802:1
Gregorius Theoderico regi Francorum. Scriptorum vestrorum eloquia incolumitatem vestram signantia laeti suscepimus, ex quibus ita transcendere vos prudentia ætatem agnovimus, 1221 ut evidenter appareat pro geniis Francorum felicitate excellentiae vestrae potestatis regiæ gubernacala supernæ gratiae favore fuisse commissa. Inter quae boc quoque in vobis salis laudabile mirandumque est, quod in his quae filiam nostram præcellentissimam aviam vestram pro omnipotentis Dei amore desiderare cognoscitis juvare sic studiosissime festinatis, ut per hoc * et hic feliciter, et in futura vita regnum cum angelis teneatis.

Gregory to Theoderic, king of the Franks. We gladly received the eloquent words of your letters signifying your good health, from which we recognized that you so surpass your age in prudence that it clearly appears that, for the felicity of the Frankish peoples, the helm of the royal power of your Excellency has been committed by the favour of heavenly grace. Among which things this too is quite praiseworthy and to be marvelled at in you, that in those matters which you know our most excellent daughter, your grandmother, to desire for the love of almighty God, you so most zealously hasten to help, that through this you may both here hold your kingdom happily and in the life to come hold it with the angels.

Quia ergo hoc Deo donante ex magna venit discretione judicii, ita omnia quae excellentia vestra voluit citius ac libenter implevimus, ut quantum nobis bona vestra placuerint effectus nostri celeritate nionsiraremus. Salutantes praeterea vos paterna dulcedine, indicamus, omnia quae viris illustribus famulis vestris Burgoaldo et Varmaricario filiis nostris apud nos agenda mandastis lacta nobis fuisse habito secreto colloquio manifesta. Et valde laudavimus, quia et præsentia sapienter, sicut decet, attenditis, et sic munire futura sempiternae pacis interventu inter vos et rempublicam festinatis I b ut, unum facti, regni vestri firmitalem in perpetuum salubriter extendatis.

Since therefore this comes, by God's gift, from great discernment of judgment, we have fulfilled everything that your Excellency wished the more quickly and willingly, so that we might demonstrate by the speed of our action how much your good deeds have pleased us. Moreover, greeting you with fatherly sweetness, we make known that everything which you commanded to be done with us through the illustrious men your servants, Burgoald and Warmaricarius, our sons, was made plain to us in a private conference. And we greatly praised it, because you both wisely attend to present matters, as is fitting, and so hasten to secure things to come by the intervention of everlasting peace between you and the commonwealth, that, being made one, you may healthfully extend the firmness of your kingdom forever.

De quibus succedenti vobis tempore quae Deo fuerint placita nuntiamus. Nam nos quidquid utile, quidquid probatur esse pacificum, desideramus, et ut fieri valeat studemus. Tantum est ut sicut nostra, ita quoque Dei, quo s:ne nihil possumus, in eis quas expediunt, sit voluntas. Sancta Trinitas in suo semper faciat vos timore proficere, et ita cor vestrum placita sibi moderationcdisponat, ut et nunc subjectis vestris de vobis, et postmodum vobis de se gaudium sine fine concedat. Concerning which matters, in the time that follows, we shall announce to you the things that are pleasing to God. For we desire whatever is useful, whatever is proved to be peaceful, and strive that it may be able to be accomplished. Only let there be, as ours, so also God's will—without whom we can do nothing—in those things which they promote. May the Holy Trinity ever make you advance in His fear, and so dispose your heart to what is pleasing to Him, that both now He may grant to your subjects joy concerning you, and afterward to you joy concerning Himself without end. b Quando ad ea ad quae catholicorum regum corda pontificalibus sunt monitis provocanda 1222 ita ardenti desiderio mvina præveniente gratia succenduntur ut ah eis ultro poscantur, tanto alacri et læ10 sunt animo coocedenda quanto et ea ipsa quae cupiunt, si nollent facere, peti debuerant.
當公教君王的心,對於那些理當藉主教的勸勉加以激勵之事,因先臨的天主聖寵而被如此熱切的渴望所點燃,以致這些事竟由他們自發地被祈求時,這些事就當以愈發熱切而喜樂的心予以應允;因為正是他們所渴望的這些事,倘若他們原不願去做,本就理當向他們懇求。
When to those things toward which the hearts of catholic kings are to be provoked by pontifical admonitions they are so kindled with ardent desire, by divine grace going before, that these things are asked of them of their own accord, they are to be granted with a mind so much the more eager and joyful, inasmuch as those very things which they desire ought to have been begged of them, had they been unwilling to do them.

Proinde, juxta scripta filiorum nostrorum praecellentissimorum regum Brunichildis ac nepotis ipsius Theoderici, senodochio quod in civitate Augustodunensi a Siagrio rcverendje memorias episcopo et prædicta excellentissima filia nostra regina constructum est, cui tu prsee se dignosceris, hujusmodi privilegia praesentis auctoritatis nostræ decreto indulgemus, concedimus, atque firmamus, statuentes i ullum regum, nullum antistitum, nul!um quacunque praeditum dignitate, vel quemquam alium de his quae xenodochio a suprascriptis præcellentissimis filiis nostris regibus jam donata sunt, cel in futuro a quibuslibet aliis de proprio fuerint jure collata, sub cujuslibet causæ occasionisve specie minuere vel auferre, sive suis usibus applicare, vel al is quasi piis causis, pro suæ avaritiae excusatione posse concedere.

Accordingly, in accordance with the writings of our most excellent sons the sovereigns, king Brunichild and her grandson Theoderic, to the hospice which was constructed in the city of Autun by Syagrius, bishop of reverend memory, and by our aforesaid most excellent daughter the queen, over which you are known to preside, we grant, concede, and confirm privileges of this kind by the decree of our present authority, ordaining that no king, no bishop, no one endowed with any dignity whatsoever, nor any other person, may under the pretext of any cause or occasion diminish or take away, or apply to his own uses, or grant to others as though for pious causes as an excuse for his greed, any of those things which have already been given to the hospice by our above-mentioned most excellent sons the kings, or which in future may be conferred upon it by any others out of their own right.

sed cuncia quae ibi oblata sunt, vcl offerri contigerit, tam a te qnam ab cis qui in tuo officio locoque successcrint pTrenni tempore illibata et sine inquietudine aliq a volumus possideri, eorum tamen usibus pro quorum sustentatione gubernalionequc concessa sunt modis omnibus profutura. lum constituimus ut, obcunte ahbate atque presbytero suprascripti xenodochii atque monasterii, nun alius ibi quacunque obreptionis astutia ordinetur, nisi quem rex ejusdem provinciæ cum consensu monachorum secundum timorem Dei elegerit ac praeviderit ordin -ndum.
但凡在那裡已被奉獻、或將要被奉獻之物,我們願其永遠由你、以及那些將繼承你職務與位分的人所持有,毫不減損、亦無任何攪擾——然而在各方面都當有益於那些人的用度,即那些為其贍養與治理之故而蒙准予之人。再者,我們規定:當上述收容所及隱修院的院長兼司鐸去世時,不得有他人藉任何暗中攫取的詭計在那裡受任,惟有那位由該省君王、經眾隱修士同意、按敬畏天主之心所選定並籌備受任者方可。
But all things that have been offered there, or that may happen to be offered, we will that they be possessed both by you and by those who shall succeed to your office and place, in perpetuity, undiminished and without any disturbance—yet in every way to be profitable for the uses of those for whose sustenance and governance they were granted. Moreover, we have established that, when the abbot and priest of the above-written hospice and monastery dies, no other be ordained there by any cunning of stealth, but only him whom the king of that province, with the consent of the monks, according to the fear of God, shall have chosen and provided for ordination.
802:7
Hoc quoque præsenti capitulo subjungimus, ut locum avaritiae excludamus, nullum de regibus, nullum de sacerdotibus, vel quemcunque alium per se suppositamve personam de ordinatione ejusdem abbatis, vel quibuscunque causis, ad xenodochium ipsum pertinentibus, audere in auro sive alia qualibet specie commodi quidquam accipere, neque eumdem abbatem ordinationis suae causa dare praesumere, ne hac occasione ea quae a fidelibus piis locis offeruntur, aut jam oblata Bunt, consumantur.
我們也藉本條文附加此規,為要杜絕貪婪的任何餘地:任何君王、任何主教、或任何他人,無論親自或藉中介之人,皆不得膽敢就該院長的受任、或就任何有關該收容所之事,以黃金或任何其他利益的形式收取任何財物;那院長也不得擅自為其受任而給予任何財物——免得藉此機會,那些由信眾奉獻於敬虔處所之物、或已奉獻之物,被耗盡。
This also we append by the present chapter, in order to shut out any place for greed: that none of the kings, none of the bishops, nor any other, by himself or by an interposed person, may dare to receive, in gold or in any other kind of gain, anything concerning the ordination of that abbot or in any matters pertaining to the hospice itself; nor may that abbot presume to give anything on account of his ordination—lest on this occasion those things which are offered by the faithful to pious places, or have already been offered, be consumed.
802:8
Et quoniam multæ occasiones in deceptionem religiosarum personarum 1223 a pravis illis, ut dicitur, hominibus exquiruntur, abbatem atque presbyterum praedicti xenodochii nullo modo i privandum deponendumque esse censemus, nisi causa specialiter criminis exigente. Unde necesse est ut si qua contra eum hujusmodi querela surrexerit, non solus episcopus civitatis Augustodunensis causam examinet, c sed, adhibitis sibi sex aliis coepiscopis suis. subtili hoc investigatione perquirat, quatenus, cunctis concorditer judicantibus, canonicæ districtionis censura aut reum ferire, aut innocentem possit absolvere.
又因為據說有許多機會被那些邪惡之人尋求,用以欺騙修道之人,我們判定:上述收容所的院長兼司鐸絕不可被剝奪職位或被罷免,除非確有罪案特別要求如此。因此必須:若有這樣的控訴針對他而起,不可單由奧頓城的主教審理此案,而須由他召集其六位同為主教者,以縝密的查究審察此事,使眾人一致判斷之後,教規嚴正的裁決或能懲治有罪者、或能開釋無辜者。
And since many occasions are sought out, as is said, for the deceiving of religious persons by those depraved men, we judge that the abbot and priest of the aforesaid hospice is in no way to be deprived or deposed, except when a case of crime specifically demands it. Whence it is necessary that, if any such complaint should arise against him, not the bishop of the city of Autun alone should examine the case, but, taking to himself six other of his fellow bishops, should investigate this by subtle inquiry, so that, with all judging in concord, the censure of canonical strictness may either strike the guilty or be able to absolve the innocent.

Simili quoque (definitione, d juxta desiderium condilorum, decernimus ut nullus eorum qui eidem xenodochio atque monasterio abbas, aut presbyter in posterum fuerit ordinatus ad episcopatus officium quacunque obreptione sit ausus aecedere, • nisi prius abbatis officio sit privatus, aliusque loco ipsius subrogatus, ne, rcs xenodochii vel monasterii iuiqua erogatione consumens, gravissimam egestatis necessitatem pauperibus ac peregrinis vel cæteris ex nde viventibus generet. Episcopum vero tollendi de eodem loco monachum ad ecclesiasticum ordnem promovendum, vel pro aliqua quacunque causa, sine consensu abbatis atque presbyteri.
我們也藉相同的規定,按建立者的意願,命令:凡此後將為該同一收容所及隱修院受任為院長或司鐸者,皆不得藉任何暗中手段膽敢晉升至主教職——除非他先被剝奪院長之職、並另有他人替代其位——免得他因邪惡的耗費而消耗收容所或隱修院的財物,為貧者、旅客及其他賴此為生者製造最沉重的匱乏之苦。至於主教有無擅權從該處帶走一名隱修士以擢升入教會聖秩、或為任何無論何種緣由,若未得院長與司鐸的同意,
By a like definition also, in accordance with the desire of the founders, we decree that none of those who shall in future be ordained abbot or priest for that same hospice and monastery may by any stealth dare to advance to the office of the episcopate, unless he has first been deprived of the office of abbot and another substituted in his place—lest, consuming the goods of the hospice or monastery by wicked expenditure, he beget the most grievous distress of destitution for the poor and the pilgrims and the others living from it. But that a bishop should have licence to take a monk from that same place for promotion to ecclesiastical order, or for any cause whatsoever, without the consent of the abbot and priest,
802:10
habere licentiam prohibemus, ne hujus rei usque ad hoc usurpatio perducatur, ut loca quae acquisitione hominum cunstruenda sunt, ablatione destruantur. Haec igitur omnia quæ hujus pra'cepti decretique nostri pagina continet, tam tibi quam cunctis qui in eo quo es ordine locoque suc cesserint, vel eis quorum interesse potuerit, in perpetuum servanda decernimus. Si q> is vcro regum, sacerdotum, judicum, personarumque sæcularium, hanc constitutionis nostre paginam agnoscens, contra eam venire leutaverit, potestatis honorisque sui dignitate careat, reumque se divino judicio existere de perpetrata iniquitate cognoscat.
我們禁止他享有這樣的擅權,免得此事的僭越竟推展至此,使那些理當藉招聚人手而建立起來的處所,反因人手的抽離而被毀壞。因此,凡我們此項訓令與法令的篇頁所載的這一切,我們命令當永遠被遵守,既由你、也由那些將在你所處的聖秩與位分上繼承你的人,以及那些於此事有干係的人所遵守。但若有任何君王、司鐸、審判官、或屬世之人,明知我們這規章的篇頁,卻圖謀違逆之,願他被剝奪其權力與尊榮的地位,並讓他知道自己因所犯的不義而在天主的審判前顯為有罪。
we forbid him to have such licence, lest the usurpation of this thing be carried so far that the places which ought to be built up by the acquisition of men be destroyed by their removal. All these things therefore which the page of this precept and decree of ours contains, we decree are to be observed in perpetuity, both by you and by all who shall succeed you in that order and place in which you are, and by those whose interest it may be. But if any of the kings, priests, judges, or secular persons, recognizing this page of our constitution, shall attempt to come against it, let him be deprived of the dignity of his power and honour, and let him know himself to stand guilty before the divine judgment for the iniquity he has perpetrated.
802:11
Et nisi vel ea quæ ab illo male ablata sunt restituerit, vel digna paenitentia illicite acta defleverit, a sacratissimo corpore ac sanguine Dei et Doolini nostri Redemptoris Jesu Christi alienus fiat, atque in aterno examine districtæ ultioni subjaceat. Cunctis autem eidem loco justa servantibus, sit pax Domini nostri Jesu Christi, quatenus et h c fructum bonae actionis recipiant, et apud distrietum Judicem præmia alternae pacis inveniant.
除非他或歸還那些被他不義奪去之物、或以配得的痛悔哀哭那些非法所行之事,否則願他被造成為與我們的天主、我們的主、救贖主耶穌基督至聖的體血隔絕之人,並在永恆的審察中受制於嚴厲的報應。至於凡向該同一處所持守公義之人,願有我們的主耶穌基督的平安臨到他們,使他們既在此世領受善行的果實,又在那嚴正的審判者面前尋得永恆平安的賞報。
And unless he either restores those things which have been wrongfully taken away by him, or bewails with worthy penance the deeds unlawfully done, let him be made a stranger to the most sacred body and blood of our God and Lord the Redeemer Jesus Christ, and let him lie subject to strict vengeance at the eternal examination. But to all who observe what is just toward that same place, may there be the peace of our Lord Jesus Christ, so that both here they may receive the fruit of good action, and before the strict Judge they may find the rewards of eternal peace.
