna occasio ad hoc eos induxit, et habere eos inter illos, qui adhuc docentur, atque monentur, et experimento percipere eorum tolerantiam, et honestatem; non enim facilis est vitæ hominum mutatio, sed cum animæ magno fit labore. Et cum triennio toto in ea viia permanserint, optimos semetipsos et tolerabiles aliis monachis et præsuli demonstrantes, hos monasticam promereri vestem, atque tonsuram, et sive liberi sint, sine calumnia permanere, sive servi, penitus non inquietari migrantes ad communem omnium.
And their most reverend abbots are to inquire of them, whether they are free or slaves, and from what motive the desire for the solitary life has come upon them; and learning from them that no evil occasion has led them to this, they are to keep them among those who are still being taught and admonished, and to ascertain by trial their endurance and integrity. For the change of a man's life is not easy, but comes about with great labour of the soul. And when they have remained in that way of life for a full three years, showing themselves excellent and bearable to the other monks and to their superior, these are to earn the monastic garment and tonsure; and whether they be free, let them remain without slander, or slaves, let them in no way be molested as they pass over into the common life of all.

36:6
Dicimus autem coelestem Dominum, sed in libertatem eripi. Nam si in multis casibus etiam ex lege hoc fit, et talis quædam libertas datur, quomodo non praevalebit divina gratia talibus eos absolvere vinculis? Si vero intra triennium venerit quispiam, et aliquem horum, qui conversationem professi sunt, abstrahere tanquam servum voluerit, hoc quod nobis nuper ex Lycia nuntiavit Zosimus Deo amabilis, vir famosissimus in conversatione, et prope vicesimum et centesimum aetatis agens annum, pollens autem et animi virtutibus et corporis operationibus, quia tanta quaedam in eo gratia Dei floret.
And we say that they are snatched away unto the heavenly Lord, indeed unto liberty. For if in many cases this is done even by the law, and a certain such liberty is granted, how shall not divine grace prevail to release such men from these bonds? But if within the three years someone should come and wish to drag off as a slave one of these who have professed the solitary life — that very thing which Zosimus, beloved of God, lately reported to us from Lycia, a man most renowned in his manner of life, nearly one hundred and twenty years of age, yet strong both in virtues of soul and in works of body, since so great a grace of God flourishes in him.

36:7
Si quis igitur ( sicut prediximus ) intra triennium veniat aliquem eorum qui volunt csse et perseverare monachi, in servitutem tracturus, et dicat quod abripuerit quasdam res, et propterea recurrerit ad monasterium, sancimus eum non prompte agere, sed primo probare pro veritate, quia et servus est, et pro furto forsan, aut pro vita maligna, aut pro vitiis pessimis fugerit quidem, propter suum autem vitium ad monasterium venerit.
If therefore anyone (as we said before) should come within the three years intending to drag into servitude one of those who wish to be and to persevere as monks, and should say that the man has carried off certain goods and has therefore taken refuge at the monastery, we decree that he is not to proceed rashly, but is first to prove according to the truth both that the man is a slave, and that perhaps for theft, or for an evil life, or for the worst vices he has indeed fled, and on account of his own vice has come to the monastery.

36:8
Et si quidem verax ostenditur, et apparuerit propter hujusmodi causam monasticam eum simulasse conversationem, aut propter turpiludinem vitæ forte diffugisse, et non pro veritate sanctimonix habitum concupiisse, hunc reddi domino, cum iis quæ forsan abripuit, si tamen haec etiam in monasterio fuerint. Eum vero, qui dominus approbatur, dare et jusjurandum, quia nihil mali ei faciet, et susceptum eum reducet domum.
And if indeed he is shown to be truthful, and it appears that for such a cause the man feigned the monastic manner of life, or that on account of the baseness of his life he fled, and did not for the sake of true holiness desire the habit, this man is to be restored to his master, together with the things he perhaps carried off, if these too are found in the monastery. But he who is approved as master is also to give an oath that he will do the man no harm, and that, having received him back, he will bring him home.
若那人果真被證明所言屬實,並顯明那奴隸是為著這樣的緣由假裝隱修生活,或是因生活的卑劣而逃走,並非為著真實的聖德而渴慕會服,這人便當連同他或許擄走的財物一併歸還其主人,倘若這些財物也在隱修院中尋見的話。但那被認定為主人的,也要起誓:他必不加害此人,並要在領回之後帶他回家。
36:9
Si vero is quidem qui dicit se esse dominum, nihil tale probaverit, et appareat is qui in talibus accusatur, ex ipsa conversationc honestus ac mitis, et forte testimonium habeat aliorum, quia etiam apud dominum consistens discendi cupidus fuerit, et honestatis amator, et si nondum forte completum est triennii tempus, attamen etiam sic maneat in venerabili monasterio, abstrahere cupientium asperitate liberatus. Triennii vero semel expleto tempore, judicatus, quia monastica dignus est honestate, maneat in monasterio. Nequaquam enim damus licentiam ulli penitus perscrutari, quæ ejus sunt, sed sive liber, sive servus sii, manere eum in conversatione volumos.
But if he who claims to be master should prove nothing of the kind, and the one who is accused in such matters appears, from his very manner of life, honourable and gentle, and perhaps has the testimony of others that even while living with his master he was eager to learn and a lover of integrity — then even if perchance the period of three years is not yet completed, nevertheless let him so remain in the venerable monastery, freed from the harshness of those wishing to drag him off. And once the three-year term has been fully completed, being judged worthy of monastic integrity, let him remain in the monastery. For we in no way grant license to anyone whatsoever to scrutinize what belongs to him; but whether free or slave, we will that he remain in the monastic life.
但若那自稱為主人的甚麼也證明不出,而那在此事上被控告的人,從他生活方式本身看來既端正又溫和,且或許有別人作證,說他即使與主人同住時也渴慕學習、熱愛端正——那麼即使三年的期限或許尚未完成,他仍當如此留在可敬的隱修院中,脫離那些想擄走他之人的苛酷。而一旦三年期滿,經判定配得隱修的端正,他便當留在隱修院中。因為我們絕不容許任何人去細查屬於他的事物;無論是自由人或奴隸,我們都願他留在隱修生活中。
36:10
Nam et si vitium in priori ab eo forte gestum est vita (humana enim natura quodammodo labitur ad delicta), attamen sufficit ad mediocrem purgationem peccatorum, et ad virtutis augmentum triennalis temporis testimonium. Ea vero quae rapta sunt, apud quoscunque tandem inveniantur, modis omnibus reddantur prisco domino. Si vero servitii necesssiatem effugiens, tentaverit monasterium quidem derelinquere, aliam autem vitæ sectari figuram, licentiam damus domino retrabere eum, et probanti fortunam inter servos habere; non enim injuriam patietur tantam ad verum servitium retractus, quantum ipse injuriatus est Dei culturam refugiens.
For even if perhaps some fault was committed by him in his former life (for human nature in some manner slips into offences), nevertheless the testimony of a three-year period suffices for a moderate purgation of sins and for the increase of virtue. But the things that were stolen, in whosoever's hands they may at last be found, are by all means to be restored to the former master. But if, fleeing the necessity of servitude, he should attempt to abandon the monastery and to follow another pattern of life, we grant license to the master to draw him back, and, having proved his case, to keep him among the slaves. For he will not suffer so great an injury when dragged back to true servitude as he himself inflicted by fleeing the worship of God.

36:11
Et hoc quidem de fortuna horum qui inter monachos profiteri volunt sancimus. Cogitandum vero est, quomodo ipsos habitantes et ibi degentes monasticae philosophiæ certatores dignos esse ostendamus. Neque enim voiumus in ullo monasterio sub ditione nostra constituto, sive plurimoruin hominum est, sive paucorom, monachos qui ibi sunt, divisos ab alterutris esse, et propriis habitationibus uti, sed communiter quidem eos comedere sancimus, dormire etiam omnes in communi, unoquoque quidem in quadam proprii statura jacente, in domo vero una collocatos, aut si forte non sufficit ad multitudinem monachorum domus una, in duas forsan, aut plures.
And this indeed we decree concerning the lot of those who wish to make profession among the monks. But we must consider how we may show those who dwell and abide there to be worthy contestants of the monastic philosophy. For we will not have, in any monastery established under our dominion, whether it be of many men or of few, the monks who are there divided from one another and using their own separate dwellings; but we decree that they eat in common, and that all sleep also in common, each one lying down within a certain space of his own, but placed together in one house — or, if perchance one house does not suffice for the multitude of monks, in two perhaps, or more.

36:12
non tamen seorsim, et apud semetipsos, sed in communi, testes alterutri sint honestatis et castitatis. Et neque somnum desidiosum habeant, sed et in somno meditantes bene composito esse corpore propter increpationem respicientium. Nisi tamen quidam eorum in contemplatione et perfectione degentes vitam remotam habeant in secessu, quos vocare anachoretas, et hesychastas consueverunt tanquam a communione ad meliora exceptos. Alioquin alios, quibuscunque inter multitudinem conversatio est, in his quæ vocantur cænobia, esse volumus. Sic enim zelus eis ad virtutem crescit, et maxime juvenibus, si cnm senioribus constituantur. Fiet enim seniorum conversatio juventutis educatio perfecta.
yet not apart and by themselves, but in common, that they may be mutual witnesses of one another's integrity and chastity. And let them not have slothful sleep, but even in sleep let them be mindful that the body be well composed, out of regard for those who observe them. Unless indeed certain of them, living in contemplation and perfection, lead a secluded life in retreat — those whom men are accustomed to call anchorites and hesychasts, as being taken up from the community to better things. Otherwise we will that the others, whoever have their manner of life among the multitude, be in what are called cenobia. For thus their zeal for virtue increases, and especially in the young, if they are placed together with the elders. For the manner of life of the elders shall become a perfect education for the young.

Et sic sint in cænobiis suo proprio abbati obedientes, et traditam sibi conversationem inculpabiliter observantes. Si quis autem forte semel dedicatus, habituque potitus, deinde a monasterio discedere voluerit, et privatam fortassis eligere vitam, ipse quidem sciet quam pro hoc dabit Deo satisfactionem; res autem quascunque habuerit, dum in monasterium intrabar, eae dominii sint monasterii, et nihil inde penitus ciciat. Illud quoque decernimus eum qui in monaserium introire voluerit, antequam monasterium ingrediatnr, licentiam habere suis uti quo voluerit modo; ingredientem namque simul sequuntur omnino res, licet non expressim. cum introduceret eas, dixerit;
And let them so be in the cenobia, obedient to their own proper abbot, and observing blamelessly the manner of life handed down to them. But if anyone, having once been consecrated and obtained the habit, should afterward wish to depart from the monastery, and perhaps to choose a private life, he himself shall know what satisfaction he will render to God for this; but whatever goods he had when he entered the monastery, these shall be the property of the monastery, and he shall carry off absolutely nothing thence. This too we decree: that he who wishes to enter a monastery shall, before he enters the monastery, have license to use his own goods in whatever manner he wishes; for to one who enters, his goods altogether follow him, even if he did not expressly say so when he brought them in.

36:14
et non erit dominus earum ulterius ullo modo. Si vero filios habuerit, si quidem contigerit jam eum res aliquas donasse eis, aut per antenuptialem donationem, aut per dolis occasionem contulisse, et faciant haec quartam ab intestalo ejus substantiae partem, nullum in reliquis rebus habeant participium filii. Sin autem nihil eis donaverit, aut minus quarta, et postquam abrenuntians conversalus fuerit inter monachos, nihilominus quarta debetur filiis, ut aut in totum eis detur aut, si contingat eos jam aliquid accepisse, suppleatur.
And he shall no longer in any way be the owner of them. But if he should have children, if indeed it happens that he has already given them certain goods, either through an ante-nuptial donation, or has conferred them by gift on some occasion, let these make up a fourth part of his estate as if from intestacy, and let the children have no share in the remaining goods. But if he has given them nothing, or less than a fourth, then after he has renounced the world and dwelt among the monks, nonetheless a fourth part is owed to the children, so that either it be given to them in full, or, if it happens that they have already received something, it be made up to that amount.

Si autem uxorem habens, deinde eam relinquens, in monasterium ingrediatur, et dos mulieri servetur, et ex morte pactum, quod in alia nostra sancivimus constitutione. Omnibus, quae super monachis dicta sunt, et in mulieribus monasterium ingredientibus, valituris. Si vero relinquens monasterium ad quamdam veniat militiarn, aut ad aliam vitæ figuram, substantia ejus etiam sic in monasterio, secundum quod a nobis prius dictum est, remanente, ipse inter officiales clarissimi provinciæ judicis statuetur, et hunc habebit mutationis fructum, quod pro sacro ministerio despecto, lribunalis terreni observet servitium.
But if a man having a wife, then leaving her, enters a monastery, let the dowry also be preserved for the woman, and the settlement upon death, as we decreed in another of our constitutions. And all that has been said concerning monks shall hold good also for women entering a monastery. But if, leaving the monastery, he comes to some military service, or to another pattern of life, his property even so remaining in the monastery, according to what was previously said by us, he himself shall be placed among the officials of the most distinguished judge of the province, and this shall be the fruit of his change: that, for the sake of the sacred ministry he has despised, he observes the service of an earthly tribunal.

Si vcro relinquens monasterium, in quo conversationem habuerit, ad aliud transeat monasterium: etiain sic quidem ejus substantia maneat, et vindicetur a priori monasterio, ubi abrenuntians hanc reliquit. Competens autem est reverendissimos abbates non suscipere eum qui hoc egit. Erronea namque est talis vita, et nullatenus monasticae tolerantiae proxima, neque constantis ct persistentis animi, sed judicium habens circulaturis, et aliud de alio requirentis. Ea propter etiam hoc prohibeant Deo amabiles episcopi et archimandritæ nuncupati, monasticam honestatem secundum regulas sacras conservantes.
But if, leaving the monastery in which he had his manner of life, he passes over to another monastery — even so let his property remain and be claimed by the former monastery, where, in renouncing, he left it. And it is fitting that the most reverend abbots not receive him who has done this. For such a life is errant, and in no way close to monastic endurance, nor of a constant and persevering mind, but holds the judgment of one who wanders about and seeks one thing after another. Therefore let the bishops beloved of God and those named archimandrites forbid this also, preserving monastic integrity according to the sacred canons.
但若他離開那曾度其生活的隱修院,轉往另一隱修院——即便如此,他的產業仍當留下,並由前一隱修院索回,就是他在棄絕時所離開之處。並且最可敬的院長們不收納行此事之人,乃是合宜的。因為這樣的生活是漂泊不定的,絕不近乎隱修的忍耐,也非恆久持守之心,乃是懷有那四處遊蕩、見異思遷之人的心思。因此,蒙神所愛的主教們,以及那稱為大院長的,也當禁止此事,照神聖教規保守隱修的端正。
36:17
Si quis autem monasticam profitentium conversationem meruerit clerici ordinationem, maneat etiam sic puram servans conversationem. Quod si facti clerici abutatur fiducia, et ad nuptias venire (quippe tali gradu constitutus inter elericos, qui ei uxorem ducere permittat, dicimus autem cantorum aut lectorum, aliis enim omnibus nuptias secundum sacras regulas penitus interdicimus), aut concubinas habere, aut luxuriis tradere vitam praesumat, excludatur nobis omnibus a clero, tanquam priorem conversationem et solitariam confundans vilam, et privatus sit de caetero. Ad militiam quidem, aut ad aliud officium venire non præsumens, nisi a nobis voluerit dudum interminatis subjacere pcenis.
But if anyone of those professing the monastic manner of life should merit ordination as a clergyman, let him even so remain, preserving his manner of life pure. But if, having been made a clergyman, he should abuse his confidence, and presume to come to marriage (since being placed in such a rank among the clergy that permits him to take a wife — we mean of the cantors or lectors, for to all others we wholly forbid marriage according to the sacred canons), or to keep concubines, or to give over his life to debaucheries, let him be excluded by us all from the clergy, as one who has confounded his former and solitary manner of life, and let him be a private person henceforth. He may not presume to come to military service, or to any other office, unless he be willing to lie subject to the penalties long since threatened by us.
但若那些立志度隱修生活之人中,有人配得受聖品為神職人員,他即使如此也當留下,保守其生活方式純潔。但若他在被立為神職人員後,竟濫用所受的信任,膽敢前去結婚(既然被置於神職中那容許他娶妻的品級——我們是指歌詠者或讀經者,因為對其餘所有人,我們照神聖教規完全禁止婚姻),或蓄養姘婦,或將生命交付放蕩,他便當被我們眾人從神職中除名,因他混亂了自己從前獨修的生活,從此要作平民。他也不可膽敢前去從事兵役或任何其他職務,除非他願意伏在我們久已警告的刑罰之下。
36:18
Ipse autem apud semetipsum reputans et agnoscens, qualem pro hoc daturus sit magno Deo satisfactionem.
But let him, reckoning and acknowledging within himself, consider what satisfaction he shall render to the great God for this.
但願他在自己心中思量並承認,為此他要向偉大的神獻上何等的交代。
36:19
Ordinalione vero abbatem si quando contigerit egere monasterium, jubemus abbatem non per ordinem reverendissimorum fieri monachorum, nec omnino eum qui mox post primum est, nec qui post illum secundus est, neque tertium, aut reliquos, hoc quod etiam alia lex nostra dicit, sed Deo amabilem locorum episcopum percurrere quidem consequenter per omnes (non enim exhonorandum est omnino tempus, et ex eo ordo) et eum qui apparuerit prius optimus inter monachos optimos constitutus, ei dignus praesulaiu eorum, hunc eligere, eo quod humana natura talis est, ut neque omnes per ordinem inter summos boni, neque rursus omnes inter novissimos mali constituti sint, sed procedat quidem secundum gradum antistitis inspectio.
But when it happens that a monastery has need of the ordination of an abbot, we command that the abbot not be made according to the rank of the most reverend monks, nor by any means he who is next after the first, nor he who is second after that one, nor the third, nor the rest — as another law of ours also says — but that the bishop of the place, beloved of God, run through all consecutively (for time, and the order derived from it, is by no means to be dishonoured), and that he who appears foremost, established as the best among the best monks, worthy of presiding over them, this one he is to choose; because human nature is such that neither are all who are by rank among the highest good, nor again are all who are placed among the lowest evil, but let the inspection of the prelate proceed according to grade.
但當隱修院需要按立一位院長時,我們吩咐院長不可照最可敬隱修士的資歷次序而立,也絕不可立那緊接在首位之後的,也不可立次於那位的第二位,也不可立第三位或其餘的人——正如我們另一條律法所言——乃要蒙神所愛的本地主教依次逐一審視眾人(因為年資及由此而來的次序,絕不可受輕視),凡顯為最優者、被立為眾優秀隱修士中之佼佼者、配得作他們的長上的,便要揀選這人;因為人性如此,既非凡按次序居於最高位者都善,也非凡置於最末位者都惡,乃要照品級進行對長上人選的審察。
36:20
Qui vero prior, mox inter numeratos optimus apparuerit, is abbas sit, et ordinem simul et virtutem suffragantem habens. Oportet enim eos qui discernunt quod melius est a pejore, alius quidem ad regendum dimittere, aliud vero inclinari jubere, et paulatim per eruditionem hoc etiam ad melius adducere. Quaecunque tamen a nobis in omnibus, quae prius, et quae nunc prolatae sunt, sacris nostris constitutionibus sunt sancita de clericis, aut monachis, aut monasteriis, hæc communia ponimus et in masculis et feminis, et monasteriis, et asceteriis, non discernentes ( quantum ad istos) masculum aut feminam, eo quod ( sicut praediximus ) unum omnia in Christo consistunt.
But he who, being foremost, at once appears the best among those reckoned, let him be abbot, having both rank and virtue together in his favour. For it behoves those who discern what is better from what is worse, to release the one for ruling, but to bid the other be bent down, and little by little, through instruction, to lead this one too to better things. But whatever has been decreed by us in all things, both those formerly and those now set forth in our sacred constitutions, concerning clergy, or monks, or monasteries, these we lay down as common both to males and to females, and to monasteries and to convents, not distinguishing (as far as these are concerned) male or female, because (as we said before) all are one in Christ.
但那居首位之人,若立時顯為被計算之人中的最優者,便當作院長,使他兼有資歷與德行同為其助力。因為那些分辨善惡優劣之人,理當釋放一人去治理,卻吩咐另一人俯伏受教,並藉教導漸漸把這人也引向更美之事。但凡我們在一切事上,無論是從前還是如今,在我們神聖的敕令中所頒定論及神職人員、或隱修士、或隱修院的一切,我們都立為男女、隱修院與女修院所共有的,並不(就這些事而論)分別男女,因為(如我們前面所說)萬事在基督裡都成為一了。
36:21
Hæc igitur omnia sanctissimi patriarchae sub se constitutis Deo amabilibus metropolitanis manifesta faciant. At illi subjectis sibi Deo amabilibus episcopis declarent, et illi monasteriis Dei sub sua ordinatione constilutis cognita faciant, quatenus per omnia Domini cultura maneat undique incorrupta. Imminebunt enim maximae poenae ista transgredientibus: dicimus autem de coelo quas,necesse est rectorum dogmatum contemptoribus imminere. Et nostræ quoque reipublicae judices. si haec eis nuntientur, omnibus studeant modis ea qu æsacris regulis continentur, quas nostra sequitur lex, ad effectum perduci procurare, nam nec illos deserit poena haec negligentes.
Let therefore the most holy patriarchs make all these things manifest to the metropolitans beloved of God established under them. And let those declare them to the bishops beloved of God subject to them; and let those make them known to the monasteries of God established under their ordering, so that in all things the worship of the Lord may remain everywhere uncorrupted. For the greatest penalties shall threaten those who transgress these things — we mean those penalties from heaven which must threaten the despisers of right doctrines. And let also the judges of our commonwealth, if these things be reported to them, strive by all means to procure that what is contained in the sacred canons, which our law follows, be carried into effect; for neither does this penalty desert those who neglect them.
故此,願最聖潔的眾宗主教把這一切顯明給置於他們之下、蒙神所愛的都主教。願這些人向順服他們、蒙神所愛的主教們宣告;願那些主教向置於他們治理之下、屬神的眾隱修院通知,使在一切事上,主的敬拜得以處處純全不受敗壞。因為極大的刑罰必威脅那些違犯這些事的人——我們是指那從天而來的、必威脅輕慢正道之人的刑罰。並且願我們邦國的審判官們,若這些事報知他們,便竭力以各樣方法促成那神聖教規所含、為我們律法所遵循之事得以實行;因為這刑罰也不放過那些疏忽這些事的人。
36:22
Quapropter sequentem hanc tuam sanctitatem decet omnibus sub se positis sanctissimis metropolitanis haec facere manifesta. Dat. xiv Kalend. April. Constantinop. Bilisario v. c. coss.
Wherefore it befits Your Holiness, who follows this, to make these things manifest to all the most holy metropolitans placed under you. Given the fourteenth day before the Kalends of April, at Constantinople, in the consulship of Belisarius, most distinguished man.
因此,這合宜於遵從此敕的閣下聖德,將這些事顯明給置於閣下之下的眾至聖都主教。頒於四月初一前第十四日,於君士坦丁堡,在最尊貴者貝利撒留任執政官之年。
