The right of equity requires that what has been restored by our predecessors upon the truth being known, our Church ought not to hold anew unduly, lest the restitution—which is agreed to be utterly contrary to a religious purpose—seem to have been not real, but imaginary and rather deceitful. And therefore, since Stephanus, abbot of the monastery of Saint Mark, which is recognized to be established near the walls of the city of Spoleto, has complained to us that the estate called Massa Veneris, situated in the province of Campania in the territory of Minturno—which we know to have been restored to him by a precept of our predecessor Benedict of blessed memory—is now unduly withheld by our Church:

idcirco hac tibi auctoritate præcipimus, nt si manifeste ab Ecclesiæ nostrae hominibus detinetur, iu jus eam praedicti monasterii sine aliqua mora vel altercatione restituas. Si vero non a nostris, sed a quibusdam forsitan extraneis detinetur, strenua te agcre sollicitudine volumus, ut in jus modis omnibus memorali debeat monasterii reformari, quatenus et ipse quod suum est, te sulalianle, siue aliqua fatigatione recipiat, et alter de dispendio monasterii injusle lucrum. non habeat.
therefore by this authority we command you that, if it is manifestly withheld by men of our Church, you restore it to the right of the aforesaid monastery without any delay or dispute. But if it is withheld not by our men, but perhaps by certain outsiders, we wish you to act with strenuous solicitude, that it may by all means be restored to the right of the said monastery—so that the monastery itself, with you aiding, may without any exertion recover what is its own, and another may not have unjust gain from the loss of the monastery.
