Gregorius Joanni episcopo Syracusano. Gloriosissimus filius noster Faustus directa petitione nos adiit, asserens fines possessionis suæ illic Intra Siciliam positos a vestris nuper hominibus occupatos, atque ob hoc rem violenter ablatam sibi per praeceptionis nostrae seriem debere petiit reformari. Quod quia, si ita ut asserit factum est, a fraternitatis vestrae cognitione omnino credimus alienum, diligenter inquirite. Et si, ut asserit, contra juris ordinem fines ipsius a possidente sublati sunt, a in possessoris redeat res pervasa dominium.

Our most glorious son Faustus has approached us with a direct petition, asserting that the boundaries of his estate situated there within Sicily have lately been occupied by your men, and on this account he has petitioned that the property violently taken from him should be restored to him through the tenor of our directive. Since we believe that this, if it was done as he asserts, is altogether unknown to your Fraternity, inquire diligently. And if, as he asserts, his boundaries have been taken from the possessor contrary to the order of law, let the invaded property return into the possessor's ownership.

Et tunc si quid est quod a vestra Ecclesia proprietatis jure utiliter opponatur, electorum debet judicium provenire, eorumque judicio terminari, dummodo indecenter possessoris jus minime perturbetur. Sed causa judiciafi termino definita, sine sacerdotali invidia dominum atque justitiam res manifesta cognoscat.

And then, if there is anything that can with advantage be advanced by your Church by right of ownership, judgment by chosen arbiters ought to be held, and the matter ended by their judgment, provided that the possessor's right be in no unseemly manner disturbed. But when the case has been settled by a judicial conclusion, let the manifest facts recognize both the ownership and the justice, without any odium to the priesthood.
