127:1
Domi'ori orbis, praesuli et reparatori Ubertatis, senatui urbis Romae, Flavius Theodoricus Kex. Pervenit ad nos, patres conscripti, de ecclesiae missa utilitate suggestio, et nostrae mansuetudinis grata sacri coelus vestri ordinatio corda pulsavit. Et licet post venerabilem synodum ad hujusmodi decreta vestri sufficiat ordinatio sola judicii, tamen pro vestra hujusmodi præsentibus oraculis dedimus consolatione responsum; ut nulli fas sit Ecclesiæ cujuslibet antistiti sub qualibet alienatione de proprietate contractus usum fructum plane suum cui salva voluerint [Al., voverint æquitate praestabunt.
致世界之主、自由的統治者與恢復者,羅馬城的元老院,弗拉維烏斯·狄奧多里克王。蒙列入名籍的諸位父老啊,關於託付給教會的利益,有一項建議到了我們這裡,而你們神聖議會的慈惠安排叩動了我們仁慈之心。雖然在那可敬的會議之後,對於這類法令,你們判斷的安排本已足夠,然而為你們的緣故,我們仍藉當前的諭旨作出回應以資安慰;即:無論哪一教會的任何主教,皆不得在任何轉讓之下,明明白白地藉契約將自己產業的用益權指定給他所願給的任何人——當保全公正。
To the Lord of the world, the ruler and restorer of liberty, the senate of the city of Rome, Flavius Theodoric, King. There has come to us, conscript fathers, a suggestion concerning the utility entrusted to the Church, and the gracious ordinance of your sacred assembly has struck the hearts of our mildness. And although, after the venerable synod, your ordinance of judgment alone may suffice for decrees of this kind, nevertheless, for your sake we have given a response in the present oracles by way of consolation; that it be lawful to no prelate of any Church whatsoever, under any alienation, plainly to assign the usufruct of his own property by contract to whomever he may have wished — preserving equity.
127:2
Neque enim frustrari sola pontificis voluntate vel cieri pcregrinis debita omnibus vel statui Ecclesiae res delata. Quid enim tam profanum, quam ut hac largientis parte violetur arbitrium? Dum quod ad ecclesiam quisque voluit pertinere, privatae [prave] sive vindicent per usufructuariae personae contractum. Ergo si quis scelesiis ausibus interdicta praesumpserit, et ultra usumfructum retinere cupit, episcopo vel clero largiente I alienata res protinus cum fructibus a venerando praesule vindicetur. Et caetera. Data v Idus Martias Ravennae; Venantio v. c. consule (anno Christ. 507).
因為所捐贈的財物——即虧欠一切外來寄居者、或歸於教會產業之物——也不當僅憑教宗或教士的意願而落空。還有什麼比這更褻瀆,即在施與者一方,他的旨意竟遭破壞?以致凡有人願其歸屬教會之物,私人〔或作:邪惡之人〕竟藉用益權者的契約據為己有。因此,倘若有人以邪惡的膽量擅取所禁之事,並圖在用益權之外保留,那由主教或教士所捐贈而轉讓的財物,便當立刻連同其孳息由可敬的主教收回。其餘從略。賜於三月之望前第五日,於拉文納;至顯赫之人維南提烏斯執政(主後五〇七年)。
For neither ought the property bestowed to be frustrated by the mere will of the pontiff or of the clergy — property owed to all foreign sojourners or to the estate of the Church. For what is so profane as that, on the part of the giver, his judgment should be violated? While whatever anyone has wished to pertain to the Church, private [or: perverse] persons should claim it through the contract of a usufructuary person. Therefore if anyone shall presume the things forbidden by wicked daring, and shall desire to retain beyond the usufruct, the property alienated by the bishop or clergy as a gift shall straightway, together with its fruits, be reclaimed by the venerable prelate. And the rest. Given on the fifth day before the Ides of March, at Ravenna; Venantius, most distinguished man, being consul (in the year of Christ 507).
