47:1
Idem Augustus Mennæ sanctissimo et beatissimo archiepiscopo Constantinopolitano, universique ejus tractus patriarchæ. Non insolitam imperatoriæ majestati rem agentes, ad præsentem legem pervenimus. Quotiescunque enim sacerdotum sententiæ aliquos qui sacerdotio indigni essent sacerdotalibus deturbarunt sedibus (quale sit, Nestorium, Eutychetem, Arium, Macedoninm, Ennomium, et alios non inferiore quam illi malitia), toties etiam ad sacerdotum auctoritatem imperatoris consensus accessit, ut divina cum humanis coenntia, rectis sententiis symphoniam quamdam et unam consonantiam inducerent.

The same Augustus, to Mennas, most holy and most blessed archbishop of Constantinople and patriarch of all his region. In carrying out a matter not unusual for the imperial majesty, we have come to the present law. For as often as the verdicts of the bishops have cast down from their priestly seats certain men unworthy of the priesthood (such as Nestorius, Eutyches, Arius, Macedonius, Eunomius, and others of malice no less than theirs), so often also has the emperor's consent been added to the authority of the bishops, so that things divine joined together with things human might, by their right verdicts, bring about a certain symphony and a single harmony.
47:2
Simile quiddam nuper circa Anthimum evenisse scimus, tam ab Alapeto religiosæ et celebrandae memoriae, præsule sacrosanctæ in vetere Roma ecclesiæ constituto, e sede hujus regiæ urbis depulsum, ut qui in sedem neque ulla sibi ratione competentem, et præter omnes canones insiliisset, quam communi sententia;

We know that something similar lately befell Anthimus, who was driven from the see of this royal city by Agapetus of religious and renowned memory, the prelate set over the most holy Church in old Rome; for he had leapt into a see in no way rightly belonging to him and against all the canons, and so by a common verdict
47:3
ejusque viri sanctae memoriæ multis nominibus exosculari videretur (id quod variis postmodum commentis refugit), simulans quidem sancta se quatuor concilia sequi, nempe trecentorum decem et octo sanctorum Patrum Niceae, centum et quinquaginta in hac alma urbe, ducentorum praeterea Ephesi primum congregatorum, neque non Dei amantissimorum sexcentorum et triginta Patrum Chalcedoni, non vero re ipsa illorum dogmata consequens, neque nostram benigoitatem et submis.ionem, quam pro ejus salute suscepimus, amplecti, neque renuntiare tam impiorum dogmatum auctoribus a sanctis Patribus in synodis rejectis volens, sed ratus in unum et eumdem auctoritatis gradum utrosque tam condemnatos quam qui condemnarint, collocandos.

and though he seemed to honor that man of holy memory with many titles (which afterward by various contrivances he repudiated), pretending indeed that he followed the four holy councils—namely of the three hundred and eighteen holy Fathers at Nicaea, of the one hundred and fifty in this gracious city, of the two hundred first gathered at Ephesus, and likewise of the six hundred and thirty Fathers most beloved of God at Chalcedon—yet not in fact following their teachings, and unwilling either to embrace our kindness and the indulgence we extended for his salvation, or to renounce the authors of such impious doctrines who had been rejected by the holy Fathers in the synods, but holding that both the condemned and those who had condemned them should be placed in one and the same rank of authority.
47:4
Semel enim peregrinis a sacrosancta Ecclesia cogitationibus mancipatus, et a rectis dogmatibus alienus factus, merito ad eorum rectitudinem regredi non valuit, quanquam a nobis quoque diligenter et summo studio ad ejus salutem contendentibus, commonstrata via, admonitus. Propter omnia haec igitur, quae cum ipso gesta sunt, et depositionis a gradu ecclesiastico sententiam a sancta synodo tam per causam itlicitae neque per sacros canones approbatæ in sacerdotales.,,jus regiæ urbis sedes irreptionis, quam a rectis et voris dogmatibus diversionis prolatam, rtam nostra facit inducat.

For once he had been enslaved to thoughts foreign to the most holy Church, and made a stranger to right doctrines, he was deservedly unable to return to their rectitude, even though admonished by us also, who diligently and with the utmost zeal strove for his salvation and pointed out to him the way. On account of all these things therefore which were done in his case, our authority confirms also the sentence of deposition from his ecclesiastical rank pronounced by the holy synod—both for the cause of the unlawful intrusion, neither approved by the sacred canons, into the priestly see of this royal city, and for his turning aside from the right and true doctrines.
47:5
Enimvero neque sententiam juste contra Severum promulgatam, et ex omnibus archiepiscopalibus et patriarchalibus se.libus una cum prudentia monachali procedentem, exortem confirmationis regiæ efficimus, qui prius sacrosanctæ Theopolitanorum Ecclesiæ sede contra sacros ritus occupata ita omnia conturbavit, ita conturbata transmutavit, ut generale quoddam et absque fecialium interventu susceptum sacrosanctis inter se ecclesiis bellum ferre videatur.

Indeed, neither do we leave without imperial confirmation the sentence justly promulgated against Severus, which proceeded from all the archiepiscopal and patriarchal sees together with the prudence of the monks—Severus, who having first against the sacred rites seized the see of the most holy Church of the Theopolitans, so threw all into confusion, and so transformed what he had confused, that he seemed to wage a kind of general war among the most holy churches, undertaken without the intervention of heralds.
47:6
Atque hoc etiam ab his qui ante nos sceptra imperii tenuerunt, ad ipsum scriptum esse tam variis atque recto alienis dogmatum fraudibus ac blasphemiis utentem, quam omnia jam nunc perturbata reddentem, et de errore solum utriusque hæresiarchae (Nestorii scilicet et Eutychetis) haustis abominandis et cum religione pugnantibus dogmatibus innitentem, et utriusque horum perversissimorum ducum, qui tametsi nonnihil inter se dissidere videantur, ad unum tamen impietatis finem tendunt notorias disputationes effingentem.

And this too had been written against him by those who held the scepters of empire before us: that he employed deceits, blasphemies, and doctrines so manifold and so foreign to rectitude, throwing everything by now into utter confusion, and resting upon the error of both heresiarchs alone (namely Nestorius and Eutyches), having drawn from them their abominable doctrines that war against religion, and inventing notorious disputations of both these most perverse leaders—who, although they seem to differ somewhat among themselves, yet tend toward one single end of impiety.
47:7
Nam cum duo inter se contraria sint dogmata, tam Nestorii, quam Eutychetis (ut diximus) quorum utrumque ex æquo mortem animæ importat, quæ ex ipsis Arianorum et Apollinaris impiamentis constant, mirabiliter tamen et praeter opinionem ipse affectus, similiter in utrumque incidit, et nunc huic, nunc illi primas partes deferens, commune se suosque sermones tantorum piaculorum receptaculum constituisse videtur.

For although the doctrines of Nestorius and of Eutyches (as we have said) are two contraries to each other, each of which equally brings death to the soul, since they are composed of the very impieties of the Arians and of Apollinaris, yet—marvelously and beyond expectation—he, being so disposed, fell alike into both, now granting the chief place to the one, now to the other, and so appears to have made himself and his discourses a common receptacle of so great crimes.
47:8
Esto igitur et ipse praedicto anathemati obnoxius, quod universus patriarchalis, sacerdotalis et mona,chalis reipublicæ nostræ (ut ita dicamus) ordo juste ei induxit, ex Theopolitanorum Ecclesia ejectus, propterea quod et illius urbis sedes eum repulerit, quasi qni ne initio quidem rite ipsam occuparit, vivente niMirum adhuc et in sacrosanctis ecclesiis hinc inde sacras conciones habente eo qui ante ipsum sacerdotio functus est: et nunc a successore suo sacerdotio exclusus sit; neque intra hosce tantum terminos re-.

Let him therefore also be subject to the aforesaid anathema, which the whole patriarchal, priestly, and monastic order of our commonwealth (so to speak) has justly imposed upon him—cast out of the Church of the Theopolitans, because the see of that city too has repelled him, as one who from the very beginning did not duly occupy it, since indeed he who had exercised the priesthood before him was still living and was holding sacred assemblies here and there in the most holy churches; and now he has been excluded from the priesthood by his own successor. Nor did he stop within these bounds alone,
47:9
stiterit, sed jam etiam sub generale anathema orthodoxæ, et catholicæ Ecclesiæ rejectus sit, et multis fer ledicis et prohibitis libris rempublicam nobis referseritUnde in universum omnibus interdicimus ne qu id librorum ejus comparent. Et quemadmodum Nestorii libros describere aut comparare non licet propterea quod ante nos imperatoribus in suis con stitutionibus videantur Porphyrii scriptis contra Chrisiianos editis similes existere, ita neque Severi dicta scriptave apud quemquam Christianorum manent., sed profana,unio, et a catholica Ecclesia ' aliena, ignique comburunt., a possessoribus, nisi illis retinendis in periculum adduci velint.

but he has also already been rejected under the general anathema of the orthodox and catholic Church, and has crammed our commonwealth with many slanderous and forbidden books. Wherefore we forbid all men universally to procure any of his books. And just as it is not lawful to copy or procure the books of Nestorius—because to emperors before us, in their constitutions, they appeared to be like the writings of Porphyry published against the Christians—so neither may the sayings or writings of Severus remain with any Christian, but as profane and alien from the catholic Church let them be burned with fire by their possessors, unless they wish to be brought into danger by retaining them.
47:10
Præterea a nemine in posterum conscribuntor, sive librarius aliquis, sive notarius, sive quisquam alius sit: sciens quod illius dicta conscribentibus abscissio manus in paenam irrogabitur. Nolumus etenim ut illorum blasphemia ad alia prorepat saecula. Consimiliter et illi hujus regiæ urbis, ejusque confiniorum, et alicuius insignioris civitatis ingressu interdicimus; sed ut in solo aliquo loco et silentio deside,., neque altos corrumpat, neque ad proferendas blasphemias eos inducat, neque contra vera dogmata novi aliquid inveniat, per quod denuo nobis sacrosanctas perturbare studeat Ecclesias.
此外,從今以後,無論是書商、公證人,或任何其他人,都不得抄寫這些書,並要知道:凡抄寫他言論的人,必被處以斷手之刑。因為我們不願他們的褻瀆蔓延到後世。同樣,我們也禁止他進入這座王城及其轄境,並任何較顯要的城市;而要他在某一處地方靜默閒居,既不敗壞他人,也不引他們發出褻瀆,也不發明任何違背真實教義的新說,藉以重新攪擾我們的至聖教會。
Moreover, henceforth let them be copied by no one, whether some bookseller, or notary, or whoever else he may be, knowing that the cutting off of the hand shall be inflicted as a penalty upon those who copy his sayings. For we do not will that their blasphemy should creep on into other ages. In like manner we forbid him also entry into this royal city and its confines and any more distinguished city; but let him sit idle in some single place and in silence, neither corrupting others, nor leading them on to utter blasphemies, nor inventing anything new against the true doctrines, whereby he might again strive to throw our most holy churches into confusion.
47:11
Sed neque Petrum, qui Apameae episcopus fuit, remotum a gradu ecclesiastico, et iisdem de causis, quamobrem Severus, anathemate (ut vocant) percussum, majestas imperatoria admittit. Sed rata sunto ctiam quae adversus ipsum decreta sunt; et quemadmodum sub generale anathema redactus est, ita et redactus esto, sententia quae de his ipsis a sanctissimis summis pontificibus processit rata permanente. Ac neque illi permittimus ut hanc regiam urbem, ejusve confinia, aut præstantiorem aliquam civitatem incolat, sed quorum secutus est errorem, horum imitetur etiam in degendavita rationem, quam longissima ab hominum consuetudine remotus, seque ipsum latebris occultans.

But neither does the imperial majesty admit Peter, who was bishop of Apamea, removed from his ecclesiastical rank, and for the same causes as Severus, smitten (as they call it) with anathema. Rather, let what has been decreed against him stand valid; and as he has been brought under the general anathema, so let him remain brought under it, the sentence which proceeded concerning these very men from the most holy supreme pontiffs remaining valid. And we do not permit him to dwell in this royal city, or its confines, or any more eminent city, but let him imitate, in his manner of passing life, the rule of those whose error he followed, removing himself as far as possible from human society, and hiding himself in concealment.
47:12
Siquidem multo præstabilius est hoc genus bominum latitare, quam in publica luce et ante omnium oculos versari. Nam si Intitent, sibi ipsis tantummodo erunt incommodi; si vero dogmata sua publicent, et vulgo proferant, mullis simplicioribus occasionem præbent ad interitum. Quod quidem ut aliquo modo in Christiano Dei ovili et pio recteque sentiente populo eveniat, neque justum est, neque a majestate imperatoria concedendum. Quia vero et Zooram religiose simul et juste judicantes episcopi dignum putaverunt quem omnino sub anathema redigerent;
因為這類人隱匿不出,遠比在公開的光中、在眾人眼前出沒要好得多。因為他們若緘默,便只損及自身;但他們若公佈自己的教義、向民眾宣揚,就給許多較單純的人帶來敗亡的機會。而這事若以任何方式在神的基督徒羊圈中、在虔誠正確思想的子民中發生,既不公正,也不應由皇帝的威嚴所許可。又因為那些既敬虔又公正判斷的主教們,認為佐拉斯也全然配受咒詛;
For it is far better that this sort of men lie hidden than that they move about in public light and before the eyes of all. For if they keep silent, they will be harmful only to themselves; but if they publish their doctrines and put them forth to the common people, they afford to many of the simpler folk an occasion of ruin. And that this should in any way come to pass in the Christian sheepfold of God and among a pious and rightly-thinking people is neither just, nor to be conceded by the imperial majesty. And since the bishops, judging both religiously and justly, deemed Zooras also worthy to be brought wholly under anathema;
47:13
ut qui veluti breve quoddam additamentum esset ejusmodi malorum, ad quae peragenda promptissimus fuit, et magnam facultatem habuit, ne omnino memoriam illi adimamus, quod aliqua in re facultate præditus fuerit: esto sane Zooras etiam particulae hujus (de Anthimo, Severo et Petro loquimur) leve quoddam additamentum, et inter eos qui anathemate notati sunt, ex sacerdotali contra ipsum prolata sententia ipse quoque collocator, quam tametsi per se satis valentem, multo tamen adhuc valentiorem reddit majestas imperatoria, quæ regia hac urbe ipsum expellit, ejusque confiniis et urbium incolatu omnifariam ei interdicit:

as being a kind of brief appendage of evils of this sort, to the perpetrating of which he was most ready and had great capacity—lest we wholly deprive him of the memory that he was endowed with some capacity in the matter—let Zooras indeed be a certain light appendage of this party (we speak of Anthimus, Severus, and Peter), and let him too be reckoned among those branded with anathema, being himself also placed there by the priestly sentence pronounced against him; which sentence, though sufficiently strong of itself, the imperial majesty renders yet much stronger, expelling him from this royal city and in every way forbidding him the confines and the inhabiting of cities:
47:14
ut cum solis illis quos ante recensuimus, ad eumdem modum blasphemantibus, ad eumdem quoque modum relegatis, habilet captetque consilia. Si quid præterca aliud quoque sanctissimorum episcoporum scntentia, quæ praedictos a gradu detrahit ecclesiaslico, et anathemate percellit, continetur, pro rato
使他只與我們上面所列舉的那些人同住、共議;那些人以同樣的方式褻瀆,也以同樣的方式被放逐。倘若至聖眾主教的判決——那剝奪前述之人教會品級、並以咒詛擊打他們的判決——中還含有其他任何內容,我們也視之為有效。
so that he may dwell and take counsel only with those whom we have enumerated above, who blaspheme in the same manner and are banished in the same manner. And if anything else besides is contained in the sentence of the most holy bishops, which strips the aforesaid men of their ecclesiastical rank and strikes them with anathema, we hold it for valid.
