48:1
In nomine Domini Jesu Christi Dei nostri, imperator Cæsar Flavius Justinianus, Alemanicns, Gotbicus, Francicus, Germanicus, Anticus, Alanicus, Wandalicus, Africus, Pius, felix, gloriosus, victor, triumphator, semper Augustus, Mennæ patriarchæ. et illud habemus, imperialibusque id legibus corroboramus, perinde quasi ab ipsa majestate imperatoria prodiisset. Quod si quis eorum adversus haec statuta deprehendatur delinqueret, sciat quod in civiles leges incidet, quae in majorem indignationem et animadversionem conjiciunt eos qui poenas leviores declinant.

In the name of the Lord Jesus Christ our God, the Emperor Caesar Flavius Justinianus, Alemannicus, Gothicus, Francicus, Germanicus, Anticus, Alanicus, Vandalicus, Africanus, Pious, Fortunate, Glorious, Victor, Triumpher, ever Augustus, to Mennas the patriarch. And this too we hold, and corroborate it by imperial laws, just as though it had proceeded from the imperial majesty itself. But if any of them be caught transgressing against these statutes, let him know that he will fall under the civil laws, which cast into greater indignation and chastisement those who evade the lighter penalties.
48:2
PORRO omnibus qui vel secundum doctrinam dementis Nestorii, vel secundum stolidam traditionem Eutychetis, vel secundum Severi, qui idem cum iilis sentit, aut illos sequentium blasphemiam, catholicam Dei Ecclesiam conantur divellere, prohibemus ne tumultus Ecclesiis immittant, aut de fide aliquid disscrant. Sed sancimus ut unusquisque eorum sileatium agat, et neque ullos in unum convocent, neque adeuntes recipiant, neque improbato more baptizare, aut sacram communionem defœdare, et aliquibus eam distribuere, aut vetitas doctrinas explanare audeant vel in regia hac nostra urbe, vel alia, sed nihil non periculi revereantur, si quid tale perpetraverit.

Furthermore, to all who attempt to tear apart the catholic Church of God—whether according to the doctrine of the demented Nestorius, or according to the foolish tradition of Eutyches, or according to the blasphemy of Severus, who holds the same opinion as they, or of those who follow them—we forbid that they stir up tumults in the churches, or discourse anything concerning the faith. But we ordain that each one of them keep silence, and that they neither convoke any into one assembly, nor receive those who come, nor dare to baptize after a disapproved manner, nor to defile holy communion and distribute it to any, nor to expound forbidden doctrines, whether in this our royal city or in another, but let them fear every peril if they perpetrate any such thing.
48:3
Omnibus insuper prohibemus ne quis hunc recipiat. Quin potius sancimus ut ex urbibus etiam, quæ ab iPsis seducuntur, ejiciant: scientes poenas sacris nostris jam comprehensas constitutionibus, quæ ipsas etiam domus in quibus tale quid peragitur, ct prædia ex quibus alimenla suppeditantur, sacrosanctis addicunt Ecclesiis, suis adimenda possessoribus, quia simplicioribus causam mali pracbeut; optimo vero jure sub dominium sacrosanctarum eas Ecclesiarum deducentes. Hæc nos pro communi sacrosanctarum Ecclesiarum pace sancimus, haec decernimus sanctorum Patrum decreta secuti, ut omnes de cætero sacerdotes sub tranquillitate et quiete permaneant;

We forbid all men besides that anyone receive him. Rather we ordain that they cast them out even from the cities which are being seduced by them: knowing the penalties already comprehended in our sacred constitutions, which assign to the most holy churches the very houses in which any such thing is done, and the estates from which sustenance is supplied, to be taken away from their possessors, because they furnish to the simpler folk a cause of evil; and by the best right bringing these under the dominion of the most holy churches. These things we ordain for the common peace of the most holy churches, these we decree, following the decrees of the holy Fathers, that all priests henceforth may abide in tranquillity and quiet;
48:4
quibus ipsis in pace conservatis, reliqua etiam reipublicae portio nobis pergliscet, pace desuper vigescente, quam omnibus magnus ille Deus et Servator noster Jesus Christus, unus de Trinitate, unigenitum Dei verbum, tam praedicat quam suppeditat his qui vere et ex animo glorificare ipsum et adorare dignatur. Quae igitur recte nobis placuerunt, ea beatitudo tua conservato, et ad effectum deducito, per Dei amantes suas litteras ea omnibus sub se constitutis rcligiosissimis metropolitanis transmittens.

and when these are preserved in peace, the remaining portion of the commonwealth too will grow for us, as peace flourishes from above—peace which to all that great God and our Savior Jesus Christ, one of the Trinity, the only-begotten Word of God, both proclaims and supplies to those who are deemed worthy to glorify and adore Him truly and from the heart. Therefore the things that have rightly pleased us, let Your Beatitude preserve and carry into effect, transmitting them through your God-loving letters to all the most religious metropolitans subject to you.
48:5
Quorum unicuique curæ erit sacrosanctis sub se constitUtis Ecclesiis haec manifesta facere, ut neminem omnium lateam quae summum sacerdotium decreverit, quæ item majestas imperatoria corroboraverit. The care of each of these will be to make these things manifest to the most holy churches subject to him, so that none of all may be unaware of what the supreme priesthood has decreed and what the imperial majesty has corroborated. Given on the seventeenth day before the Kalends of August, at Constantinople, in the consulship of Belisarius, most illustrious man. CHAPTER ONE.—Doing a thing not unusual for the empire, we also have come to the present law. For as often as the sentence of the bishops deposed certain men unworthy of the priesthood from the sacred sees (such as Nestorius, Eutyches, Arius, Macedonius, and Eunomius, and certain others no less than they in iniquity), so often was the empire of one mind with the sentence and ordination of the bishops, along with the authority of the bishops.
48:6
Sicque divina et humana pariter concurrentia unam consonantiam rectis sententiis fecere: quemadmodum et nuper factum esse circa Anthimum scimus, qui quidem dejectus est de sede hujus regiae urbis sanctæ et gloriosae memoriæ Agapito sanctissimae ecclesiae antiquæ Romae pontifice; eo quod nullo modo sibi ipsi convenienti (contra omnes sacros canones) se intruserat sedi, sed et communi sententia ipsius sanctae memoriæ viri primum, atque etiam sacrae synodi hic celebratae condemnatus et depositus fuit, eo quod a rectis dogmatibus recessit; et quae prius multoties diligere videbatur, hæc demum diversis lustrationibus [ fraudibus ] fugit;

And thus things divine and human, concurring alike, made a single harmony with right verdicts: just as we know happened lately concerning Anthimus, who was indeed cast down from the see of this royal city by Agapetus of holy and glorious memory, the pontiff of the most holy ancient Church of Rome; because he had intruded himself (against all the sacred canons) into a see in no way befitting him, and was condemned and deposed both by the common sentence of that man of holy memory first, and also of the sacred synod celebrated here, because he had departed from the right doctrines; and the things which before he seemed many times to love, these at last by various pretenses [frauds] he fled;
48:7
simulans sequi sanctas quatuor synodos (trecentorum videlicet decem et octo Patrum in Nicaea, et centum quinquaginta in hac felici civitate; ct in Epheso primo congregatorum ducentorum.et sexcentorum triginta venerabilium Patrum in Chalcedone). At quidem nec istorum dogmata sequi, nec nostram clementiam et cond scensum, quein propter ipsius salutem habebamus, suscipere voluit; neque ipse abdicare auctores impiorum dogmatum, qui prius a sanctis synodis expulsi fuerant; sed putavit oportere secundum ipsum et in aequali ducere et condemnatos, et condemnatores.

pretending to follow the four holy synods (namely of the three hundred and eighteen Fathers at Nicaea, and of the one hundred and fifty in this happy city; and of the two hundred first gathered at Ephesus, and of the six hundred and thirty venerable Fathers at Chalcedon). Yet in fact he was willing neither to follow the doctrines of these, nor to receive our clemency and the condescension which we had for the sake of his salvation; nor was he himself willing to renounce the authors of the impious doctrines, who had previously been expelled by the holy synods; but he thought it fitting, according to his own view, to hold both the condemned and the condemners as equal.
48:8
Nam semel alienis a sanctissima Ecclesia intellectibus mancipatus, et a rectis dogmatibus alienatus, merito ad ipsorum rectitudinem reverti non valuit, etiam ad haec invitatus a nobis et directus, qui omni studio usi sumus ad ipsius salutem. Propter haec igitur omnia, sententiam depositionis in ipsum a sancta synodo factam occasionem non liciti, neque a sanctis canonibus approbati raptus sacrarum sedium hujus regiae urbis, et aversionis a rectis et veris dogmatibus, firmam nostrum reddit imperium, et contra istum praesentem scribit legem.

For once he had been enslaved to understandings foreign to the most holy Church, and alienated from the right doctrines, he was deservedly unable to return to their rectitude, even when invited and directed to this by us, who used every zeal for his salvation. On account of all these things therefore, our empire renders firm the sentence of deposition made against him by the holy synod—on the occasion of the unlawful and not canonically approved seizure of the sacred sees of this royal city, and of his turning away from the right and true doctrines—and writes the present law against this man.
48:9
Interdicimus autem et ei commorari in hac felici civitate et ejus districtu, ac in quacunque alia insigni civitate sancientes in quiete esse, et iis contentum esse, quibus seipsum merito obnoxium reddidit; et non aliquibus communicare, neque eos imbuere in perditionem interdictorum dogmatum. Nec utique extra imperialem confirmationem relinquimus sententiam juste contra Severum latam, ac ex omnibus (ut ita dicamus) pontificalibus et patriarchalibus (una cum monachicis consensibus) provenientem sedibus, et anathematismum ipsi inferentem:

We forbid him also to dwell in this happy city and its district, and in any other notable city whatever, ordaining that he be in quiet and content with those things to which he has deservedly made himself liable; and that he communicate with no one, nor imbue them unto the perdition of the forbidden doctrines. Nor indeed do we leave outside the imperial confirmation the sentence justly pronounced against Severus, proceeding from all (so to speak) the pontifical and patriarchal sees (together with the monastic consents) and inflicting the anathema upon him:
48:10
qui prius contra sacras sanctiones accipiendo sedein sanctissimæ ecclesiae Theopolitanorum, sic universa conturbavit, sicque accumulatas turbationes fecit, ut commune quondam ac abominabile bellum sanctissimis Ecelesiis ad invicem immitteret. Et hoc etiam a sceptris quae ante nos fuerunt contra ipsum scriptum erat, variis dogmatum et a rectitudine alienatis fraudihus et conunentis ac blasphemiis usum fuisse, ac universa conturbasse, et illum quemcunque errorem abominabilium hæresiarcharum et in'quorum dogmatum recipere, Nestorii dicimus, et Eutychis;

who, having first against the sacred sanctions received the see of the most holy Church of the Theopolitans, so threw all into confusion, and so heaped up turbulences, that he sent forth among the most holy churches a kind of common and abominable war one against another. And this too had been written against him by the scepters that were before us—that he had used various deceits, devices, and blasphemies belonging to doctrines alienated from rectitude, and had thrown all into confusion, and received whatever error of the abominable heresiarchs and of iniquitous doctrines, of Nestorius, we say, and of Eutyches;
48:11
et cum uterque horum præcoptorum contrarii quodammodo invicem esse videamur, ad unum vero impietatis finem tendant, etiam illorum divulgatos sermones, eum in unum formavisse. Duobus enim existentibus dogmatibus ad invicem repugnantibus, quorum utrumque similiter ad animae perditionem adducit, Nestorii videlicet et Eutychis ( quemadmodum dicendo narravimus) qui ex Arianorum et Apollinarii contagione consistunt; ipse paradoxum quid perpessus iu utrumque similiter incidit: et ibi quidem illud mittendo, seipsum et sermones suos visus cst constituisse commune receptaculum tantorum delictorum.

and although both of these doctrines seem in a manner contrary to one another, yet they tend toward one end of impiety, and he formed into one even the divulged discourses of those men. For since there are two doctrines mutually repugnant, each of which likewise leads to the perdition of the soul—namely of Nestorius and of Eutyches (as we have related in our account)—which consist of the contagion of the Arians and of Apollinaris; he himself, suffering something paradoxical, fell alike into both: and there, by setting forth that doctrine, he is seen to have constituted himself and his discourses a common receptacle of so great offenses.
48:12
Sit itaque et ipse sub praedicto anathematismo, quem universus patriarchalis, pontificalis, ac monachicus nostrae, ut ita dicamus, reipublicae cœlus juste in ipsum induxit: de Theopolitana quidem Ecciesia ejectus, idcirco quod thronus illius ipsum removit, eo quod ipsius principatum recte non acceperat, sed adhuc vivente eo, et in sanctissimis Ecclesiis commemorato, qui ante ipsum sacerdotium habebat, et propter eum qui post ipsum fuit, de sacerdotio exciderat. Nec vero progressus huc usque substitit, sed et sub communi orthodoxae ac catholicae Ecclesiae anathematismo positus, multis libris, blasphemiisque et abominationibus nobis rempublicam implevit.

Let him therefore also be under the aforesaid anathema, which the whole patriarchal, pontifical, and monastic assembly of our commonwealth, so to speak, justly imposed upon him: cast out indeed from the Theopolitan Church, because its throne removed him, in that he had not rightly received its headship, but while he was still living and commemorated in the most holy churches—he who held the priesthood before him—and on account of him who came after him, he had fallen from the priesthood. Nor indeed did he stop at this point, but, having been placed also under the common anathema of the orthodox and catholic Church, he filled our commonwealth with many books, blasphemies, and abominations.
48:13
Quare universis interdicimus aliquid de libris ipsius possidere. Et sicut non lcet Nestorii libros scribere, vel possidere ( quia praedecessoribus nostris imperatoribus in suis constitutionibus visum est statuere similia his quæ dicta et scripta sunt a Porphyrio in Chrisiianos), sic nec dicta et scripta Severi maneant penes aliquem Christianum, sed sim profana et aliena ab Ecclesia catholica, igneque comburantur a possidentibus, nisi qui ipsa habent, velint periculum pati. A nemine ergo scribantur, neque ad pulchritudinem, neque ad velocitatem scribentium, sciendo quia ampulatio mauus his qui scripta ejus scripserint, pœna erit.

Wherefore we forbid all men to possess anything of his books. And just as it is not lawful to write or possess the books of Nestorius (because to our predecessor emperors it seemed good in their constitutions to enact things similar to those concerning what was said and written by Porphyry against the Christians), so neither let the sayings and writings of Severus remain in the keeping of any Christian, but let them be profane and alien from the catholic Church, and burned with fire by their possessors, unless those who have them wish to suffer peril. Let them therefore be written by no one, neither for beauty nor for speed of the writers, knowing that the cutting off of the hand will be the penalty for those who write his writings.
48:14
Neque enim volumus in futuro tempore ex illis blasphemiam protrahi. Similiter autem et huic interdicimus omnino regiam civitatem ingredi, aut districtum ej is, nec aliquam aliam de insignibus, sed in aliqua solitudine et in silentio sedere, et non corrumpere caeteros, neque in blaspbemiam ipsos adducere, et non semper aliquid novi invenire contra vera dogmata, per quod rursus nobis conturbare sanctissimas Ecclesias festinet. CAP. II. — Sed nec Petrum episcopum Apamiae, et simul ab ipsis, a quibus Severus, sub prædictu anathemate positum, imperium admittit, sed sint valida quæ contra ipsum fuere staduta. El qui sub communi anathematismo positus esi, sub ipso eslo;

For we do not wish that in time to come blasphemy should be drawn forth from them. Likewise we forbid this man too altogether to enter the royal city, or its district, nor any other of the notable cities, but to sit in some solitude and in silence, and not to corrupt the rest, nor to lead them into blasphemy, and not always to invent something new against the true doctrines, whereby he might hasten again to throw our most holy churches into confusion. CHAPTER II.—But neither does the empire admit Peter, bishop of Apamea, placed under the aforesaid anathema together with, and for the same causes as, those for whom Severus was; rather let the things that were decreed against him be valid. And let him who has been placed under the common anathema be under it;
48:15
et sententia sanctissimorum pontificum, quæ ipsum prævenit, firma permaneto. Neque vero permiuimus illi hanc regiam urbem habitare, aut ipsius districtum, vel aliquam de insignibus; sed quorum secutus est errorem, horum imitetur victus rationem, quam longissime abscedens et occultans seipsum; nam talibus occultari, quam videri utilius est. and let the sentence of the most holy pontiffs, which preceded him, remain firm. Nor indeed do we permit him to inhabit this royal city, or its district, or any of the notable cities; but let him imitate the manner of life of those whose error he followed, withdrawing as far as possible and hiding himself; for it is more useful for such men to be hidden than to be seen. For while unknown, they harm themselves alone: but in publishing their doctrines, they afford to many of the simpler folk an occasion of perdition; which it is in no way just should come to pass in the Christian sheepfold of God and among an orthodox people, nor is it permitted by the empire. CHAPTER III.
48:16
Quoniam vero et Zoaram dignum penitus judicarunt sub anathematismo esse reverendissimi, et qui justa judicant episcopi (cum parva quaedam talium malorum interpositio sil), et in quibus dehonestatus est, omnia videlicet comprehendo ex memoria quadam abundanti; sit et Zoaras interpositio quaedam parva hujus malae parlis (Anthimi dicimus et Severi ac Petri), et numeremur ipse quoque inter anathematizatos, sacra sententia ipsum dejiciente: quam firmam et ipsam ex seipsa existentem, adhuc firmiorem imperium reddit: et hunc de hac regia urbe et ejus districtu abjicit, et habilationem in aliis civitatibus ipsi omnino interdicit;

—And since the most reverend bishops, who judge justly, deemed Zooras also wholly worthy to be under anathema (since there is a small interposition of such evils), and in the things wherein he was dishonored, comprehending all, namely from a certain abundant memory; let Zooras too be a certain small interposition of this evil party (we mean of Anthimus and Severus and Peter), and let him too be numbered among the anathematized, the sacred sentence casting him down: which sentence, firm and existing of itself, the empire renders yet firmer; and it casts this man out of this royal city and its district, and altogether forbids him habitation in other cities;
48:17
itaque cum illis solis habitet et consultet qui a nobis ante memorati sunt: qui similia quidem blasphemant, similia vero patiuntur, et similiter in exilium mittuntur. Si quid vero aliud in sententia sanctissimorum episcoporum continetur, quæ prædictos deponit, et anathematizat, hoc firmius reddi mus et diutius, ac imperialibus nostris legibus ipsum corroboramus, ac si ab imperio ipso provenisset. Si vero aliquis ipsorum deprehendatur de cætero facere aliquid praeter constituta, sciat se incidisse in leges imperiales, quae minores poenas declinantes, ad majores immittunt indignationes.
使他只與我們先前所提及的那些人同住、共議:那些人以同樣的方式褻瀆,以同樣的方式受苦,也以同樣的方式被放逐入流亡。倘若至聖眾主教的判決——那廢黜並咒詛前述之人的判決——中還含有其他任何內容,我們也使之更為堅固、更為長久,並以我們皇帝的法律加以鞏固,如同它出於帝國本身一般。倘若他們中有人此後被查出做任何違背法令之事,當知道他已落在皇帝的法律之下;這些法律把那些躲避較輕刑罰的人,投入更大的義憤之中。
so that he may dwell and take counsel only with those alone whom we have mentioned before: who blaspheme in like manner, suffer in like manner, and are sent into exile in like manner. And if anything else is contained in the sentence of the most holy bishops, which deposes and anathematizes the aforesaid men, this we render firmer and more lasting, and corroborate it by our imperial laws, as though it had proceeded from the empire itself. But if any of them be caught henceforth doing anything contrary to the statutes, let him know that he has fallen under the imperial laws, which cast those who evade lesser penalties into greater indignations.
48:18
Interdicimus autem et omnibus conantibus catholicam Dei Ecclesiam divellere (sive secundum Nestorii hæretici doctrinam, sive secundum insensati Eutychis traditionem, sive secundum blasphemiam Severi, qui et similia illis intellexit, aut eorum qui illos sequUntur), seditionem inmittere sanctissimis Ecclesiis, et loqui aliquid de fide; sed sancimus quemlibet talium quietum esse. et non convocare aliquos ad se, neque accedentes recipere, aut perperam baptizare audere, aut sacram communionem sordidare, et ipsam aliquibus tradcre, aut interdictas doctrinas exponere sive in hac nostra regia, sive in alia civitate; sed omne periculum reformidare, si quid tale faciat.

Furthermore we forbid all who attempt to tear apart the catholic Church of God (whether according to the doctrine of the heretic Nestorius, or according to the tradition of the senseless Eutyches, or according to the blasphemy of Severus, who also understood things similar to theirs, or of those who follow them) to send sedition into the most holy churches, and to speak anything concerning the faith; but we ordain that any such man be quiet, and not convoke any to himself, nor receive those who approach, or dare to baptize wrongly, or to defile holy communion and deliver it to any, or to expound forbidden doctrines, whether in this our royal city or in another city; but to dread every peril, if he do any such thing.
48:19
Interdicimus etiam omnibus, ne istos suscipiant. Abjici ergo ipsos sancimus de civitatibus ab ipsis concitatis, scientes pœnas jam contentas in nostris divinis constitutionibus, quae et domos ipsas, in quibus tale quid fit, et campos ex quibus nutrimenta praebentur, sanctissimis Ecclesiis assignant, et a possidentibus auferunt, quia detrimenti causa fit simplicioribus; sanctissimis vero et orthodoxis Ecclesiis haec juste subjiciunt. Haec pro communi pare sanctissimarum Ecclesiarum statuimus, hæc decernimus, sequentes sanctorum Patrum dogmata, ut omne sacerdotium imperturbaium de cætero nobis permaneat. Quo in pace servato, reliqna nobis exuberabit respublica desuper pacem habens:
我們也禁止眾人接待這些人。因此我們命定,要把他們從那些被他們所煽動的城市中驅逐出去,並知道我們聖敕令中已包含的刑罰,這些刑罰把凡行此類事的房屋本身、以及供給養生的田地,判歸至聖教會,並從其持有者手中奪去,因為這給較單純的人帶來損害的緣由;卻公正地把這些置於至聖而正統的教會之下。我們為著至聖教會的共同平安而設立這些,照著聖教父的教義而頒佈這些,使一切聖職此後得以為我們存留而不受攪擾。當這在平安中得蒙保守時,邦國其餘的部分也必為我們滿溢,自上而下得享平安:
We forbid all men also that they receive these men. We therefore ordain that they be cast out of the cities stirred up by them, knowing the penalties already contained in our divine constitutions, which assign to the most holy churches the very houses in which any such thing is done, and the fields from which nourishment is supplied, and take them away from their possessors, because the cause of detriment arises for the simpler folk; but justly subject these to the most holy and orthodox churches. These things we establish for the common peace of the most holy churches, these we decree, following the doctrines of the holy Fathers, that all priesthood may henceforth remain for us undisturbed. And when this is preserved in peace, the rest of the commonwealth will overflow for us, having peace from above:
48:20
quam omnibus magnus Deus et Salvator noster Jesus Christus Trinitatis unus, unigenitus Dei Filius praedicat, ac donat [Al., praebeat ac donet] his qui sincere ipsum et vere glorificare ac adorare digni habiti sunt. Custodiat itaque bealitudo tua, quæ recta adnotata sunt; et mittat ipsa per suas Deo dilectas litteras omnibus sanctissimis metropolitis sub ipsa existentibus: quorum cuilibet cura erit ipsa manifesta facele sanctissimis Ecclesiis sibi subjectis, ut neminem et omnibus lateant quae sacerdotio visa sunt et ab imperio confirmata.
這平安乃那位偉大的神、我們的救主耶穌基督,三位一體中的一位,神的獨生子,向凡蒙算為配得真誠而真實地榮耀並敬拜祂之人,所宣告並所賜下的〔異文:願祂供應並賜下〕。因此,願閣下保守那些被記下的正當之事;並願閣下藉著閣下愛神的書信,把這些送給一切在閣下之下、至聖的都主教:他們每一位的職責,就是把這些事向在他之下的至聖教會公佈,使聖職所認為善、並蒙帝國確認之事,不向眾人中任何一人隱藏。
which peace that great God and our Savior Jesus Christ, one of the Trinity, the only-begotten Son of God, proclaims and grants [variant: may He furnish and grant] to all those who have been deemed worthy sincerely and truly to glorify and adore Him. Therefore let Your Beatitude preserve the right things that have been noted down; and let it send them through your letters beloved of God to all the most holy metropolitans existing under it: the care of each of whom will be to make these things manifest to the most holy churches subject to him, so that what has seemed good to the priesthood and been confirmed by the empire may be hidden from no one of all.
