59:1
Imperator Justinianus Augustus Mennæ sanctissimo et beatissimo archiepiscopo Constantinopolitano et universi ejus tractus patriarchæ. Quanquam multis jam legibus ea quæ sacrosanctas concernunt ecclesias, comprehendimus, indigemus tamen adhuc alia quadam, quae ad emergentes et denuo renascentes casus sufficiat. Multi enim comparandi nominis ergo animum solent ad sacrosanctarum ecclesiarum exstructionem appellere, simulque ut eas exædificarunt, nullam præterea curam adhibere, quo decentes item sumptus illis tum ad incedenda luminaria, tum ad sustentationem eorum qui illis vacent et assideant, neque non ad sacrum ministerium definiant;
猶斯丁尼奧古斯都皇帝致君士坦丁堡至聖至有福的大主教暨其全境的宗主教門納斯。雖然我們已藉許多律法概括了關乎至聖教會之事,但我們仍需另一道律法,以應對新出現與不斷再生的情況。因為許多人為求名聲,慣於著意建造至聖教會,而一旦將其建成,便不再施以任何照管,未為其撥定相稱的費用——既為點燃燈火,又為供養在其中專務與服事之人,並為神聖的職事;
The Emperor Justinian Augustus to Mennas, most holy and most blessed archbishop of Constantinople and patriarch of its whole region. Although by many laws we have already comprised the things which concern the most holy churches, we still, however, have need of a certain other one which may suffice for emerging and newly arising cases. For many, for the sake of acquiring a name, are wont to turn their minds to the construction of most holy churches, and at the same time, when they have built them up, to apply no further care whereby they might also allot suitable expenses to them — both for the kindling of the lamps, and for the support of those who attend and assist at them, and likewise for the sacred ministry;
59:2
sed relinquunt eas in nudis aediliciis, vel iterum destruendas, vel sacro orbatas ministerio. Sancimus igitur ut ante omnia quidem illud peragatur, ne quis licentiam habeat vel monasterii, vel ecclesia, vel oratorii ædificationem incipere, prius quam Dei amantissimus civitatis episcopus interveniens, in loco preces fundat, et publico illuc processu instituto, crucem figat, et factum omnibus manifestum reddat. Multi enim simulantes se oratoria fabricaturos, suis obsequuntur affectibus et morbis animi, uou ut orthodoxarum ecclesiarum, sed illicitarum speluncarum conditores sint.
反倒將它們撇下為光禿的房舍,或再度傾頹,或被剝奪神聖的職事。故我們頒令,首先當行此事:任何人都無權著手興建修道院、教會或祈禱所,除非該城至愛神的主教先行到場,在該地獻上禱告,並在那裡舉行公開遊行、豎立十字架,使此舉昭明於眾。因為許多人佯稱要建造祈禱所,實則放縱自己的私慾與心靈的病態,以致成為的不是正統教會、而是非法巢穴的創建者。
but they leave them as bare buildings, either to be destroyed again, or bereft of the sacred ministry. We ordain therefore that, before all things, this be done: that no one have license to begin the building of a monastery, or church, or oratory, before the most God-loving bishop of the city, intervening, pours forth prayers on the spot and, a public procession having been instituted there, fixes a cross and renders the deed manifest to all. For many, pretending that they will build oratories, indulge their own passions and diseases of soul, so as to be founders not of orthodox churches, but of unlawful dens.
59:3
Deinde ne aliter de novo ecclesiam ædificet, quam cum Dei amantissimo episcopo ea de re verba faciat, et tam ad incendenda luminaria et ad sacrum ministerium, quam ut ædes sarta tecta habeatur, et ad sustentationem eorum qui illis vacent et assideant, certum pecuniae modum finierit. Ac si sufficere videatur, ut prius eorum quae deputanda sunt donationem celebret, tum demum sacram ædem exstruat.
其次,凡欲新建教會者,除非就此事與至愛神的主教商議,並為點燈、為神聖職事、為使建築維修完好、並為供養在其中專務與服事之人撥定一定的款項,否則不得興建。若所撥足敷其用,當先將所應撥之物的捐獻辦理妥當,然後方可建造聖殿。
Next, let no one build a church anew otherwise than by conferring with the most God-loving bishop about the matter, and by fixing a certain measure of money both for the kindling of the lamps and for the sacred ministry, and that the building may be kept in good repair, and for the support of those who attend and assist at it. And if it seem sufficient, let him first execute the donation of the things to be assigned, and only then build the sacred edifice.
59:4
Cæterum si cum quis ad id non sufficiat, nihilominus tamen cupiditate et amore comparandi nominis, ut scilicet et ipse ecclesiæ conditor appelletur, hoc velit facere, quia multae sunt hinc inde, tam in hac regia urbe, quam in provinciis ecclesiae, in quibus tametsi convenienter omnia obeantur ministeria, tamen periculum est ne prae vetustate concidant, aut etiam parvae existant, aut minore ornatu quam cupiant hi qui sacra in iis tractant manibus, licebit sane ei unam ex bujusmodi ecclesiis desumere, et hanc exædificare, hic quoque cum scientia et consensu Dei amantissimi orthodoxorum episcopi ea re conficienda.
但若有人不足以辦此,卻仍出於求名的慾望與愛慕——即也想被稱為教會的創建者——而欲行此事:既然此王城與各省到處都有許多教會,其中雖一切職事都按理舉行,卻有因年久而傾倒之虞,或甚為窄小,或其裝飾不如在其中親手料理聖事之人所願——那麼確可准許他取此類教會中的一所加以重建;但此事同樣須在至愛神的正統主教知情與同意下辦成。
But if anyone be not sufficient for this, and nevertheless, out of desire and love of acquiring a name — that he too, namely, may be called a founder of a church — should wish to do this: since there are many churches here and there, both in this royal city and in the provinces, in which, although all the ministries are duly performed, yet there is danger lest they collapse through age, or even be small, or of less adornment than those who handle the sacred things in them with their hands could wish — it shall indeed be permitted to him to take one of churches of this kind and to build it up; this too, however, being a matter to be accomplished with the knowledge and consent of the most God-loving orthodox bishop.
59:5
Ita enim futurum est ut et sacræ ædis conditor appelletur, neque de suo quidquam praeterea sumptus addat, sumptibus pro more jam ad hoc deputatis suppeditandis ab bis qui prius quoque eas erogationes faciebant. Illud quoque sancimus, quatenus secundum jam a nobis prolatam legem, Deo amabiles episcopi in suis Ecclesiis maneant et non relinquant quidem eas, per tempus vero multum hic morentur, et cogant per provincias ceconomos expensas sibi transmittere, et sanctissima ecclesia expendat quidem, quod ipse eique Inde observare non patiatur.
因為如此他便得稱為聖殿的創建者,卻無須另出己資,那按慣例已為此撥定的費用,仍由先前作此撥付之人供應。我們也頒此令:按我們已頒的律法,蒙神所愛的主教當常住其教會,不離棄之;然而有些主教卻在此地久留,逼迫各省的司庫向他們轉送費用,至聖教會固然支出,而這正是不當容他藉此佔有的。
For thus it will come about that he be called founder of the sacred edifice, and yet add nothing further of his own in expense, the expenses already assigned for this according to custom being supplied by those who previously too made those disbursements. This too we ordain: that, according to the law already issued by us, the God-beloved bishops remain in their churches and do not abandon them; whereas some tarry here for a long time and compel the stewards throughout the provinces to transmit expenses to them, and the most holy church indeed expends what it ought not to suffer him thereby to retain.
59:6
Sancimus igitur, jam n nobis positam legem in sua manere virtute sive defuerit Deo amabilis episcopus Ecclesiae suæ, sive amplius tempus nullam ei mitti expensam de provincia, sed illam quidem circa actus pios et sanctissimam Ecclesiam expendi, ipsum vero hic errantem non expensis sanctissimam Ecclesiam prægravare.
故我們頒令:我們已立的律法仍存其效力:無論蒙神所愛的主教離開其教會,抑或在較長時間內無任何費用從該省送與他,那筆收益都當用於敬虔的善行與至聖教會之上,而他自己在此地遊蕩,卻不得以費用加重至聖教會的負擔。
We ordain therefore that the law already laid down by us remain in its force: whether the God-beloved bishop be absent from his church, or whether for a longer time no expense be sent to him from the province, but that this revenue indeed be expended upon pious acts and upon the most holy church, while he, wandering here, shall not burden the most holy church with expenses.
59:7
cum certum sit quod si plurimo tempore defuerit, quae jam a nobis super eisdem sancita sunt, valebunt Quoniam vero contingit jam nos sanxisse ut si quam provinciis alienatio rei immobitis ecclesiasticæ facienda est, secundum decretum hanc procedere, sicuti dudum prolata a nobis constitutio dicit, agi vero decretum non solum praesente Deo amabili episcopo civitatis ejusque clero, sed etiam metropoleos episcopo, nec non et illud insuper est sancitum, ut si Metropoleos sanctissimus episcopus futuras est venundare, sive ejus ecclesiae sanctissimi æconomi, quid oporteat fieri, etiam hoc adjicimus, utduo ex synodo quae subeoest Deo amabilium episcoporum, quoscunque elegerit, ipsi intersint, et alia omni observaticoe custodita.
因為確定的是:他若極長時間離任,我們已就同樣事項所定的規條仍然有效。又既然我們已頒令:若在任何一省須對教會的不動產進行轉讓,當依一道裁決而行——正如我們不久前所頒的法令所述——且該裁決的辦理不僅須有該城蒙神所愛的主教及其聖職人員在場,更須有都主教在場;又既然另有此令:倘若都主教或其教會至聖的司庫將要出售,當如何辦理——對此我們也補充:當有他所選的、隸屬其下蒙神所愛主教會議中的兩位主教在場,並遵守其餘一切規程。
since it is certain that, if he be absent for a very long time, the provisions already ordained by us concerning these same matters shall hold good. And since it happens that we have already ordained that, if in any province an alienation of immovable ecclesiastical property must be made, it should proceed according to a decree — as the constitution issued by us some time ago says — and that the decree be transacted not only in the presence of the God-beloved bishop of the city and his clergy, but also of the metropolitan bishop; and since this too has moreover been ordained, that if the most holy bishop of the metropolis is about to sell, or the most holy stewards of his church, what ought to be done — to this also we add: that two from the synod of God-beloved bishops which is under him, whomever he shall choose, be present at it, every other observance being likewise kept.
59:8
quae jam sancita est, præsentia duorum Deo amabilium episcoporum adjiciatur ut secundum se videatur cum sua synodo rem agere et sicut ipse rem facit credibilem, et sufficientem ei qui sub eo constitutus est, dum praesens est, ita et ipsi quæ sub eo est synodus praesens per duos Deo amabilium episcoporum videbitur rem praebere sanctissimam sumente ex hujusmodi synodo testimonium. Hanc vero nostram legem, tam ad sedem beatitudinis tuae quam ad cæteros transmissam patriarchas, ipsi per proprias litterassubvobis constitutis metropolitanis manifestam facietis. Qui rursum sub se posius episcopis eam divulgabunt, ne quid lateat eorum quæ a nobis constituta sunt. Dat. K. Maii. Constantin.. imp. do.
於那已頒定之事上,當再加上兩位蒙神所愛主教的在場,好叫他顯出是按自己、與其會議一同辦理此事;正如他本人在場時,使此事在隸屬其下者看來可信而充足,照樣他屬下的會議藉兩位蒙神所愛主教的在場,也將顯出使此事至為神聖,並從這樣的會議取得佐證。我們這道律法,既傳至你福德的座位,又傳至其餘各宗主教,你們當親自以函件使其昭明於隸屬你們的都主教;他們再向其屬下的主教頒布,免得我們所頒定之事有所隱蔽。頒於君士坦丁堡,五月朔,當我主在位之時。
to that which has already been ordained, let the presence of two God-beloved bishops be added, so that he may be seen to transact the matter according to himself with his synod; and just as he himself, while present, renders the matter credible and sufficient to him who is set under him, so also the synod which is under him, being present through two God-beloved bishops, will be seen to render the matter most holy, taking testimony from such a synod. This our law, transmitted both to the see of your beatitude and to the other patriarchs, you yourselves shall make manifest by your own letters to the metropolitans established under you; and these in turn shall publish it to the bishops set under them, lest any of the things ordained by us be hidden. Given on the Kalends of May at Constantinople, in the reign of our lord.
59:9
