91:1
Imperator Justinianus Augustus Mennae.
The Emperor Justinian Augustus to Mennas, Praetorian Prefect. If indeed the person who is recorded to have counted out money or to have given other things be present, but should be administering some office in the provinces, so that it seems difficult to send him notice concerning the money not counted out, we give licence to the one who wishes to make use of the said exception, to approach other judges, and through them to make manifest to him that he raises an exception of this kind — namely, that a complaint has been made by him concerning money not counted out. But if there be no other civil or military administrator, or if for some cause it be difficult for the one who raises the said complaint to approach him and to do the things that have been said:
91:2
Datum Kalend. Jul., Constantin., do. Justiniano A. II cos. 528.
we give licence also to make manifest the same exception to the creditor through the most reverend bishop, and thus to interrupt the appointed time. §1. This has also been received as having a place in the exception of dowry not counted out. Given on the Kalends of July, at Constantinople, in the second consulship of our lord Justinian Augustus, in the year 528.
