67:1
Quod medicamenta morbis, hoc exhibent jura negotiis. Unde consequitur ut nonnunquam a judicio discordet effectus, et quod credebat conjectura prodesse, experimento inveniatur inutile. Probat igitnr hoc praesentis etiam necessitas sanctionis, in qua privilegium ex religioso proposito sacrosanctis ecclesiis Dei et monasteriis, aliisque religiosis locis, constitutione nostra nuper indultum, necessaria correctione distinguimus. Dudum si quidem jusseramus ad centum illis annos exceptionis propagari curricula, per eujus licentiam sanctionis negotia quidem multa commota sunt, et velut antiquorum vulnerum obductæ patuerunt iterum cicatrices.
藥物之於疾病,正如法律之於事務。由此可知,結果有時竟與當初的判斷相左,臆測以為有益之事,經驗卻顯為無益。此現行法令之必要性正可印證此理:在此法令中,我們藉一項必要的更正,限定了我們先前頒布的敕令出於虔誠之意而新近賜給神之至聖眾教會、隱修院及其他宗教場所的特權。從前我們確曾下令,將時效抗辯的期限為他們延展至一百年;藉此法令之寬縱,許多事務果然又被攪動,舊日傷口已癒合的疤痕彷彿又重新裂開。
What medicines are to diseases, this the laws supply to affairs. Whence it follows that sometimes the outcome is at variance with the judgment, and what conjecture believed would profit is by experience found useless. This indeed is proved also by the necessity of the present enactment, in which we mark out, by a necessary correction, the privilege lately granted by our constitution out of religious purpose to the most holy churches of God and to monasteries and to other religious places. For some time ago we had indeed commanded that the courses of the exception be extended for them to a hundred years; by the license of which enactment many affairs were indeed stirred up, and, as it were, the closed scars of ancient wounds lay open again.
67:2
Sed eorum sanitas provenire non potuit, probationum scilicet difficultatibus impedita, quoniam per tantum saeculi malis quam temporis spatium, nec documentis integritas, nec actis fides, nec ætas valet testibus suffragari. Verum quia largitati nostræ causarum non occurrit angustia, eum ratione simul ac religione tractantes praedictura privilegium usque ad possibilem modum deducere, experimento retraximus.
然而它們的痊癒終究不能達成,因受證據之艱難所阻;蓋因經歷如此漫長的歲月與惡事之久,文書既無從保全其完整,記錄亦無從取信,年代久遠更使證人之證言難以憑藉。然而,既然我們的慷慨並不因事由之狹隘而受阻,我們便兼以理智與虔誠來處置前述的特權,本乎經驗,將它收回,使之削減至一個可行的限度。
But their healing could not come about, hindered as it was by the difficulties of proofs, since over so great a span of time as of the ages of evils, neither does integrity avail with documents, nor faith with records, nor age with witnesses. But because no narrowness of causes stands in the way of our bounty, treating the aforesaid privilege at once with reason and with religion, we have, by experience, drawn it back so as to reduce it to a possible measure.
67:3
Et jubemus in negotiis que ante hae triginta annorum removebat exceptio, nunc venerabilibus ecolesiis, monasteriis, et xenodochiis, necnon orphanotrephiis, et brephotrophiis, et ptochiis quadraginta annorum protelatio conteratur, salva scilicet circa alias personas et causas virtute quam semper tricennalis sibi praescriptio vindicabat, quoniam hanc decem annorum adjectionem solis ( ut dictum est ) religiosis locis, eorumque juri, vel contractibus indulgemus, ut sopitae hoc temporis spatio tam personales quam hypothecariæ actiones in perpetuum conquiescant, nihil penitus aliis exceptionibus derogantes, sed tam in aliis quam triennio vim roburque tenentibus.
並且我們命定:凡從前由三十年時效抗辯所排除的事務,如今當為可敬的教會、隱修院、客旅之家(xenodochia),以及孤兒院、棄嬰院與濟貧院(ptochia),設立四十年的延展期——對於其他人與其他事由,三十年時效一向為自己所主張的效力仍予以保留;因為我們所增的這十年(如前所述)單單賜給宗教場所及其權利或契約,好使無論對人之訴或抵押之訴,在此期限內既已平息,便永遠止息;對其他抗辯則絲毫不予削減,而是使其效力與權能在其他事上一如在三十年期限中得以保持。
And we command that, in those affairs which heretofore the exception of thirty years removed, there now be set, for the venerable churches, monasteries, and hospices for strangers (xenodochia), as well as orphanages and foundling-homes and almshouses for the poor (ptochia), a prolongation of forty years—saving indeed, with regard to other persons and causes, the force which the thirty-year prescription always claimed for itself; since this addition of ten years we grant (as has been said) to religious places alone, and to their right or contracts, so that, lulled to rest within this span of time, both personal and hypothecary actions may forever come to rest; in nothing at all derogating from the other exceptions, but holding their force and strength in others just as in the thirty-year term.
67:4
In illis namque ( ut dictum eat ) tantum negotiis religiosos contractus memorato quadraginta annorum privilegio volumns perfrui, in quibus eis centum annerum praerogativam constitutio nostra contulerat. Si quae plane causas ante hanc nostram constitutionem ab ecclesiis cæterisque.aeris locis ubicunque commotas, judicialis sententia aut transactionum conventio terminavit, nolumus refricari, sed in reliqoum illis hanc objici sanctionem, quas antebac sopitas octo lustrorum silentio moveri hactenus aut motas terminari non contigit. Illustris igitur et magnifica auctoritas tua, quae per hanc generatem legem nostra statuit æternitas, edietis propositis ad omnium notitiam faciat pervenire. Dat.

For in those affairs only (as has been said) do we will that religious contracts should enjoy the aforesaid privilege of forty years, in which our constitution had conferred upon them the prerogative of a hundred years. If indeed any causes moved by the churches and the other religious places anywhere before this our constitution have been terminated by a judicial sentence or by the agreement of a settlement, we will not that they be raked up again, but that for the rest this enactment be set against those causes which, lulled to rest before now by the silence of eight lustra (forty years), it has not befallen to be moved up to now, or, having been moved, to be terminated. Therefore let your illustrious and magnificent authority cause to come to the knowledge of all, by edicts set forth, that which our eternity has established through this general law. Given.
