114:1
Idem Augustus Juliano P. P. Cognovimus multos esse orthodoxos liberos quibus nec pater nec mater orthodoxæ sunt religionis. Et ideo sancimus ut non tantum in casu ubi alter [non] orthodoxae religionis est, sed etiam in his casibus in quibus uterque parens alienae sectæ sii, id est, pater et mater, hi tantummodo liberi ad eorum successionem, sive ex testamento, sive ab intestato vocentur, et donationes, seu aliae libertates bis ac. cedere possint, qui orthodoxorum venerabili sunt no mine decorati: caeteris liberis eorum qui non Dei omnipotentis amorem, sed paternam, vel maternam impiam affectionem secuti sunt, ab omni benefacio repellendis.
同一位奧古斯都致御前長官猶利安。我們得知有許多正統的兒女,其父母並非正統宗教。因此我們頒定:不僅在父母之一〔非〕正統宗教的情形中,就是在父母二人——即父親與母親——同屬異教派別的情形中,也唯有這些兒女才被召承受其繼承,無論藉遺囑或依無遺囑繼承法;並且贈與或其他慷慨之惠,只能歸於那些以正統信徒可敬之名為飾的人;至於那些不隨從全能之神的愛、反隨從父親或母親不虔之偏愛的其餘兒女,則要被擯於一切福利之外。
The same Augustus to Julian, Praetorian Prefect. We have learned that there are many orthodox children whose father and mother are not of the orthodox religion. And therefore we ordain that not only in the case where one parent is [not] of the orthodox religion, but also in those cases in which both parents are of an alien sect—that is, both father and mother—these children alone are to be called to their succession, whether by will or on intestacy; and that donations or other liberalities can accrue only to those who are adorned with the venerable name of the orthodox; while the rest of the children of those who have followed not the love of Almighty God but a father's or a mother's impious affection are to be repelled from every benefit.

Liberis autem orthodoxis non existenlibus, ad agnationem, vel cognationem eorum (orthodoxos tamen) easdem res, vel successiones pervenire. Quod si [necagnatio] vel cognatio recta inveniatur, tunceasdem res fisci nostri juribus vindicari.—§ 1. Sed ne videamur morientibus quidem genitoribus liberis providere, viventibus autem nullam inferre providentiam (quod etiam ex facto nobis cognitum esti, necessitatem imponimus talibus genitoribus ortbodoxos liberos secundum vim patrimonii alere, et omnia eis praestare, quae ad quotidianae vitae conservationem sufficiant:
但若無正統的兒女存在,便讓這同樣的財產或繼承歸於那父母的男系親屬或血親(但須是正統信徒)。但若查無此等男系親屬或合法的血親,便讓這同樣的財產被索取歸入我們國庫之權。第一節。但免得我們看似只在父母臨終時顧念兒女,卻在父母在生時不施任何顧念(這也已從一件實際的案例為我們所知),我們便加給這等父母一項義務:要按其家產的程度養育其正統的兒女,並供給他們維持日常生活所需的一切;
But if no orthodox children exist, let these same goods or successions pass to the agnates or cognates of those parents (provided, however, that they be orthodox). But if no such agnation or lawful cognation be found, then let these same goods be claimed for the rights of our fisc. § 1. But lest we seem to provide for children when their parents are dying, yet to bring no provision to bear while the parents are living (which has also become known to us from an actual case), we impose a necessity upon such parents to nourish their orthodox children according to the measure of their patrimony, and to furnish them with everything that suffices for the maintenance of daily life;

並且要為女兒和孫女給予嫁妝,為兒子或孫子訂立婚前贈與,此等慷慨之惠在各情形中都須按家產的能力估定,免得兒女因揀選了屬神的愛,反被剝奪了出於父親或母親的供應。也就是說,凡我們的敕令已就異教徒、摩尼教徒、博爾博里派、撒瑪利亞人、孟他努派、塔斯科德羅基派與奧菲特派,以及其餘異端的刑罰所定的一切,都藉我們這條律法得以確認,並永遠有效。頒於君士坦丁堡,十二月朔前第十日,當至顯赫之蘭帕迪烏斯與奧瑞斯特執政之年,五三〇年。
and also to give dowries for daughters and granddaughters, and to assign ante-nuptial gifts for sons or grandsons, such liberalities being in every case estimated according to the means of the patrimony, lest, on account of their choice of divine love, the children be defrauded of a paternal or maternal provision. All those things, namely, which our constitutions have already established concerning the penalties of pagans, and Manichaeans, and Borborites, and Samaritans, Montanists, and Tascodrogites, and Ophites, and the other heretics, being confirmed by this our law and to remain valid in perpetuity. Given at Constantinople on the tenth day before the Kalends of December, in the consulship of Lampadius and Orestes, most distinguished men, 530.
