The Emperor Justinian Augustus to John, most glorious praetorian prefect, twice ex-consul and patrician. Unless at the very earliest opportunity we restore the office of the defensores to its proper order, the truth of the ancient titles will no longer afford us its meaning. For whereas of old various names were imposed on various things, names which plainly signified the force of those very things, this very name of the defensores shows that antiquity set certain men over affairs to keep them free from all injury; and for this very reason in our native tongue we even now call them defensores, because they rescue from evil men those oppressed by injury.

Nunc vero ea ipsa defensorum sollicitudo ita in plerisque reipublicæ nostrae partibus proculcata est, et vebementer despicatui habita, ut contumeliæ potius quam henori et dignitati alicui expetita esse videatur. Inde obscuri ad hanc homines assumuntur, et decreta super ipsis ex commiseratione magis quam vera electione flunt. Quibus enim alimonia et victas aliunde sufficiens non est, hi emendicatis, defensorum suffragiis, ad hanc solli. citudinem accedunt, et pro quodam veluti ludicro præsidum Mimis sunt propositi, siquidem et removent ees quandocunque volunt, minima quæque vertentes vitie, et alios in illorum locum ingerunt.

But now this very office of the defensores has in most parts of our commonwealth been so trampled down and so vehemently held in contempt, that it seems to have been sought after for insult rather than for any honor or dignity. Hence obscure men are taken into it, and decrees concerning them are made out of pity rather than from true choice. For those who have no sufficient sustenance and livelihood from elsewhere, these, having begged the votes of the defensores, come to this office, and they are set up as a kind of laughing-stock for the mimes of the governors, since indeed they remove them whenever they will, turning the slightest faults into reproach, and thrust others into their place.

They also appoint vicars to the defensores, and sometimes within a single year admit several men into this office. Whence even the cohortales, and the magistrates of the cities, and those who dwell in them, all hold the defensor in the utmost contempt. And the things done before them are wont to be treated as though they had not been done. For unless the provincial governors so command, they do not even dare presume to draw up any records of proceedings before themselves, serving the governors in all things and attending only to their nods. But if they do draw up certain things, first of all they even sell them.

Then, since they have no archive prepared for this purpose in which to deposit the proceedings with them, what was done perishes, nor would you easily find with them any monument at all of long standing; but those who need the records seek them among the heirs of the defensores and among other successions, where partly things unworthy of credence are found, and partly even they perish and fall away, to such a degree that they are reckoned as if they had never been done.
43:5
Nos igitur quoniam praesidum partes bene disposuimus, majorque ut ipsis inter gentes esset potentia effecimus, et longius absunt quam ut civitatum commoda semper in conspectu habere possint, propterea existimavimus ipsam quoque defensorum sollicitudinem ad pristinum erigendam esse statum. Existet enim bella quaedam hoc modo consonantia et harmonia, si civitatum defensores judicum ordinem occupent, et provinciae moderator potius judicum judex, et per hoc decessoribus suis honoratior esse videatur. Quanto enim quisque præstantioribus imperat, tanto ipse et major et honoratior est.

We therefore, since we have well ordered the duties of the governors, and have brought it about that they should have greater authority among the nations, and since they are too far off to be always able to keep the interests of the cities in view, have on this account judged that the office of the defensores too ought to be raised to its former state. For there will arise a certain fair harmony and concord in this way, if the defensores of the cities occupy the order of judges, and the moderator of the province appear rather a judge of judges, and through this more honored than his predecessors. For the more excellent those are whom one commands, the greater and the more honored is he himself.

Interea igitur illud primo sanciendum est, ut ne cuiquam omnium facultas sit ad defensoris ordinationem repudiandam, sed per vices quique bonoratissimi incolæ suis hoc munus civitatibus impleant (hoc enim et elapsis teinporibus obtinuisse inque usu fuisse didicimus) nemini patefacta copia hoc repudiandi, neque si magnificentissimorum illustrium dignitate decoratus sit, neque si insignem aliquam militiam habeat, neque si quod privilegium ex ipsis sacris formis praetendat, et si concessae formae pragmaticae sint, sed omnibus civitatis incolis, gui scilicet in aliqua sunt reputatione, hanc sollicitudinem in circulum implentibus, et cum circulus desinit, iterum ad eam revertentibus, et praedictum munus obeuntibus, ut defensor judex potius, quam defensor esse videatur.

In the first place, therefore, this must be ordained: that no one of all men have license to refuse appointment as defensor, but that the most honored inhabitants in turn fulfill this office for their cities (for we have learned that this obtained and was in use in past times also), no opportunity being opened to anyone of refusing this—not if he be adorned with the dignity of the most magnificent and illustrious, nor if he hold some distinguished office, nor if he plead any privilege from the sacred rescripts themselves, even if the granted forms be pragmatic—but with all the inhabitants of the city, namely those who are of some reputation, fulfilling this office in rotation, and when the rotation comes to an end returning to it again and undertaking the aforesaid office, so that the defensor may seem to be a judge rather than a defensor.
43:7
Decreto utique cum omnium communiter jurejurando facto, qui illius civitatis incolae sunt, non autem eorum qui ibi tantum commorantur. Jusjurandum vero praestet, omnia se secundum leges et jus acturum, et conlirmetuF (quemadmodum modo dicimus) jussione gloriosissimorum noslrorum præfectorum, et per biennium duntaxat administret, posteaque a sollicitudine removeatur, non habente licentiam clarissimo praeside provinciae removendi eum, sed tantum si quid parum recte agere videatur, referendi ad gloriosissimos praefectos, ut ab eo contingat sollicitudinis absolutio, a quo etiam datur.

Indeed, with a decree made by the common oath of all who are inhabitants of that city—but not of those who only sojourn there. Let him take an oath that he will do all things according to the laws and justice, and let it be confirmed (as we now say) by the command of our most glorious prefects; and let him administer for two years only, and afterward be removed from the office, the most illustrious governor of the province not having license to remove him, but only, if he seem to act somewhat improperly, to refer the matter to the most glorious prefects, so that release from office may come to him from the same source whence it is also given.
43:8
Nulla facultate existente vel moderationem provinciae habenti, vel ipsis defensoribus, ut defensorum vicarios constituant, sed haec illis omnibus prohibemus modis. Quin potius neque clarissimos praesides pro se vicarios in civitates dimittent, exceptis ipsis defensoribus, quos praesidum locum in civilatibus supplere volumus, ipsosque in omnibus civitatum in quibus sunt curam gerere. Item ut apud defensores insinuentur testamenta, donationes. ei omne denique quod proprie ad jus monumentorum pertinet, nequeunte clarissimo praeside provinciæ vel quod confici debet, impedire, vel præscribere, quomodo confici velit, vel confectum non edere.
無論掌管省份治理者,或護民官本人,皆無權設立護民官的代理人;我們以一切方式禁止他們眾人行此事。不僅如此,連最顯赫的省長也不可派代理人代己進入各城,唯獨護民官例外——我們意願他們在各城中補足省長的職位,並親自在他們所在的各城中料理一切事務。同樣,遺囑、贈與,以及凡正當屬於文書法範疇之一切,皆須存放於護民官處;最顯赫的省長既不可阻撓應當擬具之文書,也不可規定他願如何擬具,更不可在文書擬妥後拒絕發出。
There being no power, either for one holding the governance of the province, or for the defensores themselves, to appoint vicars of the defensores; but we forbid these things to them all by every means. Nay rather, let not even the most illustrious governors send vicars into the cities in their own stead, except the defensores themselves, whom we will to supply the place of the governors in the cities, and themselves to take charge of all things in the cities in which they are. Likewise, that wills, donations, and finally everything that properly pertains to the law of records be lodged with the defensores, the most illustrious governor of the province being unable either to hinder what ought to be drawn up, or to prescribe how he wishes it drawn up, or to refuse to issue it when drawn up.
43:9
Neque enim omnino ei licentiam ad ejasmodi praebemus, absurdissimum putantes ut necessaria acta hominibus propter praesidum forte affectiones praeceptionesque nulla ratione subnixas intercidat. Sed et in acta referant quaecunque quis voluerit, edantque, tametsi quod in acta refertur, perstringat ipsum provinciae praesidem, vel aliquem potentiorum, neque hoc quisquam prohibeat. Oportet enim eos qui vel in officiis, vel cum potestate aliqua suIt, ita se gerere, ut confici adversus se acta non prohibeant, imo ita se moribus inculpatos praebere, ut nemini detur opportunitas movendae alicujus contra ipsos querelæ.

For we by no means grant him license for such a thing, deeming it most absurd that necessary acts should be lost to men on account of governors' affections perchance, or of orders propped up by no reason. But let them also enter into the records whatever anyone shall wish, and let them issue them, even though what is entered into the records reflects upon the provincial governor himself, or upon some of the more powerful, and let no one prohibit this. For it behooves those who are either in offices, or possessed of some power, so to conduct themselves that they do not prohibit acts being drawn up against themselves; nay rather, so to show themselves blameless in their conduct that to no one is given occasion of raising any complaint against them.
43:10
Nemo insuper prohibeatur apud de fensores in acla referre, quibus de rebus vult, sive præses in civitatibus praesto sit, sive non sit, his solis exceptis quae jurisdictionem requirunt, et es ipsa praesidum auctoritate pendent. Deinde ut civitatum defensores iis qui publicarum exactionum negotium habent modis omnibus auxilio sint, et sive propter indevotorum collatorum contumaciam monumenta conficere, sive interesse et flagitiosos praesentibus oculis aspicere; sive publicum sedare tumultum opus sit, alacriter hoc faciant, uno denique verbo, per omnia praesidis locum obti neant, et maxime cum absunt.

Moreover, let no one be prohibited from entering into the records before the defensores concerning whatever matters he wishes, whether the governor be present in the cities or not present—these alone excepted which require jurisdiction and depend on the very authority of the governors. Next, that the defensores of the cities assist by every means those who have the business of public exactions, whether it be needful to draw up records on account of the obstinacy of undevoted contributors, or to be present and to look with present eyes upon the wicked, or to quell a public tumult—let them do this alacriously; in one word, let them in all things hold the place of the governor, and especially when he is absent.
43:11
Et ut cohortales quoque ei regioni addicti, qui per illam consistunt civitatpm, in qua defensor est, illi obediant et opem ferant, ut absentibus provinciarum moderatoribus nihil civitatibus deesse per illorum praesentiam videatur. Habeant autem et ex coborle illi provincix destinata exceptorem futurum illis in ministerio, et duos cohortales, qui ab ipsis judicata exsequantur. Dicantque jus in omnibus pecuniariis causis usque ad trecentos aureos, nequeuntibus collatoribus nostris eos quos sibi obligatos putant, protrahere ad clarissimos provinciarum praesides, si intra dictam trecentorum solidorum quantitatem causa consistat.
並且願那派駐該地區、住在護民官所在那城各處的衙役也順從他、給他援助,使各省的治理者雖不在,各城藉這些人的在場便似無所缺。願他們從派駐該省的衛隊中得一名書記(exceptor)在職務上供其差遣,又得兩名衙役執行他們所判定之事。願他們在一切錢財案件中審斷,直至三百金幣為止;我們的繳納人不得把他們認為對自己有義務之人,拖往各省最顯赫的省長那裡,只要案值在所述三百索利都之內。
And that the cohortales too, assigned to that region, who reside throughout that city in which the defensor is, obey him and bring him aid, so that, the moderators of the provinces being absent, nothing may seem lacking to the cities through their presence. And let them have also, from the cohort assigned to that province, a registrar (exceptor) to be at their service in the ministry, and two cohortales to execute the matters judged by them. And let them pronounce judgment in all pecuniary cases up to three hundred aurei, our contributors being unable to drag those whom they reckon bound to them before the most illustrious governors of the provinces, if the case stands within the said quantity of three hundred solidi.

Sed neque actores ea ipsa de re litem pluris estiment, ut reos conterant, non ad defensorem civitatis, sed ad loci praesidem deductos. Imo si quid tale fecerint, et sententia ostendat causain miuorem esse trecentis solidis, deditaque opera aestimationem ampliatam, ut apud præsidem provinciae, non aped civitatis defensorem examinaretur, solus actor totius litis subjiciatur dispendio. Enimvero appellationes a defensoribus ad ipsos deferantur praesules. Si quid vero cohortales eontra defensores contumeliose admiserint, tune provinciarum rectores vindiClam repetant, cohortalesque castigent.
但原告不可單為此故把訴訟估價高於其實值,以致藉著把被告帶往省長而非城邑護民官面前來壓垮他們。不僅如此,若他們行此類事,而判決顯示案值不足三百索利都,且其放大估價乃出於蓄意,為使案件在省長而非城邑護民官面前審理,則唯獨原告須承擔整個訴訟的費用。至於從護民官提出的上訴,當呈報省長本人。但若衙役對護民官蠻橫地做出任何事,省的長官便當追究刑責、懲治那些衙役。
But let not the plaintiffs value the suit at more than it is on this very account, in order to crush the defendants by having them brought, not before the defensor of the city, but before the governor of the place. Nay, if they do any such thing, and the verdict shows the case to be less than three hundred solidi, and that of set purpose the valuation was enlarged so that it might be examined before the governor of the province and not before the defensor of the city, the plaintiff alone shall be subjected to the expense of the whole suit. Indeed, let appeals from the defensores be referred to the governors themselves. But if the cohortales commit anything insolently against the defensores, then let the rectors of the provinces seek vengeance and chastise the cohortales.

Damus enim defensoribus licentiam, si hoc gentium praesides negligant, ea referre ad thronum excellentiae tuae, ut illis inde auxilium impertiatur et competens vindicta, et defensores revera habeant contra delinquenles quamdam judiciariae gravitatis imitationem et figuram. AC si civitatis defensorem contingat inter, cidere, protinus ad alium, qui ex ordine circuli vocatur, cum prædicto juramento decurrat calculus, protinusque is eam curam subeat. Decretum vero refcratur et roboretur a celsitudine tua. Neque ullo unquam tempore constituantur ( uti diximus) defensoribus vicarii, ne rursus absque ratione ansam priori perturbationi praebeamus.
因為我們授予護民官此權:若各邦的省長疏忽此事,便可將此類事呈報閣下的寶座,使援助與相稱的刑責從那裡賜予他們,且護民官對犯過者確實具有某種對司法威嚴的仿效與形象。倘若某城的護民官身故,便當立即以上述誓言,將籤運交給按輪次次序被召的另一人,使他立刻承擔此職。此判令當呈報閣下並由閣下確認。並且絕不可任何時候(如我們所言)為護民官設立代理人,免得我們再無理地為先前的紛擾留下把柄。
For we grant the defensores license, if the governors of the nations neglect this, to refer such matters to the throne of Your Excellency, so that from thence aid and fitting vengeance may be imparted to them, and the defensores may truly have, against offenders, a certain imitation and figure of judicial gravity. And if it happen that the defensor of a city dies, let the lot run forthwith, with the aforesaid oath, to another who is called from the order of the rotation, and let him forthwith undertake that charge. But let the decree be referred to and confirmed by Your Highness. And let vicars never at any time be appointed (as we have said) for the defensores, lest again without reason we afford a handle for the former disturbance.

Conficiat etiam jussiones excellentia tua per unamquamque provinciam, ut in civitatibus domus aliqua publica secernatur, in quam defensores deceat actorum suorum monumenta reponere, creato aliquo ibi locorum, penes quem hujus sit custodia, quo magis et incorrupta ea maneant, et celerius quaesita inveniantur. Sitque apud ipsos aliquod archivum, et quod hactenus in civitatibus peccatum est, modo ad pristinum statum reducatur. Fient autem et defensores omnino gratis. Et pro ipsis jussionibus, si inajores sint civitates, quatuor tantummodo aurei dabantur in judicio tuae celsitudinis; si minores, tres, quemadmodum nostris jam legibus constitutum est.

Let Your Excellency also issue orders throughout each province, that in the cities some public house be set apart, into which it may be fitting for the defensores to deposit the records of their proceedings, with someone created there in that place in whose keeping its custody shall be, so that they may both remain the more uncorrupted and be the more quickly found when sought. And let there be with them some archive, and let whatever has hitherto been amiss in the cities be now restored to its former state. And let the defensores be made altogether gratis. And in return for the orders themselves, if the cities be larger, only four aurei shall be given in the court of Your Highness; if smaller, three, as has already been established by our laws.
43:15
Si quas vero ex publico annonas habent, percipient et ipsas more solito. Cognoscent utique et de levioribus criminibus, et competentem castigationem adhibebunt. Sed eos, qui in majoribus delictis capiuntur conjicient in custodiam, et ad provinciae moderatorem transmittent.
若他們從公庫得有任何糧食配給,也當照慣例領受。他們同樣當審理較輕的罪行,並施以相稱的懲戒。但凡被捕犯有較重罪行者,他們當投入看守,並解送省的治理者。
And if they have any allowances of grain from the public store, they shall receive these too in the customary manner. They shall likewise take cognizance of lighter crimes and apply fitting chastisement. But those who are caught in greater offenses they shall cast into custody and transmit to the moderator of the province.

Ita enim quaeque pro se civitas judiciali cura fruetur, et universa gens sub majore constituta judice, majorem sentiet providentiam, et bona pars præsidalium curarum praescindetur, si civitatum defensores eas in se transponant, releventque curas praesidibus, quas pro populis gerunt, ipsi per partes vel ea quæ per injuriam admittuntur, componentes, vel disceptantibus dirimentes controversias (et prout saepe dictum est), per hoc eos qui officiis praesident honoratiores efficientes. Si qui etiam per indevotionem circa publica tributa solvenda segniores existant, eorum exactiones qui ita se indevotos praebent, gentium praesides demandent defensoribus, ut et in hoc ipsis auxilio sint.
因為這樣,各城自身便得享司法的照管,而全邦既置於更高的審判官之下,便感受到更大的眷顧;省長的職責也得削減大半——若各城的護民官把這些職責移轉到自己身上,並為省長卸下他們為各民所擔的職責,自己部分地或調解因侵害而生之事,或為訴訟雙方平息爭端(並且如屢次所言),藉此使主管官職者更受尊崇。倘若有人因缺乏忠順而在繳納公賦上更顯怠惰,各邦的省長便當把那些如此顯為不忠者的徵收託付護民官,使他們在此事上也成為省長的幫助。
For thus each city for itself will enjoy judicial care, and the whole nation, set under a greater judge, will feel a greater providence; and a good part of the governors' cares will be cut off, if the defensores of the cities transfer them onto themselves and relieve the governors of the cares which they bear on behalf of the peoples, themselves in part either composing the things committed through injury, or settling controversies for the litigants (and, as has often been said), through this making those who preside over offices more honored. If any too through lack of devotion become more sluggish in paying the public tributes, let the governors of the nations commit the exactions of those who thus show themselves undevoted to the defensores, so that in this also they may be of aid to them.
43:17
Caeterum si qua defensoris ordinatio praeter barc facta sit, aut is ad quem ex ordine defensoris creatio pervenit, prætextu dignitatis, vel militiæ, vel privilegii, vel alterius rei, eam sollicitudinem deprecetur, sciat ille quinque se librarum auri poenam subiturum, et nihilominus post ejus pecuniae in civitatis opera cessurae exactionem, cogendum defensoris expedire sollicitudinem. Convenit enim, ut honestiores quique civitatibus, quas incolunt, operam et ministerium suum exhibeant, et hanc quodammodo ipsis pro incolatu gratiam rependant.
至於其餘:若有護民官的任命違反這些條款而作出,或那按次序輪到被任為護民官之人,藉著尊銜、或軍職、或特權、或任何別的事為托辭而求免此職,便當知道他要受罰五磅黃金之刑;並且在徵收這筆要撥充城邑工程的款項之後,他仍要被強制履行護民官之職。因為理當由較尊貴之人向他們所居住的城邑獻上勞力與服事,並以此在某種意義上回報城邑容其居住之恩。
For the rest, if any appointment of a defensor be made contrary to these provisions, or if he to whom by the order the creation of defensor has come should, under pretext of dignity, or of military office, or of privilege, or of any other thing, beg off from that office, let him know that he will undergo a penalty of five pounds of gold, and none the less, after the exaction of that money to be devoted to the works of the city, that he shall be compelled to discharge the office of defensor. For it is fitting that the more honorable men render their effort and their service to the cities they inhabit, and in a manner repay them this favor in return for their dwelling there.
43:18
Quae igitur nobis placuerunt, et per hanc sacram exprimuntur legem, ea studeat excellentia tua per provincias quibus praeest, propriis destinatis jussionibus, manifesta facere, ut omnes cognoscant quod et maxima, et mediocria, et minima aeque nobis curai sint, nihilque ejus generis a sollicitudine nostra removeamus.
所以,凡令我們喜悅、並藉此神聖法律所表明之事,願閣下殷勤地藉著你親自發出的命令,在你所主管的各省中予以宣明,使眾人都知道:無論至大、適中、抑或至小之事,在我們眼中都同樣是當盡心的事,我們絕不把任何此類之事從我們的關切中除去。
The things, then, which have pleased us and are expressed through this sacred law, let Your Excellency be zealous to make manifest throughout the provinces over which you preside, by your own dispatched orders, so that all may know that both the greatest, and the moderate, and the least matters are equally a care to us, and that we remove nothing of that kind from our solicitude.
43:19
Assumet vero excellentia tua et hoc in partem tuarum jussionum, ut jam inde scilicet gentium praesides operam dent, quo magis hi defensores nominentur (in circulum scilicet, ut dictum est) de quibus bona est in quaque civitate opinio, et ut decreta in commune (iant una cum jusjurando ab ipsis praestando, neque non dictus circulus describatur, et ita singuli per biennium ordine eam sollicitudinem obeant. Ac si quis ex istis intercidat, in demortui locum alius sufficiatur, semper quidem decreto cum jusjurando conficiendo.
閣下也當把此事納入你命令的範圍:使各邦的省長從此盡力,使那些在各城中享有美譽之人更被任為護民官(即如所言,按輪次),並使判令與他們所當提供的誓言一同共同作出,又使所述輪次以文字記下,使各人依次任此職兩年。倘若其中有人身故,便當另立一人補替亡者之位,而判令仍當常與誓言一同擬具。
Your Excellency shall also take this into the scope of your orders: that henceforth the governors of the nations give their effort, that those defensores be the more named (in rotation, namely, as has been said) of whom there is a good opinion in each city, and that the decrees be made in common together with the oath to be furnished by them, and that the said rotation be set down in writing, and that thus individuals undertake that office in order for two years. And if any one of these dies, let another be substituted in the place of the deceased, the decree always indeed to be drawn up with the oath.
43:20
Ipso quoque, cum sollicitudinem suscepturus est, præfinitum jusjurandum subeunte, et creatione ejus a Dei amantissimo episcopo, et venerabili ctero, atque aliis, qui bonam in civitate opinionem obtinent, perficienda. Quod quidem et nunc continuo fieri convenit, omnibus (ut dictum est) secundum hanc nostram generalem legem procedentibus. Praeterea ut ii quoque, qui hoc etiamnum tempore defensores sunt, in circulum describantur, si ejusmodi videantur, qui placere possint, et sollicitudinem usque ad biennium continuent. Quod si jam biennium in ea cura comsumpserint, a defensoris sollicitudine dimoveantur, nisi communi ipsum decreto velint iu alterum quoque biennium in eodem detinere officio.

And he too, when he is about to undertake the office, taking upon himself the prescribed oath, and his creation being completed by the bishop most beloved of God, and by the venerable clergy, and by others who hold a good opinion in the city. This indeed ought even now to be done continually, all (as has been said) proceeding according to this our general law. Moreover, that those too who are defensores even at this present time be set down in the rotation, if they appear to be of such a kind as may be pleasing, and that they continue the office up to two years. But if they have already spent two years in that charge, let them be removed from the office of defensor, unless by common decree they wish to keep him in the same office for another two years also.
43:21
Si vero nondum biennium expleverunt, dignique videntur, qui in societatem circuli recipiantur, reliquum tempus compleant, ut tamen nemo ultra id civitatem defendat, sed ad hoc duntaxat tempus usque subsistat, nisi communis eum civitatis consensus nullo reclamante comprobet. Quod si fit, altero quoque biennio eam solliciludinem recipiet, et post id finitum omnino ea desistat, tunc demum rursus defensor futurus, cum ipse eum circulus in hunc reduxerit ordinem, ne perpetua ejus sollicitudinis continuatione, et fraudulenta per singula biennia renovatione, aliquibus praedicta administratio usque in infinitum extendatur.
但若他們尚未滿兩年,且顯為配得收入輪次團契之人,便當補足其餘的時間,只是要使無人為城邑護衛超過該期限,而僅維持至此時為止——除非全城一致同意、無人反對而認可他。若此事成就,他便當再受此職兩年,而那期滿之後便當全然停止此職,到那時才再次成為護民官,待輪次本身再把他帶回此次序——免得藉著其職務的永久延續、並藉著每兩年期的欺詐性續任,使上述職權對某些人無限延長。
But if they have not yet completed two years, and seem worthy to be received into the fellowship of the rotation, let them complete the remaining time, yet so that no one defend the city beyond that term, but subsist only up to this time, unless the common consent of the city, with none objecting, approve him. And if this is done, he shall receive that office for another two years also, and after that is finished let him wholly desist from it, then at last to be a defensor again when the rotation itself shall have brought him back into this order—lest by the perpetual continuation of his office, and by fraudulent renewal through each two-year period, the aforesaid administration be extended to infinity for some.
43:22

All these things holding good for all time, inasmuch as with the highest zeal, and vigilance, and by the goodwill of the Lord God toward us, we have devised them and granted them to our subjects.
