108:1
Hæretici patres nihil habentes legitimum quo accusent orthodoxos filios, coguntur præter facultates suas etiam alimenta erogare iBis, et reliqua necessaria, et conjungere (in matrimonium) orthodoxis, et dare dotes et antenuptiales donationes, providentia præsidum et episcoporum. — § i. Orthodoxi filii hæreticorum, qui nihil deliquerunt in parentes, illibatum accipiunt, et indeminutum, quod eis ab intestato competit, et adversus hæc facta ultima voluntas infirmatur: conservatis libertatibus, nisi aliqua lege prohibeantur. Si vero quid deliquerint in parentes, accusantur, et puniuniur. Habent autem, et com deliquerint, quartam facultatum ipsorum [partem] testamento facto. — § 2.
Heretical fathers, having no lawful ground on which to accuse their orthodox children, are compelled, beyond their means, even to furnish those children with nourishment and the other necessaries, and to give them in marriage to orthodox spouses, and to provide dowries and ante-nuptial gifts, under the provision of the governors and bishops. § 1. The orthodox children of heretics, who have committed no offense against their parents, receive intact and undiminished that which belongs to them on intestacy; and a last will made contrary to these provisions is invalidated—their liberties being preserved, unless they be prohibited by some law. But if they have offended against their parents, they are accused and punished. Yet even when they have offended, they have a fourth part of their parents' estate when a will has been made. § 2.
