Gregorius Januario episcopo Caralitano. Quia ingredientibus monasteri im (Gral. 19, q. 3, c. 7) conver endi gratia d ulterius nulla sit testandi licentia, sed res eorum ejusdem monasterii juris fiant, aperta leg s definitione decretum est. Qn d cum pene omnibus notum sit, in magnam nos Gaviniæ abbatissæ monasterii b sanctorum Gavini atque Luxorii insinuatio admirationem perduxit, quod Siricam monasterii sui abbatissam, postquam regendi suscepit officium, condito testamento legata quibusdam asseruit reliquisse.

Gregory to Januarius, bishop of Cagliari. That for those entering a monastery for the sake of conversion there is thenceforth no further liberty of making a will, but that their property becomes of the right of that same monastery, has been decreed by open definition of the law. Since this is known to almost all, the intimation of the abbess Gavinia, of the monastery of Saints Gavinus and Luxorius, brought us into great astonishment, in that she asserted that Sirica, abbess of her monastery, after she had undertaken the office of governing, made a will and left legacies to certain persons.

Et dum de sanctitatis vc trae sollicitudine quæreremus cur res monasterio competentes ab aliis perculerit detiueri, communis filius Epiphanius archipresbyter vester præsens inventus respondit, memoratam abbatissam usque ad diem obitus indui se monachica veste noluisse, sed in vestibus quibus loci illius utuntur c presbyterae permansisse. Ad hæc repticabat prædicta Gavinia hoc pene ex consuetudine licuisse, adeo ut abbatissam quæ:unte suprascriptam Siricam fuerat talibus usam fuisse vestibus allegaret.

And when we inquired of your Holiness's solicitude why property belonging to the monastery was being detained by others, our common son Epiphanius, your archpriest, being found present, replied that the said abbess, up to the day of her death, refused to be clothed in the monastic habit, but remained in the garments which the presbyterae of that place use. To this the aforesaid Gavinia rejoined that this had been permitted almost by custom, so much so that she alleged that the abbess who had been before the above-written Sirica had used such garments.

Cum ergo de qualitate vestiuin hec nos mediocriter Coepissemus ambigere, necessarium visum est, tam cum consiliariis nostris quam cum aliis hujus civitatis doctis viris, qu d esset agendum de lege tractare. Qui tractantcs responderunt, postquam solemni more abbatissa ab episcopo ordinata est, et in monasterii regimine per annos plurimos usque ad vitæ suæ transitum præfuit, vestis qualitatem ad culpam 932 forte episcopi respicere, qui eam sic esse permiserit, non tamen potuisse monasterio præjudicium irrognre, sed res ipsius eidem loco ex quo illuc ingressa et abbatissa constituta est manifesto jure competere.
故此,因我們對那衣服的性質已開始有些疑惑,便顯得有必要,既與我們的謀士們、也與這城中其他有學問的人,商議按律法當如何行。那些議論的人回答說,一位女院長既已按莊嚴慣例由主教所按立,並主持修道院的治理達許多年之久、直到她一生的終了,那衣服的性質或許可歸咎於主教之過——就是他容許她如此——卻不能給修道院帶來損害,反倒她的財產以明白的權利歸屬那同一之處,就是她進入並被立為女院長之處。
Since therefore we had begun to be somewhat in doubt concerning the quality of the garments, it seemed necessary to treat, both with our counsellors and with other learned men of this city, of what ought to be done according to the law. Those who deliberated replied that, after an abbess has been ordained by a bishop according to solemn usage and has presided over the government of the monastery for very many years up to the passing of her life, the quality of the garment might perhaps look to the fault of the bishop, who permitted her to be thus, yet could not have brought prejudice to the monastery, but that her property belongs by manifest right to that same place, into which she entered and was appointed abbess.

Et ideo quia ex dimissis illicite rebns xenodochium possessionem asserit indebite detinere, his vos hortamur affatibns, ut quia et monasterium et xcnudochium ipsum in vestra est civitate positum, omni cura ac studio providere debeatis, quatenus si possessio ipsa ex nullo praecedenti contractu, sed ex memoratæ Siricæ legato descendit, ante dicto monasterio, postposito strepitu vel excusatione, redd itur. Si vero ex alio forte dicitur obvenisse contractu, aut fraternitas vestra, inter partes cognita veritate, quod tegalis suaserit ordo definiat,, aut mutuo sibi consensu arbilros eligant qui earum valeant allegationes ddistinguere.
故此,因那客旅收容所(醫院)被指稱不當地扣留了那從非法遺贈而來之物的產業,我們便以這些話勸你——既然那修道院與那收容所本身都位於你的城中——你當以全部的謹慎與熱忱籌謀,若那產業並非源於任何在先的契約,乃是出於前述西里卡的遺贈,就當把一切喧擾與推諉擱在一旁,將它歸還給前述的修道院。但若或許有人說它是從別的契約而來,那麼,或由你的弟兄之尊在雙方之間查明真相,裁定法律的次序所指示的;或由雙方彼此同意,選定仲裁者,使他們能分辨雙方的主張。
And therefore, since the xenodochium (hospice) is asserted unduly to detain possession out of things unlawfully bequeathed, we exhort you with these words that—because both the monastery and the hospice itself are situated in your city—you ought with all care and zeal to provide that, if that possession descends from no preceding contract but from the legacy of the said Sirica, it be restored to the aforesaid monastery, all clamour and excuse being set aside. But if it is said perchance to have come from some other contract, either let your Fraternity, the truth being ascertained between the parties, define what the legal order shall have advised, or by mutual consent let them choose arbitrators who may be able to distinguish their allegations.

A qu bus quidquid fuerit statutum, ita vestra provisione servetur, ut nullum inter venerabilia loca jurgium remaneat, quae magnopere alterna paeis sunt fovenda concordia. Alia igitur omnia quae ex testamento pra nominatae Siricae detinentur, quippe quod nullum esse legali sanctione permittitur, necesse est ut juri monasterii fraternitatis vestroc sollicitudine sacerdotali per omnia e studio reparentur, quia imperiali constitutione aperte I sancitum est ut ea quæ contra leges fiunt, non solum inutilia, sed etiam pro infectis habenda sint (Grat. 25,q. 2, c. 13).
凡經他們所定的,願你以你的措置如此謹守,使那些可敬之處之間不留任何爭執,因這些地方極當以彼此和平的和睦相互珍惜。故此,凡因前所提名之西里卡的遺囑而被扣留的其餘一切之物——既然律法的規定容許它為無效——就必須藉你弟兄之尊的祭司之關切,凡事熱心地歸還修道院之權下;因為皇帝的法令明白規定,凡與律法相違而行之事,不僅當視為無用,甚至當視為未曾發生(格拉提安25,問2,第13條)。
Whatever shall have been established by these, let it be so kept by your provision that no dispute may remain between the venerable places, which are greatly to be cherished by mutual concord of peace. All the other things, therefore, which are detained by virtue of the testament of the aforenamed Sirica—inasmuch as it is permitted by legal sanction to be null—it is necessary that they be, by your Fraternity's priestly solicitude, in all things zealously restored to the right of the monastery; for by imperial constitution it is openly sanctioned that those things which are done contrary to the laws are to be held not only useless, but even as though undone (Gratian 25, q. 2, c. 13).
