Gregorius Felici episcopo Messanensi Januarius subdiaconus Ecclesiæ Messanensis petitoria uobis insinuatione suggessit, quoe habetur in subditis, in civitate Messanensi basilicam se pro sua devotione fundasse, qnam in honorem sancti Stephani. et Pancratii, atque Eupli,desiderat consecrari. Et ideo, frater charissime, si in tuæ diœcesis civitatis jure consistit, et ° nullum corpus ibidem constat Inmatum, percepta primitus donatione legitima, id cst a iræsentis anni tributis liberos fiscalibus so!idos decem, et reliqua dc substantia sua sibi tantummodo usumfructum retincat. Quæ omnia diligenter inquire;

Gregory to Felix, bishop of Messina. Januarius, subdeacon of the Church of Messina, has suggested to you by a petitionary intimation, which is contained in the subjoined matter, that in the city of Messina he has, out of his own devotion, founded a basilica, which he desires to be consecrated in honour of Saint Stephen, and of Pancratius, and of Euplus. And therefore, most dear brother, if it stands within the jurisdiction of a city of your diocese, and it is established that no body has been buried there, a lawful endowment having first been received—that is, ten solidi free of this present year's fiscal tributes, and the rest of his substance he shall retain only the usufruct thereof for himself. Inquire diligently into all these things;

ct si corum quæ offeruntur redituum quantitas, vel quae tempore mortis reli;uerint, sartis 572 lectis, ct luminaribus, necnon alimoniis servientium annua possunt praestatione sufficere, reipsa munilicentia sit gestis municipalibus alligata. Quod si hæc quæ dixitnus per sollicitudinem luam impleta non fuerint, de propria substantia quanti interfuerit utilitati Ecclesiæ te vti hæredes tuos satisfacturum esse non dubites. Ilis igitur procuratis, benedictio optata proveniat. Nec antc dcdicalionis munus impertias, quim superius comprehensus fuerit ordo donationis impletus.

and if the quantity of the revenues of the things that are offered, or of those which they shall have left at the time of death, can suffice by an annual provision for the repairs, the lights, and likewise the sustenance of those who serve, let the munificence itself be in reality bound by the municipal records. But if these things which we have said shall not have been fulfilled through your solicitude, doubt not that you together with your heirs are to make satisfaction from your own substance, as much as shall have concerned the welfare of the Church. These things therefore being procured, let the desired blessing come forth. Nor bestow the gift of dedication before the order of endowment set forth above shall have been fulfilled;
