257:1
Gregorius Joanni a episcopo primæ Justinianæ. Post longas tribulationes, quas Adrianus b Thebanæ civitatis episcopus a consacerdotibus suis, velut ab hostibus pertulit, in Romanam civitatem confugit. Et licet adversus Joannem c Larissaeum episcopum ejus ruisset prima suggestio, non ab eo in causis pecuniariis reservatis legibus judicatum; tamen post hæc magis contra personam fraterniiatis tuæ, a qua non juste se a sacerdotii gradu flagitabat esse dejectum, gravissime querebatur. Sed nos, indisrussis petitionibus non credentes, eadem quæ apud Joannem fratrem et coepiscopum nostrum, vel quae apud fraternitatem tuim sunt acta, relegimus.
Gregory to John, bishop of Prima Justiniana. After the long tribulations which Adrian, bishop of the city of Thebes, endured from his fellow priests as though from enemies, he took refuge in the city of Rome. And although the first accusation had been against John, bishop of Larissa, and no judgment was passed by him in the pecuniary cases reserved by the laws, yet after these things he complained most grievously rather against the person of your fraternity, by whom he demanded that he had been unjustly cast down from the grade of the priesthood. But we, not giving credence to petitions undiscussed, have re-read those same things which were done before John our brother and fellow bishop, and those which were done before your fraternity.

Et quidem de memorati Joannis episcopi Larissæ jcdicio, quod fuerat appellatione suspensum, satis et piissimi rerum Domini, ad d Corinthi episcopum missis jussio nibus, decreverunt. Et nos quoquc, per præsentium latores epistolis nostris ad præfatum Joannem Larissaeum directis, Christo auxiliante, decrevimus.
And indeed concerning the judgment of the aforementioned John, bishop of Larissa, which had been suspended by appeal, both our most pious lords of affairs have decreed, by sending orders to the bishop of Corinth. And we too, through the bearers of these presents, by our letters directed to the aforesaid John of Larissa, have, with Christ's help, decreed.

Cum vero diversi disceptationem judicii cujus examen libi imperialia jussa tradiderant, et inspectam gestorum apud Joannem episcopum de criminalibus habitorum seriem ventilavimus, reperimus prope nil te quod ad nominatas indictasque tibi causas aninuit exquisisse, sed machinationibus quibusdam testes adverstis Demetrium diaconum in damnationein ejutdem episcopi produxisse, qui eum de 1110, quod nee audiri fas est, testimonium dicentem se audivissc perhiberent. Quod dum præsens Demetrius coulradiceret se dixisse, adversus sacerdotalem 628 morem disciplinamque canonicnm, dejectum honore suo diaconum proconsuli provincias f tradidisse.
But when we ventilated the disputation of the judgment whose examination the imperial orders had committed to you, and inspected the series of the criminal proceedings held before John the bishop, we found that you had inquired into almost nothing that pertained to the causes named and charged to you, but that by certain machinations you had produced witnesses against Demetrius the deacon for the condemnation of the same bishop, who alleged that they had heard him giving testimony about that which is not even lawful to be heard. And when Demetrius, being present, contradicted that he had said it, against priestly custom and canonical discipline you handed over the deacon, stripped of his honor, to the proconsul of the province.

Qui cum, multis laniatus verberibus, adversus episcopum suum forsan aliQua potuisset tormentorum necessitate mentiri, usque ad finem negotii nihil eum de quibus interrogabatur penitus invenimus fuisse confessum. Sed nec alia in gestis ipsis, sive per depos!tionem testium, sive per Adriani professionem, qnod ei potuisset obesse, reperimus. Sed tantum fraternitas tua, nescio quo mentis motu, divino humanoque jure contempto, abruptam protulit in ejus damnatione sententiam; quæ licet non esset appellatione suspensa, contra leges tamen canonesque prolata, ipsa non poterat jure subsistere.
And when he, torn with many stripes, might perhaps have lied against his own bishop under the compulsion of the torments, we found that right up to the end of the affair he had confessed nothing at all of the things about which he was interrogated. But neither in the proceedings themselves, whether through the deposition of witnesses or through Adrian's own profession, did we find anything that could have told against him. But your fraternity alone, by some impulse of mind I know not what, despising both divine and human law, brought forth an abrupt sentence in his condemnation; which, although it was not suspended by appeal, yet being pronounced against the laws and canons, could not itself stand by right.

Postquam autem ex abundanti appellationem tibi constat esse porreclam, mirati sumus cur nec homines tuos secundum K cautionem lIonorato diacono nostro per responsales tuae Ecclesiæ expositam, qui tui judicii rationem potuissent reddere, transmisisti. Quod factum te vel de contumacia vel de conscientiae trepidatione redarguit. Si igitur haec quae nobis h oblata sunt veritate vallantur, quoniam occasione vicium nostrarum consideramus I vos injusta præsumere, de his alias secundum id quod a nobis deliberatum fuerit, Christo auxiliante, decernemus.
But after it is established that an appeal was superabundantly presented to you, we wondered why you did not even send your men, according to the security set forth to Honoratus our deacon through the responsals of your Church, who could have rendered the reason of your judgment. This deed convicts you either of contumacy or of a trepidation of conscience. If therefore these things which have been laid before us are fortified by truth, since we consider that on the occasion of our districts you presume unjust things, we shall, with Christ's help, decree concerning these matters at another time, according to what shall have been deliberated by us.
但既已查明有一份上訴已充分地呈交於你,我們便詫異:你為何連你的人都不派來——即照著藉你教會的代表向我們的執事何諾拉圖所立的保證所應派來、本可陳述你判決之理由的那些人。此舉便定你或有頑抗、或有良心的驚惶之罪。故若這些呈於我們面前的事有真相為之堅立,既然我們認為你趁我們轄區之便而擅行不義,我們必靠基督的幫助,按我們日後所議定的,於另一時就這些事作出裁決。

Quod vero ad praesens attinet, cassatis prius atquo ad nihilum redactis praedictae sententiæ tuae decretis, ei beati Petri principis aposiolorum auctoritate decernimus triginta dierum spatio te sacra communione privatum, ab omnipotenti Deo nostro tanti excessus veniam cum summa poenitentia ac lacrymis exorare. Qnod si hanc sententiam nostram te cognoverimus implesse remissius, non jam tantum injustitiam, sed et contumaciam fraternitatis tuae cognoscas, ad. juvante Domino, severius puniendam.
But as regards the present, having first quashed and reduced to nothing the decrees of your aforesaid sentence, we decree, by the authority of blessed Peter, prince of the apostles, that for the space of thirty days you be deprived of the sacred communion, and implore from our almighty God pardon for so great an excess with the utmost penitence and tears. But if we shall have learned that you have fulfilled this our sentence too remissly, know that not only the injustice but also the contumacy of your fraternity is, the Lord helping, to be more severely punished.

Praelatum vero Adrianum fratrem et coepiscopum nostrum ex tua sententia, ut diximus, nequaquam canonibus neque legibus existente oamnatum, in suum locum atque ordinem reverti Christo comilante disponimus, ut nec illi fraternilaiis tuæ noceat contra justitiae tramitem prolata sententia, nec charitas tua, pro placanda futuri indignatione judicis, incorrecta remaneat. (Vide inf. ep. 7 et 58. Cf. Joan. Diac. I. IV, c. 26.)
But our aforesaid brother and fellow bishop Adrian, having been, as we have said, by your sentence in no way condemned according to the canons or the laws, we arrange, Christ accompanying us, to be restored to his own place and order, so that neither may the sentence pronounced against the path of justice by your fraternity harm him, nor may your charity, for the appeasing of the indignation of the future Judge, remain uncorrected. (See below, epistles 7 and 58. Cf. John the Deacon, book 4, ch. 26.)
