44:1
Idem imperator Anthemio sacratissimo et beatissimo archiepiscopo Constantinopolitano et universi ejns tractus patriarchae. Legem nuper de mensura ordinationum conscripsi mus, quodque nec in sacrosancta majore ecclesia, neque in aliis effusas eas esse conveniat. Quam sane ratam manere, et pro universo suo tenore firmitatem obtinere etiamnum volumus.
同一位皇帝致安提繆斯,君士坦丁堡至聖至福的大主教、其全管區的宗主教。我們近日寫了一條關於聖職按立數目的法律,並指明無論在至聖的大教會、或在其他教會,按立都不可濫施。這事我們如今仍意願它保持有效,並按其全部要旨持守其效力。
The same emperor to Anthemius, most sacred and most blessed archbishop of Constantinople and patriarch of his whole district. We lately wrote a law concerning the measure of ordinations, and that it is fitting that they be not lavished, neither in the most holy Great Church, nor in the others. This indeed we will even now to remain ratified, and to obtain firmness according to its whole tenor.

Quoniam vero intendimus ordinationes in arctum contrahere, indeque expensarum exuperantiam ad mediocrem et tolerabilem quantitatem sacrosanctae majori ecclesiae reducere, quo magis sumptuum illi multitudo minuatur, propterea per omnes undique vias oberrantes, tandem ad hanc etiam praesentem legem pervenimus, non quidem plane diversam a priore, sed quae ex eodem profecta proposito, aliquando amplius sacrosanctae majori prodesse possit ecclesiae.
但因我們有意將按立限於狹窄的界限之內,並由此把開支的過量縮減至一個適中且可承受的數額,以利於至聖的大教會,使其費用之眾得以更加減少;為此故,我們遍尋各路,終於得出這條現行的法律——它與前一條並非全然不同,乃是出於同一宗旨,有時或能更使至聖的大教會獲益。
But since we intend to confine the ordinations within narrow bounds, and thence to reduce the excess of expenses to a moderate and tolerable amount for the most holy Great Church, that the multitude of its costs may be the more diminished, on this account, wandering everywhere through all ways, we have at last come even to this present law—not indeed wholly different from the former, but one which, proceeding from the same purpose, may sometimes be able to profit the most holy Great Church yet more.
44:3
Sancimus enim, si in una aliqua sacrosanctarum ecclesiarum, quarum administrationem simul et expensas eadem sacrosancta major ecclesia sustinet, presbyierum, aut diaconum, aut lectorem, aut cantorem niori contigerit, ne statim alius extrinsecus introducatur. sed prius heatitudo tua despiciat, quam magnus adhuc venerabilium clericorum sit numerus, qui illic ministrant. Ac si nondum quidem clericorum numerus deminutus est, sed quo ad numerum ab initio definitum et (ut vocant) statutum, quidam etiamnum superfluunt, ne qua in ejus locum instituatur ordinatio, donec numerus sibi ipsi restituatur.
因為我們頒令:若在至聖諸教會中任何一所——其行政與開支乃由同一至聖大教會一併維持者——遇有長老、或執事、或讀經員、或詠唱員身故,不可立即從外另引入一人;而當先由閣下察看那裡供職的可敬聖品人尚有多少。倘若聖品人之數尚未減少,而就起初所定、(如他們所稱的)已固定的員額而言,仍有某些人多餘,便不可在其位上設立按立,直到員額自行復滿為止。
For we ordain that, if in any one of the most holy churches—whose administration and expenses the same most holy Great Church together sustains—it happen that a presbyter, or a deacon, or a lector, or a cantor should die, another be not at once brought in from outside; but first let Your Blessedness consider how great is still the number of venerable clerics who minister there. And if indeed the number of clerics has not yet been diminished, but as regards the number defined from the beginning and (as they call it) fixed, certain ones still remain superfluous, let no ordination be instituted in his place, until the number be restored to itself.
44:4
Si vero muhitudo ita deminuta est, ut in defuncti locum alium cIeri cum introduci necesse sit, ne quid statuto desit, beatitudo tua dispiciat, an citra sacrosanctam majorem ecclesiam ejusdem ordinis clericus in aliis ecclesiis inveniatur superfluus, et exinde in demortui locum aljum sublegat, non autem novam ordinationem celebret. Eo enim pacto si id, cui deest, ex- eo suppleatur, cui superfluit, bella quaedam neque Deo ingrata commensuratio imponetur negotio, et sacrosancta major ecclesia paulatim ære alieno liberabitur.
但若人數已減少至必須引入另一聖品人來補替亡者、免得固定員額有缺,便當由閣下察看:除至聖大教會之外,是否在其他教會中尋得同一品級多餘的聖品人,並由此另揀一人補替亡者之位,而不舉行新的按立。因為藉此安排,若以有餘之處補不足之處,便為此事加上某種美好、且不為神所不悅的均衡,而至聖的大教會也漸漸得從其債務中釋放。
But if the multitude has been so diminished that it is necessary for another cleric to be brought in in place of the deceased, lest anything be lacking to the fixed number, let Your Blessedness consider whether, apart from the most holy Great Church, a cleric of the same order be found superfluous in the other churches, and thence choose another in place of the deceased, and not celebrate a new ordination. For by this arrangement, if that which lacks be supplied from that which has superfluity, a certain fair commensuration, and not displeasing to God, will be imposed upon the matter, and the most holy Great Church will little by little be freed from its debt.
44:5
Alioqui si id, cui deest, forensibus superinductionibus suppleatur, id vero cui superfluit non minuatur, longum et infinitum temporis spatium decurret, donec omne id, quod abundat, deminuatur. Tua igitur beatitudo ea quae der enter nobis propter sacrosanct arum ecclesiarum utilitatem placuerunt, effectui et fini tradere studeat.
不然,若不足之處藉外來引入而補足,而有餘之處卻不減少,便要流逝漫長無盡的時日,直到一切多餘的都減盡為止。所以願閣下殷勤地把那些令我們喜悅、為至聖諸教會之益而適切頒定之事,引向施行與終局。
Otherwise, if that which lacks be supplied by external introductions, while that which has superfluity be not diminished, a long and infinite span of time will run on, until all that abounds be diminished. Let therefore Your Blessedness be zealous to bring to effect and conclusion the things which have pleased us, fittingly, for the benefit of the most holy churches.
44:6
Et si quid hæc contra fiat, scire necesse est, eum qui contra hanc nostram legem ordinationem suscipere ausus fuerit, quod nullam exinde I utilitatem habebit, neque venerabiles oeconomi eam impensam, quæ in hanc partem fit, in rationes sacrosanctae majoris ecclesiae referent, sed damnum inde emergens ipsi agnoscent, per semetipsos hunc socordiae suæ fructum recipientes. Dat. Idibus Augusti, Constantinop. post consulatum Belisarii v. c. Dat. XVII Kal. Aug. Constant. d. n. Bilis. v. c. cons.
若有任何違背此事之舉,必須知道:凡膽敢違背我們這條法律而承辦按立者,必因此一無所獲;可敬的司庫(oeconomi)也不可把這方面所生的開支記入至聖大教會的帳目,而是他們自己要承認由此而生的虧損,親自獨力領受他們疏忽的這份果子。頒於八月望日,於君士坦丁堡,在貝利撒留(顯赫之士)的執政官任期之後。頒於八月朔日前第十七日,於君士坦丁堡,吾主貝利撒留(顯赫之士)任執政官之年。
And if anything be done contrary to this, it is necessary to know that he who shall have dared to undertake an ordination contrary to this our law shall thereby have no benefit, nor shall the venerable stewards (oeconomi) refer the expense incurred in this part to the accounts of the most holy Great Church, but they themselves shall acknowledge the loss thence arising, themselves receiving by themselves this fruit of their negligence. Given on the Ides of August, at Constantinople, after the consulship of Belisarius, vir clarissimus. Given on the seventeenth day before the Kalends of August, at Constantinople, our lord Belisarius, vir clarissimus, being consul.
