50:1
In nomine Domini Jesu Christi Dei nostri. Imperator Cæsar, Flavius, Justinianus, Alemannicus, Gothicus, Francicus, Germanicus, Lazicus, Alanicns, Vandalicus, Africanus, pius, felix, gloriosus, victor, triumphator, nunquam non colendus Augustus, Longino praefecto urbi. Quoniam potentiae nostræ, subditi nostri, sive vivant, sive moriantur, curae sunt, ne vel graves ipsis sepulturæ, vel defuncti cognatis damnosæ existant, propterea et haec qu:e eorum sepulturam concernunt, quo convenit moda, disposuimus.

In the name of the Lord Jesus Christ our God. The Emperor Caesar, Flavius, Justinianus, Alemannicus, Gothicus, Francicus, Germanicus, Lazicus, Alanicus, Vandalicus, Africanus, pious, fortunate, glorious, victor, triumpher, ever to be venerated Augustus, to Longinus prefect of the city. Since our subjects, whether they live or die, are a care to our power, lest their burials be either grievous to themselves or ruinous to the kinsmen of the deceased, on that account we have disposed in fitting manner also these things which concern their burial.
50:2
Et quia tam divae memoriae Constantinus amplæ hujus nostrae urbis conditor quam etiam pientissimus princeps Anastasius lecticariorum seu decanorum (ut vocant) numerum ad certam mensuram redegerunt, mille et centum tantummodo decanis totidemque officinis definitis, ut nullo hae unquam tempore augmentum reciperent; propterea sane cupientes ut numerus eorum quos ex unoquoque collegio convenit esse lecticarios, divæ memoriae Anastasii formulae subjaceat, firma ea et fixa manere voluimus. Caeterum quia adeuntes nos almæ hujus et regiae nostræ urbis collegiati, quorum excellenter et prae caeteris curam gerimus, potentiam nostram edocuerunt, magnam et intolerandam se necessitatem sustinere.

And since both Constantine of divine memory, the founder of this our ample city, and likewise the most pious prince Anastasius, reduced the number of the litter-bearers, or deacons (as they call them), to a fixed measure—only one thousand and one hundred deacons and as many workshops being defined, so that these should at no time ever receive increase—therefore, indeed, desiring that the number of those who ought to be litter-bearers from each guild should be subject to the rule of Anastasius of divine memory, we have willed it to remain firm and fixed. But since the guild-members of this gracious and royal city of ours—for whom we exercise care eminently and above the rest—coming to us, have informed our power that they sustain a great and intolerable necessity.
50:3
Sacrosanctam etenim majorem ecclesiam centum et mille officinas in fructu habere ab omni vectigali liberas, quas oppido quam libenter illi concedant, eo quod ad peragendas in commune omnium hominum exsequias proficiant; sed caetera se onera ferre non posse.

For the most holy greater church holds one hundred and one thousand workshops in usufruct, free from every tax, which they very gladly concede to it, because they serve toward the performing in common of the funeral rites of all men; but the other burdens they say they cannot bear.
50:4
Nam cum plurimæ in alma hac urbe diversarum mercium et negotiationum orficinæ tabernaeque existant, non hasce solas (nempe centum et mille) officinas praedictis publicis muniis obeundis exemptas esse, sed etiam multas sacrosanclas ecclesias, multa sacra hospitalia, monasteria, et alias sacras aedes, quarum pleraeque prius hæreticis mancipatae, deinde ad orthodoxam fidem reversæ sunt, multas quoque regias domus, et insuper magistratuum, ac senatorum, et illustrium, et cubiculario.

For although there exist in this gracious city very many workshops and shops of diverse merchandise and trades, not these alone (namely the one thousand and one hundred) workshops are exempted from undertaking the aforesaid public services, but also many most holy churches, many sacred hospices, monasteries, and other sacred buildings—most of which were formerly bound over to heretics, and then returned to the orthodox faith—and many royal houses besides, and moreover those of magistrates, and senators, and illustrious men, and chamberlains
50:5

are exempted from the rendering of taxes, and their owners thereby procure for themselves a peculiar revenue, and harm the commonwealth, the multitude of exemptions confining the matter itself within exceedingly narrow bounds, so that very few remain who acknowledge and sustain the public services, and the former contributions, sometimes increased threefold and fourfold, have at this time even become tenfold greater: although the divine prince Anastasius, in the rule established by him, granted immunity to no other at all, except the one thousand and one hundred workshops, which on account of the funeral rites were attributed to the most holy greater church.
50:6
Ea propter et nos putavimus, tum proceribus nostris et insuper beatissimo hujus almae urbis arcbiepiscopo id negotii dandum, ut certo loco convenirent et rem ipsam examinarent, atque placita ad nos sua referrent, tum ad excellentiam tuam praesenti utendum lege, confirmantes ea quae Anastasio pientissimo in hoc principi placuerunt. Et sancimus ut centum quidem illx et mille officinæ sacrosanctæ majori ecclesiae occasione decanorum sive lecticariorum, et ad peragendas defunctorum exsequias deputatae, omnibus modis integro numero et omni præstatione liberae conserventur: praeter ipsam nulla alia queunte decanum erigere, sive ex hæreticis recepta, sive quacunque sacrosancta ecclesia.

For this reason we too have judged that the business should be entrusted both to our nobles and, in addition, to the most blessed archbishop of this fostering city, so that they might assemble at a fixed place, examine the matter itself, and report their decisions to us; and that meanwhile your Excellency should employ the present law, confirming those things which were approved by the most pious prince Anastasius in this matter. And we ordain that the eleven hundred workshops belonging to the most sacred Great Church, on account of the deans or bier-bearers and those appointed to perform the funeral rites of the dead, be in every way preserved free, with their full number and every exemption; and that no other body whatsoever, whether received from among the heretics or any most sacred church, be permitted to appoint a dean besides it.
50:7
Sed quod nuper constituimus valeat, et octogintae quidem officinæ corpora præstent, trecentae autem in exactione pecuniarum consistant. Nam quod exinde corraditur, ad quid proficere conveniat, sacra jam nostra pragmatica forma disposuit. Semperque quod intercidit restauretur. At qua ratione fieri debeat restauratio, satis per Anastasii piae memoriae jussiones expressum est. Has igitur ut immunes et ab omni vectigali maneant exemptæ, sancimus, neque his ipsis officinis, neque vectigalia imperantibus collegiis quae istas præbent, quidquam damni sustinentibus aut ullos titulos agnoscentibus.

But let what we have lately decreed hold good: that eighty workshops supply the personnel, while three hundred remain liable to the exaction of moneys. For our sacred pragmatic sanction has already laid down to what use the proceeds gathered thence ought to be applied; and that whatever falls into ruin be ever restored. By what method the restoration ought to be carried out has been sufficiently expressed through the ordinances of Anastasius of pious memory. These therefore we ordain to remain immune and exempt from every tax, so that neither these very workshops, nor the corporations which provide them and which are charged with the taxes, suffer any loss or be subject to any imposts.
50:8
Caeterae vero omnes hujus almae urbis quatuordecim regionum officinæ, sive sacrosanctae alicujus sint ecclesiae, sive hospitalium, sive monasteriorum, sive orphanotrophiorum, sive ptochiorum, sive alterius cujuscunque dominii, sive regiarum domuum, sive aliquorum magistratuum, ampla, media, minutave officia administrantium, sive gloriosissimorum senatorum, sive magnificentissimorum illustrium, sive spectabilium cubiculariorum, sive aliquorum militiis adscriptorum;
但這座養育之城十四區的其餘一切作坊,無論是屬於某至聖教會的,或是屬於醫院、修道院、孤兒院、濟貧院的,或是屬於任何其他主權的,或是屬於皇室宅邸的,或是屬於某些掌理大、中、小職務之長官的,或是屬於至榮顯的元老們、至宏偉的顯貴們、可敬的內侍們的,或是屬於某些被列入軍役者的;
But all the other workshops of the fourteen regions of this fostering city, whether they belong to some most sacred church, or to hospitals, or to monasteries, or to orphanages, or to poorhouses, or to any other lordship whatsoever, or to imperial households, or to certain magistrates administering offices great, middling, or small, or to most glorious senators, or to most magnificent illustrious men, or to honourable chamberlains, or to certain men enrolled in the military services;

hae, inquam, omnes publica ipsis imposita praestent vectigalia, et omnia alia tum faciant, tum impleant, quemadmodum quemque in suo collegio facere æquum est, nemine queunte ea de causa iuniti privilegiis, aut ejusmodi alia uti excusatione. Neque enim sustinemus aliorum onus ad alios deferri, aut tam immitem proponere formulam, ut quotidie vectigalia augeantur, et (quemadmodum edocti sumus) quadruplo, aut quincuplo, adeoque etiam decuplo majora irrogentur, cum nihil tam magno studio, tamque serio affectemus, quam ne novo quisquam vectigali oneretur. Novum autem fuerit non tantum quod nunc primum impositum est, sed etiam quod primum modum excedit.

these, I say, shall all pay the public taxes imposed upon them, and shall both perform and discharge everything else, just as it is fitting for each to do in his own corporation, no one being able on that account to be aided by privileges, or to make use of any such excuse. For we will not endure that the burden of some be transferred to others, or to propose so harsh a formula that the taxes be daily increased and (as we have been informed) imposed fourfold, or fivefold, or even tenfold greater, since we strive after nothing with such great zeal and such earnestness as that no one be burdened with a new tax. And a tax will be 'new' not only when it is now first imposed, but also when it first exceeds the established measure.
50:10
Sed eadem conditione ac fortuna omnes sunto, et sacra hæc nostra pragmatica forma (quam legem etiam appellare Iicuerit) contra omnes communis esto, ut omnibus largiatur, quo molestia vacent. Neque enim facile eam quis aegre tulerit, si neminem alium praeterea exemptum intueatur, nisi quod in centum et mille officinis exsequiarum defunctorum ratio habeatur, quæ maxime communis est omnibus, et ex æquo universis pariata hominibus.
但要使眾人都處於同一境況與命運之下,並使我們這神聖的詔令性敕法(也可稱之為法律)對眾人一律通行,好叫它賜給眾人免受騷擾的自由。因為人若見除自己之外並無別人得享豁免——惟有那一千一百間作坊乃因顧及亡者的喪禮之故,而那喪禮是眾人最共有的,是眾人平等共享的——他就不至於輕易心生不滿了。
But let all be of the same condition and lot, and let this our sacred pragmatic sanction (which it may also be permitted to call a law) be common against all, so that it may bestow upon all freedom from molestation. For no one will easily take it ill, if he sees no other besides exempted, except that in the eleven hundred workshops account is taken of the funeral rites of the dead, which is most common to all, and shared equally among all men alike.
50:11
Si quis vero conetur excusatione aliqua uti, et seipsum a praestanda alleviare contributione, et aut non committere, quo magis ab inquilinis suis exigatur, aut praestare etiam patrocinium, sive militare, sive civile, sive ecclesiasticum, sive quodcunque tandem in universum officinae dominio excidito, estoque ipsis publica, toti addicta collegio. Eo enim pacto et cautiores erunt, et vetita non attentabunt. Porro si minutatim et pariter in omnes vectigalia distribuantur, non solum paululum erit, quod præstitum fuerit, sed etiam tanto moderatius, levius, tolerabilius, faciliusve, quod confertur existet, quanto a pluribus colligitur.
但若有人企圖使用某種藉口,使自己免於繳納份額,或不去確保更多地向其租戶徵收,或甚至給予庇護——無論是軍事的、民事的、教會的,或任何種類的——就讓他喪失對那作坊的全部所有權,使其歸為公有,完全劃歸行會。因為藉此安排,眾人既會更加謹慎,也不會去嘗試被禁止的事。再者,賦稅若一點一點地、平均地分攤於眾人,那麼所繳的不僅微小,而且所納的也愈發顯得溫和、輕省、可堪承受、容易擔負,正與它由更多人共同分擔成正比。
But if anyone attempts to use some excuse, and to relieve himself from making his contribution, and either to fail to ensure that it be the more exacted from his tenants, or even to afford patronage, whether military, civil, or ecclesiastical, or of whatever kind at all—let him forfeit the entire lordship of the workshop, and let it become public property, wholly assigned to the corporation. For by this arrangement men will be both more cautious and will not attempt forbidden things. Moreover, if the taxes be distributed bit by bit and equally upon all, not only will that which is rendered be little, but also that which is contributed will prove the more moderate, lighter, more tolerable, and easier, in proportion as it is collected from a greater number.
50:12
An vero non multo absurdissimum fuerit, homines propriis laborantes manibus, et uxores ac liberos alentes, et reliqua denique vim necessaria inde acquirere satagentes, etiamnum majoribus onerare vectigalibus? et quanto plures inter alleviatas referuntur, tanto etiam majores ex inde læsiones oboriri? idque infinitum sit, neque possit ullum habere terminum ? Hæc nos omnia probibentes, sacram hanc pragmaticam formam proponimus, amissionis pœnam similiter omnibus ordine subditis interminantes, si ex quoquo collegio imperitantes solita illa et ab initio statuta vecligalia percipere prohibuerint, aut vectigalia conentur in pensiones privatas convertere;
豈不真是極其荒謬麼——叫那些用自己雙手勞苦、養活妻兒、總之竭力從中謀取生活所需之物的人,如今竟還被加上更重的賦稅?並且他們愈被列在蒙減免者之中,就愈因此招致更大的損害?而這事竟漫無止境,無從終結?我們禁止這一切,頒佈這神聖的詔令性敕法,向一切隸屬此等級的人一律以沒收之刑相警誡:若有任何行會中當權者禁止那自始所定的慣常賦稅被收取,或企圖將賦稅轉為私人租金;
Would it not indeed be utterly absurd that men who labour with their own hands, and who feed wives and children, and who in short strive to acquire from that source the things needful for life, should even now be burdened with greater taxes? And that the more they are counted among those relieved, so much the greater injuries should arise to them therefrom? And that this should be boundless, and able to have no end? Forbidding all these things, we set forth this sacred pragmatic sanction, threatening alike with the penalty of forfeiture all subjects of the rank, if from any corporation those in authority should prohibit the customary taxes established from the beginning from being received, or should attempt to convert the taxes into private rents;
50:13
sed quisque pro se quidem pensionum illatione perfruitor, officinas autem seu tabernas solito receptoque more contributiones agnoscere concedito. Quemadmodum enim quisque pro se rebus suis prospicit, ita et non necesse est ei quod amplae et regiae huic urbi expedit et confert nutanti quodammodo et jam lapsuro manus porrigere. Neque enim aliter quae publice expediunt progressus habitura sint. Nemo itaque ex his qui tali hactenus onere liberati, quique huc usque id ferre coacti sunt.
但要使各人為自己享有收取租金之利,同時容讓作坊或店鋪按慣常通行的方式承認應繳的份額。因為正如各人為自己照顧自己的事務,照樣他也不該推辭去援手那於這宏大皇城有益有利之事——當這城彷彿搖搖欲墜、行將傾覆之時。因為若非如此,凡於公眾有益之事就無從進展。所以,凡迄今免於這重擔的人,與凡迄今被迫擔負它的人,誰都不可如此行。
but let each enjoy for himself the bringing in of the rents, while permitting the workshops or taverns to acknowledge the contributions according to the customary and accepted manner. For just as each provides for his own affairs on his own behalf, so neither is it unnecessary for him to lend a hand to that which is expedient and profitable for this ample and royal city, when it is, as it were, tottering and now about to fall. For not otherwise will the things that are publicly expedient have their advance. Let no one therefore of those who have hitherto been freed from such a burden, and who have hitherto been compelled to bear it.
50:14
Quae igitur nobis placuerunt, et sacra hac exprimuntur lege, ea excellentia tua, imo non ipsa tantum custodies, sed et quicunque post te idem officium suscepLuri sunt, et obtemperans tibi cohors, jam inde in omne reliquum tempus custodiet. 因此,凡蒙我們所喜悅、並在這神聖法律中所表明的事,閣下要加以遵守——不僅閣下自己,凡在你之後承擔同一職分的人,以及順服你的僚屬,都要從今時起、在此後一切時間中加以遵守。頒於君士坦丁堡,六月朔前第十六日,至顯赫者貝利撒留執政之後第一年。
Those things therefore which have pleased us and are expressed in this sacred law, your Excellency—nay, not only you yourself shall guard, but also whoever after you shall undertake the same office, and the staff obedient to you, shall from now and for all the remaining time guard them. Given on the sixteenth day before the Kalends of June at Constantinople, in the first year after the consulship of Belisarius, most distinguished man.
