41:1
Tester ego jurando omnipotentem Deum, et unigenitum Filium ejus Deum nostrum Jesum Christum, et Spiritum sanctum, necnoa sanctum, ac gloriosum Dei genitricem, et perpetuo virginem Mariam, et quatuor Evangelia, quae hisce manibus teneo, et sanctos archangelos Michaelem et Gabrielem, quod sacratissimis et pientissimus dominis nostris JustiaM, et Theodorae conjugi potentiae illius existenti, occaaione concessi mihi ab illorum pietate officii, puram conscientiam et genuinum praestaturus sum servitium. Quodque pro ipsorum imperio et republica, in coocesso mihi ab ipsis officio, summa cum animi promptitudine, sine dolo et absque fraude, omnem operam ac laborem subiturus sum.

I, swearing, call to witness Almighty God, and His only-begotten Son our God Jesus Christ, and the Holy Spirit, and also the holy and glorious Mother of God and ever-Virgin Mary, and the four Gospels which I hold in these hands, and the holy archangels Michael and Gabriel: that to our most sacred and most pious lords Justinian, and Theodora the consort of his power, I will, on the occasion of the office granted me by their piety, render a pure conscience and genuine service. And that, for their empire and commonwealth, in the office granted me by them, with the utmost readiness of mind, without guile and without fraud, I will undergo every effort and labor.
41:2
Et quod cum sanctissima Dei catholica, et apostolica Ecclesia communionem habeo, neque ei ulla unquam in re, aut modo adver. labor, neque (quantum in me erit) alicui alii permittam. Eodem juramento testor, quod neque occasione traditi mihi officii, neque per causam patrocinii, aut praestiti apud Dominum suffragii, ulli omnino quidquam, vel dedi, vel dabo, vel promisi, vel pactus sum ex provincia mittere, vel nuMam, sive gloriosissimi praefecti sunt, sive alii celeberrimi viri cum potestate existentes, sive circa illos versari soliti, sive quisquam omnium:

And that I hold communion with the most holy Catholic and Apostolic Church of God, nor do I ever in any thing or manner labor against it, nor (as far as it shall be in me) will I permit any other to do so. By the same oath I testify that neither on the occasion of the office handed to me, nor on the pretext of patronage, or of support rendered with the Lord, have I given, nor will I give, nor have I promised, nor have I made a compact to send anything at all out of the province to anyone whatsoever, or to a deputy—whether they be the most glorious prefects, or other most renowned men existing in power, or those wont to be conversant about them, or any one of all men:
41:3
sed quemadmodum gratuitum officium suscepi, ita et erga pientissimorum noslrorum dominorum collatores integrum me et sincerum exhibebo, constitutis mihi ex publico annonis contentus. Ac prae omnibus sane operam dabo ut tributis diligenter incumbam, et indevotos quidem ac compulsione indigentes cum omni vehementia exigam, in nullo eis cedens, neque omnino lucri captandi studio, vel per gratiam, vel odium, ullra quam convenit, sive petam ab aliquo, sive alicui remittam, devotos vero paterno quodam affectu complectar. Et subditos pientissimorum nostrorum dominorum (quantum in me erit) undique noxa, et damno liberos conservabo.

but, just as I have undertaken the office free of charge, so also will I show myself entire and sincere toward the contributors of our most pious lords, content with the allowances appointed me from the public funds. And above all I will indeed take pains diligently to attend to the tributes, and the undevout and those needing compulsion I will exact with all vehemence, in nothing yielding to them, nor at all out of any eagerness to snatch gain, whether through favor or hatred, more than is fitting—whether I demand from anyone, or remit to anyone—but the devout I will embrace with a kind of fatherly affection. And the subjects of our most pious lords (as far as it shall be in me) I will everywhere keep free from harm and loss.
41:4
Atque æquum me utrique parti, tam in disceptandis controversiis, quam tuenda disciplina publica praebens, neutri parti praeter jus et fas addictus ero, sed omnes delinquentes persequar, et æquitatem omni et parte conservabo, et prout mihi justum videbitur. Simul insontes, ne quid sentiant dispendii, tuebor, simul reis sontibus secundum leges irrogabo suppliclum. Et (ut dictum est) tam in publicis quam privatis contractibus: præteres et si fisco adferatur injuria, justitiam observabo. Neque ego tantum iste perficiam, sed etiam qui unquam mihi assident, quique drca me sumit, tales studebo assumere, ut non solus ego ionoeenter vivere, qui vero circa me sunt, rapere, et delinquere videantur.
並且我向雙方都顯為公平,無論是在裁決爭訟上,還是在維持公共秩序上,我都不超乎正理與神律地偏附任何一方,反倒必追究一切犯法者,並要全然且從各方面保守公道,照我所看為公正的去行。我一面必保護無辜者,使他們不受任何損失,一面必照律法向有罪的被告施以刑罰。並且(如所說的)無論在公約或私約上:此外,即使有損害臨到國庫,我也必持守公義。我不僅自己要成就這事,連那些隨時陪侍我者、並凡在我左右任職者,我也必竭力揀選這樣的人,免得只有我自己看似清白度日,而我左右的人卻看似劫掠與犯法。
And showing myself fair to either party, both in adjudicating controversies and in maintaining public discipline, I will be addicted to neither party beyond right and divine law, but will prosecute all offenders, and will preserve equity wholly and on every side, and as shall seem just to me. At once I will protect the innocent, that they may suffer no loss, and at once I will inflict punishment upon guilty defendants according to the laws. And (as has been said) both in public and in private contracts: moreover, even if injury be brought to the treasury, I will observe justice. Nor will I only myself accomplish this, but those also who ever sit beside me, and whoever takes up duty about me, such will I be zealous to take on, that not only I may seem to live innocently, while those who are about me seem to plunder and offend.
41:5
Si quis autem drca me talis invenietur, præstabo, quod ipse admisit, eumque abigam. Quod si non omnia haec, ut dixi, observavero, omnibus incommodis ero expositus, tam hic, quam in futuro saeculo, in torrendo judicio magni Domini Dei, et servatoris nostri Jesu Christi, habeboque partem cum Juda, et lepram Giesi, et tremerem Gain, ultra hoc, quod etiam peenis lege eorum pietatis comprehensis ero obnoxius. Scriptum exemplum hujus Dominico gloriosissimo per Illyricum prætoriorum præfecto.

But if anyone about me be found such, I will furnish what he himself committed, and will drive him away. But if I do not observe all these things, as I have said, I shall be exposed to all calamities, both here and in the age to come, in the terrible judgment of the great Lord God and our Savior Jesus Christ, and I shall have my portion with Judas, and the leprosy of Gehazi, and the trembling of Cain, over and above this—that I shall also be liable to the penalties comprehended in the law of their piety. A copy of this was written to Dominicus, most glorious praetorian prefect throughout Illyricum.
