Imperator Justinianus Augustus Joanni beatissimo archiepiscopo. Solitaria vita atque in ea contemplatio res plane sacra est, et quae suapte natura animas ad Deum adducat, neque iis tantum qui eam incolunt commodet, sed etiam omnibus aliis puritate sua et apud Deum interpellatione competentem de se utilitatem præbeat. Unde et olim ea res imperatoribus studio fuit habita, et nos non pauca de dignitate et honestate eorum legibus complexi sumus. Sequimur enim sacros in hoc canones et sanctos Patres qui hæc comprehenderunt legibus, quandoquidcm nihil non pervium ad inquisitionem majestati existit imperatoriæ, quæ communem in omnes homines moderationem et principatum a Deo percipit.

The Emperor Justinian Augustus to John, most blessed archbishop. The solitary life and contemplation therein is a thing wholly sacred, and one which by its own nature leads souls to God, and not only benefits those who dwell in it, but also furnishes to all others, by its purity and its intercession before God, a fitting usefulness on its own behalf. Whence of old this matter was held in zeal by emperors, and we too have embraced not a few things in our laws concerning the dignity and honor of these. For in this we follow the sacred canons and the holy Fathers who comprehended these things in laws, since nothing is not accessible to the inquiry of the imperial majesty, which receives from God a common governance over all men and the sovereignty.
72:2
Ac descripsimus quidem j im constitutionem quae vult ut monachi, et si magno continentur numero, secundum formam cænobiorum ( ut appellant) in commune vitam degant, neque proprias habeant possessiones, neque opes accumulent, neque clam testibus vivant, sed et communiter: cibum capiant, et in communi loco cubent, et undique bene compositam persequantur vitam, testesque sint invicem mutuæ honestatis; et juniores revereantur canitiem eoruiu qui ista inspiciunt, nonnunquam etiam dedita opera capessant vigilias, ut ue in somno quidem aliquid intempestivum aut turpe de se aliis edant spectaculum, sed quisque pro se honestatem vel inter dormiendum conservet.

And we have indeed already described a constitution which wills that monks, even if they are contained in a great number, should after the form of cenobia (as they call them) pass their life in common, and neither have private possessions, nor accumulate wealth, nor live hidden from witnesses, but should both take food in common, and sleep in a common place, and pursue on every side a well-ordered life, and be witnesses to one another of mutual honesty; and that the younger should reverence the gray hairs of those who inspect these things, and sometimes even of set purpose undertake vigils, so that not even in sleep may they offer to others any unseasonable or shameful spectacle of themselves, but that each one for himself may preserve honesty even while sleeping.
72:3
Cum vero quæpiam nobis renuntientur, quæ et majore cura digna sint, et firmiore lege indigeant, merito ad præsentem legislationem ad illius perfectionem et supplementum pervenimus, per quam sancimus ut nullus omnino propriam habitationem habeat, neque aliqua ( ut appellatur) cellula sit in monasterio his, qui ad vitam in contemplatione et quiete traducendam uno forte aut duobus utantur ministris; sed tametsi plures viri sint, nihilominus unicus ipsorum sit conventus, sive precentur, sive naturae opera faciant, quæ ciira reprehensionem tamen et absque calumnia consisiunt:

But since certain things are reported to us which are both worthy of greater care and stand in need of a firmer law, we have rightly come to the present legislation, for the perfecting and supplementing of that one, by which we decree that no one at all have his own dwelling, nor that there be any (as it is called) cell in the monastery for those who, for passing their life in contemplation and quiet, make use perhaps of one or two attendants; but even though there be several men, none the less let there be a single gathering of them, whether they pray, or perform the works of nature, which nevertheless consist without reproach and apart from calumny:
72:4
et tam communiter (ut dictum est) cibum captant, quam communiter dormiant, si modo tanta multitudo sitquam una domus possit capere, alioqui duae forte aut tres domus existant quae ipsos recipiant. Nullus autem omnino quidquam babeat proprii, sed diu noctuque in commune vivat, et noctes eamdem inter ipsos cum diebus habeant observationem. Neque enim semper omnes dormiunt, sed manifestarium est quod dum hi dormicudo occupati sunt, illi vigilant, et prorsus quidam dormientes inspiciunt.

and that they both take food in common (as has been said), and sleep in common, if only there be so great a multitude as one house can hold; otherwise let there perhaps be two or three houses which may receive them. But let no one at all have anything of his own, but day and night let him live in common, and let them keep among themselves the same observance for the nights as for the days. For not always do all sleep, but it is manifest that while these are occupied in sleeping, those keep watch, and certain ones altogether watch over the sleepers.
72:5
Cæterum, si 'jux habitatiunculæ, seu cellulae in ullo monasteriorum fuerint, sub generali hujus ample urbis patriarcba, sive in ejus confiniis, aut sub sanctitate tua constitutorum, sive a nobis ipsis aedificatorum, sive ab aliis, hasce omnes omnibus modis demolieris, apefiesque ipsis mutuum inter se aspectum, ut quæ vicissim inter ipsos geruntur, omnes intueantur. Cur ennio tandem hoc agere revereantur, qui semet se Deo dedicarunt, et omnem popularem conversationem valere jusserunt?

Moreover, if there should be any little dwellings or cells in any of the monasteries—whether under the general patriarch of this ample city, or in his confines, or among those established under your Holiness, or built by ourselves, or by others—you shall by all means demolish all these, and shall open up to them a mutual sight of one another, so that all may behold the things which are done in turn among themselves. For why at last should they be ashamed to do this, who have dedicated themselves to God, and have bidden farewell to all popular intercourse?
72:6
Atque hoc quidem ea fini obtineret tam boc tempore quam in omne deinceps ævum volumus, nullo (ut dictum est) propriam babitationem habente, seJ omnibus in unum congregandis, et quae vicissim inter ipsos gerantur spectaturis. lllud enim constat, quod ejusmodi peragere Studebunt quae undique reprehensione careant. Quod si quis usque adeo impudeus visus erit, ut conari audeat transgredi ea quæ lege promulgata sunt, hæc solitariae mansionis præsul examinato. Volumus enim ut isla nostra observatio diligentius custodiaLur. Et primum quidem, ue monasterium multos habeat aditus, sed unum tantum, aut duos forte.

And this indeed we wish to obtain for this end, both at this time and for every age thereafter—no one (as has been said) having his own dwelling, but all being gathered into one, and being beholders of the things done in turn among themselves. For this is established, that they will be zealous to perform such things as on every side lack reproach. But if anyone shall appear so shameless as to dare to attempt to transgress the things that have been promulgated by law, let the superior of the solitary abode examine these matters. For we wish that this our observance be guarded more diligently. And first, that the monastery have not many entrances, but one only, or perhaps two.
72:7
Et ut portæ assistant viri ætate graves, et casti, neque non omnium testimonio comprobati, qui neque ipsos re. verendissimos monachos permittant sine præsulis voluntate monasterio egredi, sed intus cos contineant ut ea quae Deum concernunt perquirant, nec seipsos, actionesque ac studia s a Deo divellant;neque alius quospiam, vel interdiu, vel noctu in monasterio i versari sinant, qui quidem ne reverendissimorum monachorum sincera ac recta maneat opinio efficiant. Esto autem monasterium forii muro circumseptum, ne quis alia parte exitus sit quam per portas.
並使在門口站立著年事已高、貞潔、且同樣被眾人之見證所認可的人;他們既不允許至可敬的修士本人未經院長之意而走出隱修院,反要將他們約束於內,使他們得以探求關乎天主之事,並不使自己及其行為與追求脫離天主;他們也不允許任何其他人,無論晝夜,在隱修院中逗留,免得這些人使至可敬的修士之純正且正當的聲譽不得保全。並使隱修院四周以牆環繞,以致除了藉門以外,任何部分都沒有出口之處。
And that at the gates there stand men grave in age, and chaste, and likewise approved by the testimony of all, who shall neither permit the most reverend monks themselves to go out of the monastery without the superior's will, but shall contain them within, that they may search out the things which concern God, nor tear themselves and their actions and pursuits away from God; nor shall they allow any others, whether by day or by night, to tarry in the monastery, who might cause that the sincere and right reputation of the most reverend monks not remain. And let the monastery be enclosed round about by a wall, that there be no place of exit in any part except through the gates.
72:8
Deinde et si ecclesia in monasterio non sit, neque sic tamen licenter praetextu ecclesiarum egrediantur, aut etiam deambulationes illic faciant, et cum aliquibus colloquantur quibus cum non decet, sed tempore quidem sacri ministerii una cum praesule, et primoribus ejus ac aetate provectis illo accedunto. Ministerio autem impleto, quidquid monachorum est, omnes in cœnobium denuo concedant, et ibi resideant, simulque magnum Deum precibus fatigent, et sacrarum Scripiurarum lectioni incumbant. Ingens enim sacrorum istiusmodi librorum existit chorus, et polis est cuiusque animum emendare, ac sacris irrigare eloquiis:

Furthermore, even if there be no church within the monastery, let them not on that account go out freely under the pretext of churches, nor make their walks there, nor converse with any persons with whom it is unfitting; but at the time of the sacred ministry let them go thither together with the prelate and his chief men and those advanced in age. And when the ministry is fulfilled, let all who are monks withdraw again into the cloister and remain there, and together wear out the great God with prayers, and devote themselves to the reading of the sacred Scriptures. For there exists an immense choir of books of this holy kind, and it is able to amend the soul of every man and to water it with sacred utterances;
72:9
quae si continue legant, non unquam erraverint, neque ad humanas delabentur sollicitudines. Porro in sacrosancta ecclesia, quae in monasterio consistit, quatuor aut quiuque ex eadem mansione senes sint, quibus omnis jam difficultas in sancta illa vitae ac fidei institutione superata est, et qui ordinationem in clero meruerunt, presbyterorum forte, vel diaconorum, vel aliorum deinceps gradum tenentes: atque hi adeuntibus sui copiam faciant, et de Scripturis sanctis exquisitius ser mocinabuntur, efficientque ut alii omnes tales reputentur, simul sacram asservantes ædem, simul juventutem insolescentem et terminos suos egredi volentem in tolerantia retineutes.
他們若持續誦讀,便永不致迷失,也不會墮入屬人的憂慮。此外,在隱修院內所設的至聖聖堂中,當有四五位出自同一居所的長老,他們在那聖潔的生命與信德操練中已克服一切艱難,且已蒙配在聖品中受聖秩,或許居於司鐸、執事,或其後其他等次之位;這些人當向前來者開放自己,更精審地講論聖經,使其餘眾人皆被視為這樣的人,一面看守聖殿,一面以忍耐約束那些日漸放肆、想要逾越本分的年輕人。
and if they read these continually, they will never go astray, nor sink down into human cares. Moreover, in the most sacred church which stands within the monastery, let there be four or five elders from the same dwelling, men in whom every difficulty in that holy discipline of life and faith has already been overcome, and who have merited ordination in the clergy, holding perhaps the rank of presbyters, or of deacons, or thereafter of others; and let these make themselves available to those who approach, and discourse more searchingly concerning the holy Scriptures, and bring it about that all the rest be esteemed such men, at once guarding the sacred edifice and at once holding back in patience the youth that grows insolent and wishes to overstep its proper bounds.
72:10
Non ingredietur autem omnino neque mulier in monasterium virorum, nejue vir in muliebre, vel obtentu memoriae defuncti illic reconditi, vel ob aliam causam. Et maxime si quis fratrem forte, aut sororem, aut quempiam ex genere conjunctis se iu monasterio habere dicat. Monachis etenim cognatio in terra non est, utpote qui coelestem vitam affectent. Quid enim omnino tandem volentes hujusmodi aditiones faciunt, nisi si quid perpetrare velint rerum interdictarum, cum et ea quae viros decent, viris in virorum monasteriis efficere, et consimiliterquae mulieribus attributa sunt mulieribus liceat in muliebribus monasteriis peragere?
此外,斷不可有任何婦人進入男修院,或任何男子進入女修院,無論是藉口紀念葬於該處的某位亡者,或為其他緣由。尤其若有人說他在院中或許有兄弟、姊妹,或某位血親。因為隱修士在地上並無親屬,正因他們所慕求的是天上的生命。人作這樣的造訪,究竟所圖為何?豈不是或許想要犯下禁戒之事麼?既然凡合乎男子之事,男子可在男修院中行之,同樣凡分派給婦女之事,婦女也可在女修院中行之。
Moreover, let no woman whatsoever enter into a monastery of men, nor any man into one of women, whether under cover of the memory of some deceased person there buried, or for any other cause. And especially if anyone should say that he has perhaps a brother, or a sister, or some kinsman in the monastery. For monks have no kindred upon earth, inasmuch as they aim at the heavenly life. For what at all do men make such visits desiring, save that they may perchance wish to commit some of the forbidden things, since both what befits men is permitted to men to carry out in monasteries of men, and likewise what is assigned to women is permitted to women to perform in monasteries of women?
72:11
nullo alteri admisto, neque si frater, aut soror, aut alius cognatus esse dicatur. Neque enim per hanc causam aditum ipsis patere concedimus. Nam si ipsa præciderimus principia, et errorem, qui per aspectum se animis hominum insinuat, et exinde ad mala lubricitatem prohibuerimus, multo clementior et facilior existet sacris decertatoribus vitae in melius emendatio. Omnes itaque huic legi obtemperanto, et neque virum recondunto in muliebrium monasteriorum sepulcris, neque mulieres in virorum monasteriis, seu asceteriis derodiuntor. Neque enim viris mulierum domicilia, neque rursus virorum habitacula conveniunt mulierum consortiis.
且不容任何外人介入,縱使說是兄弟、姊妹或其他血親也不行。因為我們也不准他們藉此緣由得以進入。因為我們若斬斷其開端,並禁止那藉由觀看潛入人心的迷惑,以及由此通往諸惡的滑落,那麼這些聖潔的奮鬥者改善生命、向上提升便要大為寬緩容易得多。故此眾人皆當遵守此法,不可將男子葬於女修院的墳墓中,也不可將婦女埋於男子的修院或苦修所中。因為婦女的居所不宜男子,男子的住處也不合與婦女相處。
with no other person admitted, not even if he be said to be a brother, or a sister, or some other kinsman. For neither do we grant that access lie open to them on this pretext. For if we cut off the very beginnings, and forbid the error which through sight insinuates itself into the minds of men, and thereafter the slippery slide toward evils, far more clement and easy will be the amendment of life for the better for these sacred contenders. Let all therefore obey this law, and let them neither bury a man in the sepulchres of women's monasteries, nor inter women in monasteries or ascetic houses of men. For neither do the dwellings of women befit men, nor again do the abodes of men suit the company of women.
72:12
Nec per eusqui propter defunctos ingrediuntur voluIDUS exinde inhonestas hasce commistiones fieri, ne per hanc causam naturae fenestra aperiatur, ut ea quae. nefas est delicatius in se admittat, et ludos faciat. sacrasque res defœdet, ac velamento pietatis, et sub specie exsequiarum,ea perpetret quae neque dicereneque in animo cogitare solilariam vitam exercenUbus pulchrum est. Cum vero illud re ipsa manifestum existat, quod necesse ait eos qui sepulturis peragendis ministerium praebent, et maxime qui ferelra deportant, quique defodiunt, ingredi in monasteria, res sane difficilis consistit in muliebribus, cum ob alia multa, tum propter praefatam prohibitionem.
也不可藉著那些因亡者而進入的人,由此發生這等不端的混雜,免得藉此緣由開了情慾本性的窗口,使之更放縱地接納那不法之事,戲耍胡為,玷污聖物,並在虔誠的遮蓋之下、喪葬儀式的外表之下,犯下那些獨修生活者連說出或心中思想都不相宜的事。但既然此事實在顯明,就是那些供役行葬之事的人——尤其是抬棺者與掘墓者——必須進入修院,那麼在女修院之中此事便確實成了難題,不僅因諸多其他緣由,也因上述的禁令。
Nor should these unseemly minglings come to pass through those who enter on account of the dead, lest through this cause a window of nature be opened, so that it may admit into itself more wantonly what is unlawful, and make sport, and defile sacred things, and under the veil of piety, and beneath the appearance of funeral rites, perpetrate those things which it is not fitting for those who practice the solitary life either to speak or even to conceive in mind. But since this is in very fact manifest, that it is necessary for those who furnish service in carrying out burials—and especially those who bear the biers, and those who dig the graves—to enter into the monasteries, the matter indeed proves difficult in the case of women's houses, both for many other reasons and on account of the aforesaid prohibition.
72:13
Sancimus tamen ut si quando tale aliquid futurum est, et mulier aliqua in muliebri sepeliatur monasterio (virum cnim ibi sepeliri non permittimus), reverendissimæ quidem mulieres in suo permaneant habitaculo, sola autem ostiaria, sive ostiariæ, et ipsa forte (si velit) antistes his quae fiunt intersit. Simul atque vero illi quae circa exsequias fieri solent, tam sepulcro effosso quam corpore recondito,effecerint, statim discedant, neque aliquas ipsi reverendissimi spectantes mulierum, neque ab aliquibus earum spectati.
然而我們規定:每逢有此等事將要發生,有某婦人要葬於女修院之時(因為我們不准男子葬在那裡),那些極可敬的婦女當留在自己的居所,唯有守門者,或眾守門女,並或許女院長本人(若她願意),可在所行之事中在場。一俟那些人完成喪儀慣行之事,掘了墳墓並安放了遺體,便當立即離去,他們那些人不可觀看任何婦女,也不可被任何婦女觀看。
We ordain nevertheless that, whenever any such thing is to occur, and some woman is to be buried in a women's monastery (for we do not permit a man to be buried there), the most reverend women shall remain in their own dwelling, but only the doorkeeper, or doorkeepers, and perhaps the abbess herself (if she so wishes) shall be present at the things that are done. And as soon as those persons have accomplished the things that are customarily done about the funeral rites, both the grave being dug and the body laid to rest, let them straightway depart, neither themselves, the most reverend persons, looking upon any of the women, nor being looked upon by any of them.
72:14
Sed neque aliam ingressuum occasionem excogitanto, vel viri in mnliebria monasteria, vel mulieres in ea quæ viris deputata sunt, per causam eorum quæ peraguntur circa exsequias, quas scilicet memorias appellitant, in tertium nonumque diem convenientes, item cum quadraginta excesserint, aut etiam annus, cum liceat, siquidem muliebre monasterium sit, mulieres omnia peragere; si virile, viros, neque per hujusmodi occasionem venerabilibus monasteriis aliquam inurere infamiam.
但他們不可另設任何進入的藉口——無論是男子進入女修院,或婦女進入分派給男子的修院——以行那喪儀之事為由,就是他們慣常稱之為「追思」的,在第三日與第九日聚集,同樣在滿了四十日、甚或滿一年之時聚集;既然在合法之時,若是女修院,眾婦女可行一切之事;若是男修院,則由男子行之;他們不可藉此等機會使這些可敬的修院蒙受任何惡名。
But let them not devise any other occasion of entrances—whether men into women's monasteries, or women into those assigned to men—on account of the things which are performed about the funeral rites, which indeed they are wont to call memorials, gathering on the third and ninth day, likewise when the forty days have passed, or even the year; since, when it is lawful, if it be a women's monastery, women may perform all things; if a men's, men; and let them not through such an occasion brand any infamy upon the venerable monasteries.
72:15
Quia vero nihil eorum quæ inclusa sunt legibus, uti æquum est, servari potest, nisi convenientem habeat custodiam, sancimus ut qui cujusque monasterii pro tempore præsul fuerit, continue < ad ipsum animadvertat, et in unoquoque ad instar rei, et disciplinæ publicae operam navet. Et sicubi vel paululum quiddam contra decorum fiat, protinus hoc emendet, neque committat ut major exinde lapsus oriatur, et anima quæ ad salutem ex sancta vita atque fidei institutione provenientem confugit, pereat. Ipse quoque monasteriorum summus præsul, sive in loco sit, quemadmodum in hac est urbe, sive non, enixe in eam rem operam dato, et apocrisiarios suos (ut nuncupantur) per monasteria dimittito;
但既然凡被律法所規範的事,若無相宜的看守,便不能如理保全,我們便規定:凡一時擔任任何修院院長者,當持續看顧該院,並在每件事上按照公共秩序與紀律的樣式盡心效力。倘若任何地方有絲毫違反端莊之事,他當立即予以糾正,不容由此生出更大的墮落,也不容那已逃奔到聖潔生命與信德操練所帶來之救恩的心靈淪亡。眾修院的最高院長本人,無論他身在當地(如在本城這般),或不在,也當竭力在此事上效力,並差遣他的「使者」(如其名所稱)巡行各修院;
But since nothing of those things which are enclosed within laws can, as is fitting, be preserved unless it have suitable custody, we ordain that whoever shall be for the time the prelate of any monastery shall continually give heed to it, and in each thing bestow his effort after the manner of public order and discipline. And if anywhere even some little thing be done contrary to decorum, let him forthwith amend this, and not allow a greater lapse to arise therefrom, and the soul which has fled for refuge to the salvation that comes from a holy life and the discipline of faith to perish. Let the supreme prelate of the monasteries himself also, whether he be on the spot, as he is in this city, or not, earnestly give his effort to that matter, and send his apocrisiaries (as they are called) throughout the monasteries;
72:16
e vicinis etiam interroget, nunquid mali in aliquo vicinorum perpetrctur monasteriorum; atque haec omnia coerceto, et competentem pro digniiate impendito providentiam. Sed et cujusque civitatis episcopus in hoc providentiam adbibeto, sive patriarcha, sive metropolitanus, sive quicunque sit; et reyerendissimos defensores ecclesiae suae mittito, qui haec perquirant, et observent, neque committant ut praeter decorum quidquam fiat. Sed et si quid tale perpetretur, ut primo quoque tempore hoc corrigant. Consimiliter autem et sanctissimus hujus almæ urbis patriarcha ea quae monasteria hic concernunt perquirito;
也當向鄰近者查問,看鄰近各修院中是否有任何惡行被犯下;他當約束這一切,並按其尊嚴施以相宜的看顧。各城的主教也當在此事上施以看顧,無論他是宗主教、都主教,或不論其為何人;他當差遣其教會中極可敬的護衛者,去查察並監督這些事,不容有逾越端莊之事發生。但若有此等事被犯下,他們也當在最早的時機加以糾正。同樣,這蒙福之城至聖的宗主教,也當查察此地關乎眾修院之事;
let him also inquire of the neighbors whether any evil is being perpetrated in any of the neighboring monasteries; and let him restrain all these things, and bestow a fitting providence according to its dignity. But let the bishop of each city also apply his providence in this matter, whether he be patriarch, or metropolitan, or whoever he be; and let him send the most reverend defenders of his church, who may search out these things and observe them, and not allow anything to be done beyond decorum. But also, if any such thing be perpetrated, let them correct it at the very first opportunity. And likewise let the most holy patriarch of this benign city search out the things which here concern the monasteries;
72:17
et ejus rei custodes Dei amantissimos defensores sacrosanctæ majoris ecclesiae, et quoscunque diligentissimos, honestissimosque esse putaverit constiluito, ut majore adhibita custodia, amplior item observatio, et pro delictis vindicta procedat. Enimvero singula monasteria sub aliquo censeri oportet antistite, et habere (quemadmodum diximus) quos dicunt apocrisiarios, viros aetate graves, qui et in monastiea jam disciplina impendio decertarint, neque facile corporis sustineant impetus, et rebus gerendis, atque ipsorum usibus vacarint.
他當立至聖大教會中那些敬愛天主的護衛者作此事的監護人,並立他所判斷為最殷勤、最可敬者,使在施以更大看守之時,也有更完備的監督,並對過犯施以懲處。因為各個修院確當隸屬於某位上司,並(如我們所言)當有他們所稱的「使者」,就是年高持重之人,已在隱修紀律中大大奮鬥,不易屈服於肉體的衝動,並已委身於處理事務及自身的職分。
and let him appoint as guardians of that matter the God-loving defenders of the most sacred greater church, and whomsoever he shall judge to be most diligent and most honorable, so that, greater custody being applied, a fuller observance likewise, and a punishment for offenses, may go forth. For indeed each several monastery ought to be reckoned under some superior, and to have (as we have said) those whom they call apocrisiaries, men grave in age, who have already striven greatly in monastic discipline, and do not easily endure the impulses of the body, and have given themselves to the conduct of affairs and to their own occupations.
72:18
Neque hoc tantum, si virorum monasterium sit, sed etiam si mulierum forte sit, duo aliqui viri, vel (si haberi possunt) eunuchi constituantur, qui amplissimo testimonio comprobati, negotia ipsarum gerant, et ineffabilem ipsis communionem, com ejus rei opportunitas erit, distribuant. Quod si illi de necessitate aliqua monasterii, aut quæ unam aliquam reverendissimarum ascetriarum pertingat, necessarii aliquid dicere voluerint, colloquantur ea de re cum sola antistite, neque praeterea cum ulla alia mulierum quae in eo consistant monasterio, per reverendissimas tamen omnia conficientes ostiarias.
不僅此也,若是男修院如此,即或是女修院,也當設立兩位男子,或(若能得著)閹人,他們既經最充分的見證所核准,便可料理她們的事務,並在時機來到時,將那難以言喻的聖餐分給她們。倘若那些人要說任何關乎修院某項需用、或關乎某位極可敬的女苦修者之必要事,他們當單與女院長商議此事,此外不可與住在該修院的任何別的婦女商議,但凡事仍須藉那些極可敬的守門女辦理。
And not only this, if it be a monastery of men, but even if it happen to be one of women, let two men, or (if they can be had) eunuchs, be appointed, who, approved by the amplest testimony, may conduct their affairs, and distribute to them the ineffable communion when the opportunity for that shall arise. But if those men should wish to say anything necessary concerning some need of the monastery, or which pertains to some one of the most reverend ascetics, let them confer about that matter with the abbess alone, and not besides with any other of the women who dwell in that monastery, accomplishing all things, however, through the most reverend doorkeepers.
72:19
Oportet enim et hujusmodi aliquas ad fores collocari, quæ consimiliter et ingressus et exitus respicientes, tam exitus mulierum prohibeant quam inaccessos viris aditus, exceptis apocrisariis, reddant. Hi autem ostiarias accedem, et adventus sui causam exponent. Antistes vero re cognita, et progressa, cum his colloquetur, ipsique ad illam referent ea quæ dispensationem eorum concernunt et necessitatem, quamobrem accesserim. Atque ita et humana pulchre administrabuntur, et ex omni parte nullo tentata malo durabit castitas.
因為也必須有這樣一些婦女守在門口,她們既照樣看守進出,便可禁止婦女外出,並使各通道對男子不得通行,唯獨對「使者」例外。這些使者前來見守門女時,當陳明來意。女院長在事情查明並陳上後,便與這些使者商議,他們也將那關乎事務管理及前來緣由之必要事向她報告。如此,屬人之事便得以美好地處理,而貞潔不受任何方面之惡的試探,得以持守。
For it is necessary that some such women too be stationed at the doors, who, likewise watching both the entrances and the exits, may both prohibit the going-out of women and render the accesses inaccessible to men, except to the apocrisiaries. These latter, approaching the doorkeepers, shall set forth the cause of their coming. And the abbess, when the matter is known and brought forward, shall confer with these, and they shall report to her those things which concern the management of their affairs and the necessity for which they have come. And thus both human affairs shall be beautifully administered, and chastity, tempted by no evil on any side, shall endure.
72:20
Certe si quis delinquat (ut multa sunt humana, neque quisquam ita continere naluram potest in officio, quin aliquando peccet, hoc enim solius est Dei), hunc quidem, si mediocre delictum sit, et admoneto, et seorsim includito, tempusque illi assignato pœnitentiæ, ut meliorc ratione percepta, ad seipsum redeat, neque depensos jam et exhaustos labores amittat. Sin vero major lapsus fueril, pro inodo peccati adhibetor etiam emendationis diligentia, et item vehementiorem admonitionem, et fortiorem pœnitentiam expetito.
若有人犯過(因人事甚多,無人能如此約束本性而盡其本分,以致永不犯罪——因為這唯獨屬乎天主),那麼,若所犯尚屬輕微,他當予以勸誡,並將其單獨隔離,給定一段補贖之期,好叫他既領悟了更佳的道理,便能回轉歸於自己,不致喪失已耗費竭盡的勞苦。但若墮落較為嚴重,便當按罪的程度施以更殷切的糾正,並要求更激切的勸誡與更剛強的補贖。
Certainly if anyone should offend (since human affairs are many, nor can anyone so restrain nature in its duty as never at some time to sin—for this belongs to God alone), then, if the offense be moderate, let him both admonish him and shut him up apart, and assign him a time of penance, so that, having received a better understanding, he may return to himself, and not lose the labors already expended and exhausted. But if the lapse be greater, according to the measure of the sin let diligence of correction also be applied, and let him demand both a more vehement admonition and a stronger penance.
72:21
Et siquidem hisce modis servare eum valuerit, qui labi coeperat (idem autem et in mulieribus sanctimoniali vitae deditis, et in viris dicimus), magno Deo gratias agat, qui et angelicis in cœlo potestaiibus gaudium oboriri dixit si quis peccatorum servetur. At si delictum atrocius sit quam quod medela reparari possit, tunc prorsus monasterio ipsum expellito, ut cum seipsum a melioribus ad deteriora contulerit, ipse solus improbitatis suæ fructum capiat, neque vitiorum suorum aliquid caeteris contagione affricet, quemadmodum peste laborantia et incurabiliter ægrotantia solent pecora.
他若能藉這些方法挽回那開始跌倒的人(我們對獻身聖潔生活的婦女與男子所說的相同),就當感謝偉大的天主,祂曾說,若有一個罪人得救,連天上的天使眾權能中也要生出喜樂。但若所犯的過惡兇暴到非藥石所能補救,那麼就當將那人徹底逐出修院,叫他既從較佳處轉趨較惡處,便唯獨自己承受其自身邪惡的果子,不致藉傳染將自己的惡習沾染給其餘的人,正如染瘟疫、患不治之疾的牲畜慣常所為。
And if by these methods he shall have been able to save the one who had begun to fall (and we say the same both of women given to the consecrated life and of men), let him give thanks to the great God, who said that joy arises even among the angelic powers in heaven if any one of sinners be saved. But if the offense be more atrocious than can be repaired by remedy, then let him utterly expel that man from the monastery, so that, since he has betaken himself from the better to the worse, he alone may reap the fruit of his own wickedness, and may not by contagion rub off any of his vices upon the rest, as cattle laboring with plague and incurably diseased are wont to do.
72:22
Nam ut maxime hi neglexerint, non tamen majestas ista despiciet imperatoria, neque indignatione contra id factum, contrare locorum episcopum et ecclesiasticos qui sub ipso constitutli sunt, abstinebit, nisi hoc observaverint, nimirum cum ejus negotii diligentia necessario ipsi etiam majestati imperatoriæ incumbat. Si enim puris illi nudisque manibus pro republica preces Deo obtulerint, manifestum sane quod et res militaris pulchre se habebit, et civitates in bono statu erunt. Deo item propitio ac benevolo constituto, quomodo non omnia in summa pace et recta legum moderatione vigebuni?
因為縱使這些人特別怠忽其職,這帝國的威嚴也不會輕看,也不會不對那行為發怒,不會不對那地方的主教及隸屬其下的教職人員發怒,除非他們守住此事——因為那事務的看顧必然也落在帝國威嚴本身。因為那些人若以潔淨赤裸的手為國家向天主獻上禱告,顯然軍政必要美好,諸城必要處於良善的境況。天主既照樣被使為慈悲恩慈,萬事豈不要在至高的平安與律法的正當治理中興盛麼?
For though these men should especially neglect their duty, yet this imperial majesty shall not look down upon it, nor shall it refrain from indignation against that deed, against the bishop of the place and the ecclesiastics who are appointed under him, unless they observe this—seeing that the diligence of that business necessarily falls upon the imperial majesty itself as well. For if those men shall have offered prayers to God for the commonwealth with pure and bare hands, it is surely manifest both that the military estate will be in good case, and that the cities will be in a good condition. And God being likewise made propitious and benevolent, how shall not all things flourish in the highest peace and the right governance of the laws?
72:23
Terra quoque nobis frucium feret, et celerius bona sua edet, per Dei benevolentiam precibus illorum universam rempublicam in unum colligentibus. Sed et communis hominum figura venerabilior erit, quaerentque quod praestantius est, illorum puritatem reveriti. Unde una fiet conspiratio, omnibus simul ad hoc concurrentibus. et fquoad fieri potest) cxterminata omni malitia melioribus sanctioribusque studiis introductis, et dignitatem habentibus. Quod quidem cum desideremus, bonum haud dubie opus, quemadmodum persuasum habemus, perficimus.
地也要為我們結出果實,並藉天主的恩慈更快地獻出其美物,因為他們的禱告將整個國家聚為一體。人類共同的樣式也要更為可敬,眾人也要敬重他們的純潔,而尋求那更卓越之事。由此便要生出同心合意,眾人一同奔向此目標;並(在可行的範圍內)一切邪惡被剷除,更佳更聖潔且具尊嚴的追求被引入。我們既渴慕此事,毫無疑問便成就了一件善工,正如我們所深信的。
The earth too will bear us fruit, and more swiftly yield its goods, through the benevolence of God, as their prayers gather the whole commonwealth into one. But the common form of mankind also will be more venerable, and men will seek what is more excellent, revering their purity. Whence one harmony will come to be, all running together at once toward this; and (so far as it can be done) all malice being exterminated, and better and holier pursuits being introduced, and such as bear dignity. Which thing indeed, since we desire it, we accomplish a good work without doubt, even as we are persuaded.
72:24
Illud quoque omnibus observari modis volumus, ut si quis reverendissimorum monachorum in caupona aliqua diversari videatur, illico is tradatur civitatum defensoribus, aut hic judicio excellentiæ tuae, castigeturque convictus, certiorque ea de re reddatur antistes, ut cum qui haec deliquit, et turpem vitam cum angelico hoc statu permutavit, expellat monasterio. Duabus enim potissimum in rebus operam et diligentiam reponere oportet monachos, ut aut sacris vacent Scripturis, aut quas manuarias vocare solent artes monachos decentes meditentur exerceantque. Siquidem mens inerti otio dedita haud sane quidquam bonorum pepererit.
我們也願此事在凡事上得遵守:若見任何極可敬的隱修士寄宿在某酒館,當立即將他交給各城的護衛者,或在此交於閣下的審判,定罪後加以懲處,並將此事通知其上司,好叫他將這如此犯過、以卑賤生活換取此天使般地位的人逐出修院。因為隱修士尤當在兩件事上盡心竭力:或專研聖經,或操練施行他們慣稱合乎隱修士的手工技藝。因為一個沉於懶散安逸的心思,斷不能生出任何善果。
We will also that this be observed in every way: that if any of the most reverend monks be seen lodging in some tavern, let him forthwith be handed over to the defenders of the cities, or here to the judgment of your excellency, and, being convicted, be chastised, and let the superior be informed of that matter, so that he may expel from the monastery the one who has thus offended and has exchanged a base life for this angelic estate. For in two things above all ought monks to place their effort and diligence: that they either devote themselves to the sacred Scriptures, or practice and exercise those manual arts which they are wont to call befitting monks. Since the mind given over to slothful idleness will assuredly produce nothing of good.
72:25
Atque hanc legem de his proponimus, tam in hac regia valituram urbe quam in omnibus gentibus. Nam et ad unumquemque religiosissimum patriarcham pro majore cautela et competente custodia eam transmittemus. Hi vero ad metropolitanos sub ipsis constitutos eam emittent. Illi autem omnibus aliis impertientur episcopis, et per episcopos haecreverendissimis monachis eorumque antistitibus manifesta fiet.
我們頒布此法以治理這些事,使其在這帝京及萬邦中皆有效力。因為我們也將把它傳達給每位最虔誠的宗主教,以求更大的謹慎與相宜的看守。這些宗主教又將其發送給隸屬其下的都主教。那些都主教則將其分傳給其餘一切主教,並藉主教使之向那些極可敬的隱修士及其上司顯明。
And we set forth this law concerning these matters, to be in force both in this royal city and among all nations. For we shall transmit it also to each most religious patriarch for greater caution and fitting custody. These in turn shall send it forth to the metropolitans appointed under them. And those shall impart it to all the other bishops, and through the bishops it shall be made manifest to the most reverend monks and their superiors.
72:26
Porro hnjus rei observationem committimus non tantum cujusquc mansionis solitariae præsuli, neque solum Dei amantissimis locorum episcopis, aut religiosissimis metropolitanis, aut sanctissimis patriarchis, sed et hic quidem praefeclis, ut si res vehementiore aliqua animadversione indigeat, de hoc a Dei amantissimis viris edocti, id exsequantur: in provinciis vero illarum praesidibus, ut tamen quid facto opus sit, prius a Dei amanlissimis perdiscant episcopis. Et prorsus tam per sacratas personas quam magistratus ea quae Deum concernunt incorrupta existant;
再者,我們將此事的執行不僅託付給各獨修居所的上司,也不僅託付給敬愛天主、各地方的主教,或最虔誠的都主教,或至聖的宗主教,更在此託付給眾長官,好叫倘若此事需要更激切的懲治,他們既由敬愛天主的人受教,便加以執行;在各行省則託付給各省長,但須先從敬愛天主的主教徹底領明當行之事。並當在凡事上,藉著聖職人員與官長,使凡關乎天主之事不受敗壞;
Furthermore, we commit the observance of this matter not only to the superior of each solitary dwelling, nor only to the God-loving bishops of the localities, or the most religious metropolitans, or the most holy patriarchs, but here also to the prefects, so that, if the matter need some more vehement chastisement, being instructed about this by the God-loving men, they may carry it out; and in the provinces to their governors, yet so that they first learn thoroughly from the God-loving bishops what needs to be done. And in every way let those things which concern God remain uncorrupted, both through consecrated persons and through magistrates;
72:27
et præ caeteris omnibus per majestatem imperatoriam, ut pote cum nihil divinarum rerum, et quae custodirc juslum esl, a nobis negligatur, sed per omnia studcamus ut communis reipublicae status ex magni Dei et Servatoris nostri Jesu Christi erga homines amore fructum auferat per reverendissimorum virorum puritatem: quam custodient et clerici, et monachi, et episcopi, tam majores quam minores, tum sacrorum memores canonum, tum nostrarum legum et constitutionum de hoc conscriptarum, quas et valere et ratas esse per praesentem quoque legem sancimus. Quae igitur nobis placuerunt, et per hanc sacram declarantur legem, ea cognoscens gloria tua, effectui et fini tradere studeto. Uat.
並且尤其藉著帝國的威嚴,因為凡關乎神聖之事、凡按理當看守之事,無一被我們所忽略,反倒我們在凡事上竭力,使國家的共同境況,藉那偉大的天主、我們救主耶穌基督對人的愛,能藉那些極可敬之人的純潔而結出果實——這純潔,眾教士、隱修士及大小主教皆當看守,既謹記神聖的教規,也謹記我們為此所撰的律法與敕令,我們藉本法也規定其有效並得批准。故此凡蒙我們所喜悅、並藉此神聖律法所宣布之事,願閣下既已知曉,便殷勤付諸實行並使之完成。順頌安康。
and above all others through the imperial majesty, inasmuch as nothing of divine matters, and of those which it is just to guard, is neglected by us, but in all things we strive that the common condition of the commonwealth may, out of the love of the great God and our Savior Jesus Christ toward men, carry off fruit through the purity of the most reverend men—which purity both the clergy, and the monks, and the bishops, both greater and lesser, shall guard, mindful both of the sacred canons and of our laws and constitutions composed concerning this, which by the present law also we ordain to be valid and ratified. The things therefore which have pleased us, and are declared through this sacred law, do you, knowing them, your glory, be zealous to bring to effect and to their end. Farewell.
