Gregorius Fortunato episcopo Neapolitano. Valde nos vestra miruri fecit fraternitas ut causam clerici sui aut noluisset, aut non assurgeret definire. Petrus itaque praesentium portitor ad ios veniens, questus est pueros a quibus de tentatione sceleris falso se asserit criminatum, 1072 non ut oportuit esse discussos, sed tantummodo verbo tenus inquis!tos, a et sibi propter hoc solum, ne vobiscum procederc audeat, interdictum. Aut enim vera fuere quae dicta sunt, et juxta causae qualitatein canonicae fuit cocretioni subdendus; aut falsa, et diu non debuit in criminc remanere.

Gregory to Fortunatus, bishop of Naples. Your fraternity has caused us much wonder, that you should either have been unwilling to define the case of your clergyman, or should not have set about it. And so Peter, the bearer of these presents, coming to us, complained that the boys, by whom he falsely asserts himself to have been charged with the temptation to a crime, were not examined as they ought to have been, but only interrogated in word, and that for this reason alone it was forbidden him to proceed with you, lest he should dare to do so. For either the things that were said were true, and according to the quality of the case he ought to have been subjected to canonical correction; or they were false, and he ought not long to have remained under accusation.

Quia et ratio indicit, et hic pro sui purificatione b sollicitus quæ adversum se dicta sunt apostolicam sedem adiit, et juxta elaminatione finiri perquirit, necesse est ut una cum Anthemio subdiacono nostro subtili ac districta discussione a pueris illis veritatem exigere debeatis. Et si prædictus portitor attentati facinoris reus esse patuerit, canonica modis omnibus ultine plectatur. Si vero insons fueril declaratus, celrri absolutione respiret, c et vobiscum habeat procedendi licentiam, quia sicut reis competens exercenda vindicta est, ita innocentibus non est absolutio differentia.

Since both reason demands it, and he, anxious for his own vindication, has come to the apostolic see concerning the things said against him, and seeks to have them concluded by examination, it is necessary that, together with our subdeacon Anthemius, you should by subtle and strict investigation demand the truth from those boys. And if the aforesaid bearer shall appear to be guilty of the attempted crime, let him by all means be punished with canonical vengeance. But if he be declared innocent, let him breathe again by a swift absolution, and let him have license to proceed with you; because just as the fitting penalty is to be exacted upon the guilty, so upon the innocent absolution is not to be deferred.

Sic ergo huic causae sollicite fraternitas vestra flnem studeat imponere, quatenus nullam de neglectu valeat reprehensionem incurrere.

Therefore let your fraternity carefully strive to put an end to this case, so that you may incur no reprehension for neglect.
