Imperator Justinianus Augustus Mennae archiepiscopo regiae civitatis Constantinopolitano. Et priscis sancitum est legibus nulli penitus esse Iicentiam domi quæ sacratissima sunt agere, sed publicesinere procedereincredulitatem etDeiculturam secundum sanctionem de his sacratis actibus traditam; et nos etiam hanc in præsenti ponimus legem, quam cum omni cautela tenere volumus. Omnibus enim interdicimus magnae hujus civitatis habitatoribus, magis autem etiam totius nostrae ditionis, in domibus suis hahere quasdam quasi orationum domos, et in his sacra celebrare mysteria, et hinc fieri quaedam catholicæ et apostolicæ traditioni extranea.

The Emperor Justinian Augustus to Mennas, archbishop of the royal city of Constantinople. It was sanctioned even by ancient laws that there be utterly no license to anyone to perform at home the things that are most sacred, but to let belief and the worship of God proceed in public, according to the ordinance handed down concerning these sacred acts; and we too in the present set forth this law, which with all caution we wish to be kept. For we forbid all the inhabitants of this great city—nay, rather of our whole dominion—to have in their houses certain so-called houses of prayer, and to celebrate the sacred mysteries in these, and from thence for certain things foreign to the catholic and apostolic tradition to be done.

Sed si quidem domos ita simpliciter aliqui bahere putaat oportere in sacris suis, orationis videlicet solius gratia, et nullo celebrando penitus horum, quae sacri eunt mysterii, hoc eis permittimus. Invidia enim nulla est, si volunt citra haec habere habitacula quaedam, et in eis tanquam in sacris orare, aliis autem omnibus abstinere. Nisi tamen in cis voluerint aliquos invitare clericos, hic quidem sanctissimae majoris ecclesiae et sub ea sanctissimarum domuum, voluntate ac probatione sanctissimi archiepiscopi ad hoc deputatos, in provincia vero Deo amabililum episcoporum.

But if indeed some think they ought to have houses thus simply for their sacred uses, for the sake, that is, of prayer alone, and with nothing at all of those things which are of the sacred mystery being celebrated, this we permit them. For there is no ill-will, if they wish, apart from these, to have certain dwellings, and in them to pray as in sacred places, but to abstain from all the rest. Unless however they should wish to invite into them certain clerics—here indeed of the most holy Great Church and of the most holy houses under it, deputed to this by the will and approval of the most holy archbishop; but in the province, of the bishops beloved of God.
55:3
Nulla novitate sedi ejus beatitudinis ex praesenti nostra lege facienda, circa existentia ei quolibet modo in ordinationibus, aut gubernationibus hic, aut in provinciis jura, sed omnibus etiam coinpetentibus ei quolibet modo et tempore ralis nunc ct in omne reliquum tempus servandis: sancimus tuam hæc conservare gloriam, et manifesta omnibus per litteras proprias constituere, quatenus per omnia valeat lex. Haec enim et gloriosissimo præfecto felicis hujus urbis, ct sanctissimo archiepiscopo, et universali patriarchæ præcipimus, ut ex civili et sacerdolali virtute haec perpetue custodiantur.
我們現行的法律對閣下之座座(總主教座)並不造成任何新更動,無論是關乎此城或各省、以任何方式存於它的任命權或治理權;凡以任何方式、在任何時候歸屬於它的一切權利,無論如今或在此後一切時間,都要為它保守有效:我們規定,閣下要保守這些事,並藉自己的書信向眾人加以宣明,使法律得以在凡事上有效。因為這些事,我們既吩咐這至福之城至榮顯的長官,也吩咐至聖的總主教兼普世宗主教,使這些事憑藉民事與祭司的德能得以永遠看守。
No novelty being made to the see of his Beatitude by our present law, concerning the rights existing for it in any way whatsoever in ordinations or governances here or in the provinces; but with all things in any way and at any time pertaining to it being preserved for it valid both now and for all the remaining time: we ordain that your Glory preserve these things, and establish them manifest to all by its own letters, so that through all things the law may hold good. For these things we enjoin both upon the most glorious prefect of this happy city, and upon the most holy archbishop and universal patriarch, that out of civil and priestly virtue these things may be guarded perpetually.
55:4
Sciant cnim et ipsi domuum domini, quia si non haec custodierint, ipsi quidem sub imperiali fient motu, domnis autem in quibus aliquid tale agitur, et publicæ fient, et sub sacratissimum nostrum ærarium deducentur. Si autem et aliquos contingit tale aliquid in suis habere domibus sciant quod nisi intra tres menses, ex quo haec lex insinuata fuerit, hæc correxerint, et ad figuram a nobis ordinatam deduxerint, sub prædicta poena fient. Haec autem agi cum veritate, non per aliquam calumniam volumus, veraciom enim solummodo sumus amatores. Haec sancimus tuam cuslodire celsitudinem, et nibil tale fieri concedere.
因為這些房舍的主人也當自知:他們若不看守這些事,他們自己固要遭皇室的不悅,而那行此類事的房舍既要被充公,又要被收歸我們至聖的國庫。但若也有人碰巧在自己家中有任何這類事,就讓他們知道:自這條法律頒佈之時起,除非在三個月內改正這些事,並使其歸於我們所定的形制,他們就要受上述的刑罰。我們願這些事憑真理進行,不藉任何誣告;因我們惟獨是誠實人的愛護者。我們規定閣下要看守這些事,並不容任何這類事被作成。
For let the masters of the houses themselves also know that, if they do not guard these things, they themselves indeed shall come under imperial displeasure, while the houses in which any such thing is done shall both become public, and be brought under our most sacred treasury. But if it should befall any also to have any such thing in their houses, let them know that, unless within three months from the time this law has been promulgated they correct these things, and reduce them to the form ordained by us, they shall fall under the aforesaid penalty. And these things we wish to be done with truth, not through any false accusation; for we are lovers only of the truthful. These things we ordain your Highness to guard, and to grant that nothing of the kind be done.
55:5
Scito enim quia si didicerimus, tibi tale aliquid denuntiatum, deinde non prohibuisti, aut tu, aut successores tui quicunque futuri, ipse quidem quinquaginta librarum auri expones poenam, sed et qui sucessores cinguli fucrint. Parens autem tibi officium sustinebit idem damnum, si rem nobis stadiosam et sanctissimæ Ecclesiae custodientem unitatem, et prohibentem quae a nobis aperte interdicta soni, agi latenter passum est, et despicere commissum, et circa ipsum cingulum periclitabitur, insuper et ipsam domum in qua aliquid tale agitur, fieri publicam, et sub sacratissiruum venire ærarium.
因為你要知道:我們若得知有任何這類事曾稟報於你,而你竟未加禁止——無論是你,或你那將來無論為誰的繼任者——你自己固要繳納五十磅黃金的刑罰,而那些將繼任此職(cingulum,原意「官帶」)的人也照樣要繳。順服你的屬官,若任憑那於我們有益、保守至聖教會合一、並禁止我們公開所禁之事,在暗中被作了,並輕忽了交託他的職守,他也要擔受同樣的損失;他甚至要因自己的官職遭危,並且那行此類事的房舍本身也要被充公,歸入我們至聖的國庫。
For know that, if we should learn that any such thing was reported to you, and you then did not forbid it—whether you, or your successors, whoever they shall be in future—you yourself indeed shall pay a penalty of fifty pounds of gold, but so also shall those who shall be successors to the office (cingulum, lit. 'belt'). And the official obedient to you shall sustain the same loss, if he has allowed to be done in secret a thing zealous for us and preserving the unity of the most holy Church, and forbidding the things openly interdicted by us, and has despised the charge entrusted to him; and he shall be imperilled even regarding his very office, and moreover the very house in which any such thing is done shall be made public, and come under our most sacred treasury.
55:6
Scriptum exemplar a nobis et sanctissimo patriarchæ felicis hujus urbis, ut et ipse hujus ponat rei proTi. dentiam. A written copy (has been sent) by us also to the most holy patriarch of this happy city, so that he too may exercise providence over this matter. For we wish these things, guarded in priestly and judicial manner, to endure for the remaining time and unimpaired. Given on the third day before the Kalends of November at Constantinople, in the eleventh year of the reign of our lord Justinian, Perpetual Augustus, after the consulship of Belisarius, most distinguished man.
