Idem Augustus Joanni P. P. Sancimus, in curationibus juniorum, sive primz, sive secundæ sint aetatis, aut alii quidam, qiubus lex dat curatores, siquidem usque ad quingeotos aureos et solummodo facultates sint juniorum, non praesidum provinciarum exspectare creationem, neque impensis maximis subjici, præsidibus forte neque morantibus in urbibus illis in quibus prospici curalioni contingit, sed apud civitatis illius ecdicum Įdefensorem] aut strategum [magistratum municipalem,] vel in Alexandrina civitate apud ejus juridicum, una cum religiosissimo ejus episcopo, aut aliis etiam publicis personis, si harum copiam habeat civitis, Geri creationes curatorum seu tutorum;

The same Augustus to John, Praetorian Prefect. We decree, in the curatorships of minors (juniores), whether they be of the first or of the second age, or of certain others to whom the law gives curators, that if the means of the minors are only up to five hundred gold pieces, they should not wait for the appointment by the governors of the provinces, nor be subjected to very great expenses — the governors perhaps not even residing in those cities in which it happens that provision must be made for the curatorship — but that the appointments of curators or guardians be made before the ecdicus [defender] of that city, or the strategus [municipal magistrate], or, in the city of Alexandria, before its juridicus, together with its most religious bishop, or also other public persons, if the city has an abundance of these;

fidejussore secundum mensuram facultatum dato, secundus. dictarum personarum judicium; et aliis omnibus procedentibus, quaecunque super tutorum vel curatorum fidejussione et secundum modum facultatum consueta sunt; sola personarum transmutatione, per quas haec fiant propter minorum utilitatem a præsenti sanetione introducta; omnibus videlicet bis sub sola duorum numismatum [id est, solidonlm] datione conficiendis, præsertim cum hac maxime de causa hæc posita sit constitutio, poena imminente, si quis plus accipere ausus fuerit, aut distulerit constituere tutelam seu curationem spe majoris lucri;
並依財產之多寡提供擔保人,依前述人員的判斷;其他一切凡關於監護人或保佐人之擔保、並依財產額度而向來慣行之事,皆照常進行;唯有藉本敕令、為未成年人之利益所引入者,是執行這些事務的人員之更替;凡此一切,自當僅以支付兩枚錢幣(numismata,即 solidi 金幣)辦理,尤其因為本敕令主要正是為此緣由而設,並懸有罰則:倘若有人膽敢收取更多,或因圖謀更大利益而拖延設置監護或保佐之職,
a surety being given according to the measure of the means, in accordance with the judgement of the said persons; and all the other things proceeding which are customary concerning the surety of guardians or curators and according to the measure of the means; only the change of the persons through whom these things are done being introduced by the present enactment for the benefit of the minors; all these things, namely, to be accomplished under the giving of only two coins (numismata, that is, solidi), especially since this constitution has been laid down chiefly for this reason — a penalty being imminent if anyone shall have dared to receive more, or shall have deferred to establish the guardianship or curatorship in hope of greater gain;

et eo non solum triplum reddituro omne quidquid acceperit, sed etiam ab ipsa sollicitudine et administratione removendo. Cum autem factae fuerint lutorum aut curatorum creationes, praesente etiam religiosissimo civitatis episcopo, in ipsis sanctissimæ ecclesiae archiis deponi gesta sancimus, ut sit perpetua rei memoria, et non intercidat casibus fortnitis curationis exinde quæsita cautela. His quæ in magna hac civitate fiunt tulelis aut curationibus apud solum clarissimum praetorem faciendis, uti jam sancitum est. Dat. v Kalend. Aug., CP., post consul. Lamp.
則此人不僅須三倍償還其所收受的一切,並且須被免除該照管與管理之職。又當監護人或保佐人的任命作成後,並有該城最虔誠的主教在場,我們裁定應將相關記錄存放於至聖教會的檔案中,俾成此事的永久記錄,使因保佐而獲致的保障不致因偶發事故而喪失。至於在此大城中所辦理的監護或保佐事務,仍應僅在最尊貴的執政官(praetor)之前辦理,一如已經裁定者。頒於八月一日前五日,於君士坦丁堡,蘭帕迪烏斯執政之後。
and that one being bound not only to repay threefold whatever he received, but also to be removed from the very care and administration. But when the appointments of guardians or curators have been made — in the presence also of the most religious bishop of the city — we decree that the proceedings be deposited in the very archives of the most holy church, that there may be a perpetual record of the matter, and that the security obtained from the curatorship may not perish through chance accidents. As for the guardianships or curatorships which are made in this great city, they are to be performed before the most illustrious praetor alone, as has already been decreed. Given on the 5th day before the Kalends of August, at Constantinople, after the consulship of Lampadius.
