90:1
Idem Augustus Joanni P. P. Praesens lex in alterius legis scriptae a nobis refertur mentionem, quam proculdubio et denno cootirmare cum quadam meliore putavimus oportere adjectione, majorem poenam contra delinquentes proferendo; non quia augmentis delectemur pœnarum (nihil enim nobis tam gratum est quam humanius, sed ut metu poenae eos qui ad peccandum proclives sunt a peccando arceamus.

The same Augustus to John, Praetorian Prefect. The present law refers to the mention of another law written by us, which we have thought it fitting without doubt to confirm anew with a certain improving addition, by proffering a greater penalty against transgressors — not because we take delight in the increase of penalties (for nothing is so pleasing to us as what is more humane), but in order that by the fear of punishment we may restrain from sinning those who are prone to sin.
90:2
Scimus igitur nos scripsisse legem dicentem nullam esse licemiam sanctissimarum ecclesiarum oeconomis, aut antistitibus Itnonum, aut nosocomiorum, aut ptochiorum, aut monasteriorum, sive virorum, sive mulierum, aut aliorum talium corporum, quorum præfata constitutio meminit, ea quae in perpetuum illis relicta sunt, quæ annalia vocant leges, secundum aliquod pactum aut auro distrahere certo, autalienare aliter per quemcunque modum, et posteris adimere id quod eis obveniret exinde solatium:
因此我們知道,我們曾訂立一條法律,聲明至聖教會的財務管理人(經濟官),或客旅之家(招待所)、養病院、濟貧院,或修道院(無論男修或女修),或前述憲令所提及的其他此類團體的主管,無權藉任何協議、或以固定數額的黃金、或以任何其他方式,將那些永久留給他們、法律稱之為「年金物」之物轉讓出去,而剝奪後人從中所應得的慰藉;
We know therefore that we wrote a law stating that there is no liberty for the stewards (oeconomi) of the most holy churches, or for the prelates of hospices (xenones), or of infirmaries (nosocomia), or of poorhouses (ptocheia), or of monasteries — whether of men or of women — or of other such corporations which the aforesaid constitution mentions, to alienate, by any agreement or for a fixed sum of gold, or in any other manner whatsoever, those things which have been left to them in perpetuity — which the laws call 'annalia' — and to take away from posterity that consolation which would thence accrue to them;
90:3
et convenientes legi adjecimus rationes, ut quia non amplius propter tale commentum, nec appellatio quidem annui conservetur, nisi per singulos annos contingat præstari, sed semel repraesentatum, postea perfecte pereat. Hanc iterum cum aliqua adjectione renovantes legem sancimos:

and to the law we added fitting reasons: that since, on account of such a contrivance, not even the designation of an annual payment is preserved unless it happens to be rendered through each several year, but once paid down in full, it afterwards utterly perishes. Renewing this law again with a certain addition, we ordain:
90:4
si quis aut reverendissimorum œconomorum, aut xenodochorum, aut nosocomorum, aut ptocbotrophorum, autgerontocomorum, aut brephotrophorum, aut orphanotrophorum, aut archimandritarum, III aliarum contentarum priore nostra divina constitutio' ne personarum, id quod in perpetuum relictum est venerabilibus domibus quibus praesunt, sive in auro, sive in aliis rebus, tentaverit transmutare, ne videatur esse perpetuum, sed transactionibus aut venditionibus, aut quibusdam aliis machinationibus, ut quod perpetuum manere debebat terminetur, tentaverit, praeter vim a nobis nuper profectæ in bojas modi rebus divinae legis, nullam habere ullo modo licentiam hoc facere;
若有至可敬的財務管理人,或客旅之家的主管,或養病院、濟貧院、養老院、育嬰院、孤兒院的主管,或修院院長(archimandrites),或我們前一道神聖憲令所含的其他人,企圖將永久留給他們所主管的可敬之家之物——無論是黃金或其他物品——加以轉換,使其顯得不再永久,而是企圖藉交易或買賣、或某些其他詭計,使那本應永久存留之物歸於終結:他絕無任何權利以任何方式如此行,因這違背我們近來在此類事務上所頒布之神聖法律的效力;
that if any of the most reverend stewards, or of the wardens of hospices (xenodochi), or of infirmaries, or of feeders of the poor (ptochotrophi), or of keepers of the aged (gerontocomi), or of nurturers of infants (brephotrophi), or of keepers of orphans (orphanotrophi), or of archimandrites, or of the other persons comprised in our former divine constitution, should attempt to convert that which has been left in perpetuity to the venerable houses over which they preside — whether in gold or in other things — so that it should not appear to be perpetual, but should attempt by transactions or sales, or by certain other machinations, that what ought to remain perpetual be brought to an end: he shall have no licence whatsoever in any way to do this, contrary to the force of the divine law lately issued by us in matters of this kind;
90:5
sed et si fecerit, irritum esse quod factum fuerit; et licentiam esse ei qui post ipsum eamdem suscipiet curam, vel etiam eo negligente (ut fieri potest) caeteros deinceps omnes statim revocare id quod fuerit factum, et ita infirmum declarare, atquesi ab initio non processisset, ut et fructus metiti temporis, et usuras, et omnem utilitatem ad pium pertinere omnimodo locum, omnibus quae medio tempore attentata sun I quiescentibus. Homini etenim cuique cursus unus est vitæ ab opifice datus, cujus finis est omnino mors: venerabilibus vero domibus, et earum coetibus, indesinenter a Deo custoditis, non est neque secundum earum possessiones inducere aliquam metam:

but even if he should do it, what has been done shall be void; and it shall be lawful for him who shall undertake the same charge after him — or even, should he be negligent (as may happen), for all the rest thereafter — at once to revoke what has been done, and so to declare it invalid, as if it had not proceeded from the beginning; so that both the fruits of the intervening time, and the interest, and every benefit shall by all means pertain to the pious place, all things attempted in the meantime being annulled. For to every single human there is one course of life given by the Maker, whose end is altogether death; but for the venerable houses and their communities, unceasingly guarded by God, there is no setting of any limit even according to their possessions:
90:6
sed quousque utique permanserint venerabiles domus (manent autem in perpetuum, et usque ad bujus saeculi consummationem, quousque Christianorum nomen apud homines erit et coletur), aequum itidem est manere, et in perpetuum relictas erogationes aut reditus immortales semper piis actionibus nunquam cessaturis servituros. Eum igitur qui tale quid deliquerit, et transferre rem auro accepto, aut per aliam occasionem præsumpserit, damnum quidem nullum induci (secundum ea quæ prædicta sunt) his contra quas talia perpetrarunt domibus, sed illas quidem domos, et aurum, etrem lucrari, quam acceperunt;

but so long as the venerable houses shall endure (and they endure forever, even unto the consummation of this age, as long as the name of Christians shall be among men and shall be venerated), it is likewise just that the endowments and revenues left in perpetuity should remain, immortal, ever to serve pious works which shall never cease. Therefore, as for him who shall have offended in any such thing, and shall have presumed to transfer the property with gold received, or by some other occasion, no loss indeed shall be brought upon (according to what has been aforesaid) those houses against which they committed such things; but those houses shall gain both the gold and the property which they received;
90:7
et nihilominus relictum exigere absque ulla quacunque diminutione, tam ab ipso qui hoc egit, quam ab ejus haeredibus et successoribus, et illius res, et bona obligari ipsi qui cum eo contraxit; et ea ipse vindicet, tam contra illius personam quam bona ipsius, usque ad plenam et competentem ipsi indemnitatem, ne scilicet contra venerabilem domum, quam contra fas fraudavit, ullam speret datorum recuperationem, aut ejus, quod factum est, instaurationem: quod autem ad ipsum quocum contraxit attinet, omnem habeat a legibus licentiam regredi contra ipsum, et haeredes ejus, et res ejus, et quod datum est, si possit, exigere;
並且他們仍要毫無任何減損地索取那被留下之物,既向行此事之人,也向其繼承人與承繼者索取;而那人的財產與資產,應對與他締約之人負擔;讓那人得以追回,無論是針對對方的人身或其財產,直至他自己得到充分而適當的補償——即,使他不致期望從那可敬之家追回任何他所給之物(他乃違法詐騙了那家),亦不致期望恢復其所為之事。但至於與他締約之人的事,讓那人得依法享有一切權利,得以對其人身、其繼承人及其財產提起追訴,並儘可能索回所給之物;
and nonetheless they shall exact what was left, without any diminution whatsoever, both from the one who did this and from his heirs and successors; and that man's property and goods shall be bound to him who contracted with him; and let that man recover it, both against the person of the other and against his goods, up to full and adequate indemnity for himself — namely, so that he may not hope for any recovery of what he gave against the venerable house, which he defrauded contrary to right, nor any restoration of what was done. But as for the matter concerning him with whom he contracted, let him have every licence from the laws to proceed against him, and his heirs, and his property, and to exact what was given, if he can;
90:8
ut, si minus ob Dei metum, metu sahem propriae ipsorum substantiae, et suorum hæredum tardiores fiant ad hujusmodi pactiones; quas in confesso est eos nullius boni causa celebrare, sed vel pecuniis corruptos, vel affectionibus quibusdam superatos. Quae omnia per hanc divinam legem prohibentes et ipsam sacris nostris inscribi legibus sancimus, et offerimus ipsi Domino universorum Deo et Salvatori nostro Jesu Christo, pulchrum quoddam et conveniens ipsi sacrificium et ipsam adducentes. so that, if not for fear of God, at least for fear of their own substance and that of their heirs, men may become more reluctant toward agreements of this kind, which it is acknowledged they conclude for the sake of no good, but being either corrupted by money or overcome by certain affections. Forbidding all these things by this divine law, we ordain that the law itself be inscribed among our sacred laws, and we offer it to the Lord God of all and to our Saviour Jesus Christ, presenting it as a kind of beautiful and fitting sacrifice unto Him. Given on the day before the Ides of September, at Constantinople, in the fourth consulship of our lord Justinian, Perpetual Augustus, and that of the most distinguished Paulinus, in the year 534.
