Si quis in conscribendo instrumento sese confessus fuerit non usurum fori præscriptione propter sacerdotii prærogativam, sancimus non licere ei adversus sua pacta venire, et contrahentes decipere, cum regula sit juris antiqui: Omnes licentiam habere his quæ pro se indulta sunt renuntiare. The same Augustus to John, Praetorian Prefect. If anyone, in drawing up a document, shall have confessed himself not to use the privilege of the forum by reason of the prerogative of the priesthood, we decree that it is not lawful for him to come against his own pacts and to deceive the contracting parties, since it is a rule of ancient law: that all have liberty to renounce those things which have been indulged in their favor. Which general law we decree shall hold good in all cases which have not yet been settled by a judicial sentence or an amicable agreement.
