Differente domino recipere emphyteuma. licentiam habet emphyteuta consignare ipsum, et Constantinopoli quidem in fine triennii contestari id ipsum apud hyparchos [seu praefectos prætorio] aut apud praefectum urbis, aut competentem recusaniis magistratum, aut patriarcham, si dominus homo sit potens: in provinciis autem apud praesidem, aut, eo non morante ibi, apud defensorem, aut episcopum civitatis, in qua est is qui recusat; et unius ipsorum assumere testationem: ac nisi aut sic acceperit canonem, canon solvitur, et lucratur canonem emphyteuta eliam sequentis temporis, et eousque quo dominus mittat per lestalionem petitum;

The same Augustus. When the owner delays to receive the emphyteutic rent (emphyteuma), the emphyteuta (holder of the emphyteusis) has permission to deposit it, and at Constantinople indeed, at the end of the triennium, to attest the same thing before the hyparchs [or praetorian prefects], or before the prefect of the city, or the competent magistrate of the one refusing, or the patriarch, if the owner be a powerful man; but in the provinces before the governor, or, if he does not reside there, before the defender or the bishop of the city in which the one who refuses resides; and to take the attestation of one of them: and unless he has thus received the rent (canon), the rent is dissolved, and the emphyteuta gains the rent even of the following period, and up to the point at which the owner sends, by attestation, to demand what is sought;

exinde etenim, non autem ex praeterito tempore, accipiet, et post triennium post attestationem ejusmodi indevotum emphyteutam expellere poterit.

for from thenceforth, and not from the time past, will he receive; and after a triennium, following an attestation of this kind, he will be able to expel the undevoted (negligent) emphyteuta.
